All lots are sold "as is". Any sales are final with no refund, no credit, and no exchange.

Description and/or photographs of lots are not warranties. Every lot and item is ready for the prospective bidders/purchasers to inspect and examine completely and thoroughly prior to the time of sale. It is the bidders/purchasers' sole responsibility to determine the condition and quality of lot (including wear and tear, perfection, measurement, weight, height, composition, mixture, and all the other aspects), age, origin, value, and authenticity of the lots and items.168 auctions endeavors to describe the items for sale, but NO any written and oral descriptions in the website, catalogue, or elsewhere or by the staffs and representatives of 168 auctions shall be considered as a express and implied guarantee or warranty of any kind. Such descriptions are opinions only, and can not be considered as a guarantee, warranty, or assumption of liability of authenticity, history, age, composition, artist, item condition, value, correctness, and so on. The absence of a condition description can not be considered that the item and/or lot is in perfect condition or free from defects. Each item might carries natural wear and tear and imperfection because of its age and history. By attending the bidding, the bidders/purchasers are considered that they are totally satisfied with the lot/item, they have inspected thoroughly by themselves or their agents, or have abandoned the inspection voluntarily.

Each lot sold is subject to a buyer premium of 20% of the successful bid price.

The buyer is required to pay Harmonized Sales Tax (HST) on the total purchase price including the buyer's premium unless exempted by law. HST is not applicable for the international buyers if the lot/item is shipped out of country. If the lot/item is shipped out of Ontario, the buyer is required to pay taxes as per the tax status of that province.

The auctioneer has the right to withdraw any lot from sale at any time, to reopen the bid, to refuse any bid, to advance the bidding, and not to accept and not to reject any bid at his sole and absolute discretion, all without notice. If any dispute should arise between the bidders, the auctioneer's decision shall be final and our record is conclusive in all cases.

The buyer shall be the highest bidder accepted by the auctioneer for any lot. The buyer shall pay for all lots within 10 business days from the date of the sale.

Payment for the purchase can be by cash, bank draft, certified cheque, wire transfer (all can be in U.S. or Canadian dollars).For payment by wire transfer, 168 Auctions Inc. will issue $40 credit to invoice total which is equal to or over $2000, or $20 credit to invoice total which is less than $2000 and more than $400.

For telephone/absentee bids, 168 Auctions Inc. will endeavor to execute the order, but will not be responsible for failure to execute a bid and is not liable for any losses incurred as a result of failure to execute absentee bids. For live internet bidding, 168 Auctions Inc. is not liable for any bids that are not received and executed for any reasons (such as networking problems, computer errors, and any other technical problems).

The buyer should understand that any item bought may be affected be the provisions of Cultural Property Export Act or by restrictions placed on the import and export of materials related to the endangered species. Items bought shall be paid for in accordance with these conditions of sale and the denial of any export or import licence or any delay in the obtaining of such licences shall not justify the cancellation of any sale or any delay in making payment of the total purchase price for the lot.

The collection and use of client's personal information are for communication between clients and 168 Auctions Inc. and use of company's business service, such as setting up account, attending the auctions, invoicing for goods and services, processing payments , and arranging the shipment, etc. We consider and treat clients' personal information TOP confidential and utmost important. We will NOT sell, lease, rent any of clients' personal information. We will not disclose any of personal information unless required by regulatory authorities and government based on law. In the event this kind of requirement arises, we will contact and notify you first and forward the requirement directly to you for review.

168 Auctions reserves the right to refuse admission to the sale or to refuse to recognize any or all bids from any particular person, persons, or companies at any auction, and to edit any of the condition of sale and terms without notice and explain the condition and terms. The law of the Province of Ontario, Canada shall apply if there is dispute.
