In the event a reserve price has been set, the Auctioneer reserves the right to bid on account of the Seller. If the reserve price set by the Seller is not met, the next lot will be offered for sale by rapping the hammer. 11. The Buyer shall pay a commission of 25% (VAT 8% included) for lots sold at a bid price until CHF 1'000.-; 22.5% (VAT 8% included) for lots sold at a bid price between CHF 1'001.- and CHF 50'000.-; 20% (VAT 8% included) for lots sold at a bid price between CHF 50'001.- and CHF 100'000.-: 17.5% (VAT 8% included) for lots sold at a bid price of 100'001.- or more. CONDITIONS OF SALE Buyers for Cars and Motorcycles will pay a 17.5% Buyers Premium (8% VAT included). For items which are marked with an asterisk (*) in the Catalogue the VAT 8% will be charged on the full amount. (Bid price plus commission). PAYMENT AND?COLLECTION 12. All payments for property bought at auction shall be made in cash and in Swiss francs or via bank transfer. Cheques are not accepted. 13. One may pay by Maestro, EC-Direct and Postcard without extra fees. An additional fee of 2% will be added on one's invoice for payment by the credit cards Visa or Mastercard. GALARTIS SA does not take American Express or other credit cards. 14. Title to the property shall not pass to the Buyer until it has been delivered to and paid in full by the Buyer. 15. Property bought at auction must be removed at the expense and risk of the Buyer: - during and at the end of the sale. 16. Galartis SA can help you briefly wrap your purchase. Galartis does not take responsibility for wrapping porcelain, glass, cristal or unhang lamps. Therefore Galartis' employees are not allowed to wrap these lots for you. For home delivery, the Buyer may contact GALARTIS SA. Deliveries and shippings are at all risks and expenses of the Buyer. 17. Ten days after the sale, and without further notice, the purchased lots will be stored at the expense and risk of the Buyer in a storage room. In contravention of Article 486 OC, the Buyer allows GALARTIS SA to sell or get rid of the lots when the storage fees are left unpaid for two consecutive quarters. APPLICABLE LAW AND?JURISDICTION 18. Any dispute arising out of or in connection with the sale shall be governed exclusively by laws of Switzerland. Buyer shall be deemed to have consented to the exclusive jurisdiction of the Courts of the Canton of Vaud regardless of the domicile of the parties to such dispute. However, GALARTIS SA will also have the possibility to file its claim at buyer's domicile/head office, or in front of any other competent court, subject to a possible appeal to the Supreme Court of Switzerland in Lausanne. The French version of these Conditions of Sale is the only reference applicable.

Terms and Condition

1.The auctioneer acts as an agent for unnamed consignors. Business currency is Euro.

2. Every lot can be examined before the auction. Consignments for approval cannot be sent. You may request further photos. All lots are sold as they stand with any fault, imperfections and errors of description. All descriptions are made conscientiously by our experts but without warranty.

3. The auctioneer has the right to separate, rearrange, withdraw or leave any lot without any declaration. He has also the right to exclude persons from the auction sale without giving any reason.

4. We accept mail bids (also e-mail and fax bids, if the client is known). All these bids will be handled with care but without any guarantee. Please indicate your preferred method of dispatch of the purchased lots (airmail, customs declarations, and special insurance). Minimum prices are starting prices as well as reserve prices. Underbids cannot be accepted.

5. Czerny's is not responsible for any eventual restrictions on export.
Please always check the availability in import lots in your country.

6. The lots are knocked down to the highest bidder. Unknown bidders have to give a satisfactory reference and have to place either a deposit before bidding or a proof of identity (Passport, ID), otherwise the auctioneer may not accept their bids. Should two bids have reached the same maximum price limit, the auctioneer has sole discretion to award the lot to the high bidder of his or her choosing; he may also declare the transactions at issue annulled, and repeat the bidding, at the very same auction session or the one after, for a starting price equal to the highest bid received in the hall or in writing and uncontested.

7. From the time that a lot has been knocked down, all risks lie with the buyer, but all lots remain the property of the auction house until full payment has been effected. The buyer must wait for a paper or digital invoice from Czerny's after the auction's end before any payment is made. The invoice is automatically generated and it includes the total amount due, including buyers premium (25.06%) + Platform Transaction Fee (3%). PLEASE NOTE THAT 25.06% BP INCLUDES ITALIAN TAXES EVERY CLIENT HAS TO PAY.
Once received the payment of your purchase, you will receive a new pro-forma invoice for packaging and shipping costs exclusively. In case you do pay with Credit Card please note we'll add 2.9% on top of your total invoice. The full amount has to be paid immediately in Euro. Foreign mail bidders must pay within ten days after receipt of the invoice. Checks are accepted only by special agreement and must cover also bank charges. If a buyer acts as an agent for third parties, he may be hold responsible, even if the name of this third party appears on the invoice.

8. All lots of an invoice will remain in the auction house until the whole amount has been fully paid. Delays in payment may cause extra charges and legal interest. The auction house may store or resell lots at the expenses of the buyer if the invoice has not been paid in time.

9. Consignments are made at the buyer's risk and expense. In case of damage or loss of a package the buyer must file a claim at the post officer, airline etc. immediately. Without these official papers the insurance company cannot be held responsible. After an auction the purchased lots have no insurance.

10. If any misunderstanding would result from mail bids, phone calls, faxes, letters, telegrams, e-mails etc., they are at the vendor's and the buyer's risk. Invoices written during or right after the auction may be corrected later.

11. Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. Czerny's International Auction House has no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effect of aging.

12. Please be aware that delivery time for purchases shipped by our premises is approximately six weeks from receipt of payment. In case of lots considered arms for Italian law, we need an official permit from the local bureau before sending the items.

13. If you want to bid live with Internet applets and dedicated websites please note we will be selling about 100 lots per hour; Czerny's International Auction House is not responsible for internet connection problems or third parties applet problems during the online auction.
We strongly suggest our internet bidders to always leave an absentee bid on our website for the lots they want to bid online first. We are not responsible if we do miss bids during the live auction or skip lots. Please note that the bid increment as shown on your screen may vary from the bid increment in the floor. The Auctioneer is the only one determining the bid increment at the time of the auction.

14. Czerny's will facilitate the shipping of purchases to out-of-town buyers at an additional charge for packing, shipping and insurance as included in the attached, but will not be responsible for any loss, damage or delay resulting from the packing, handling and shipping thereof.
Unless specific instructions are received, Czerny's is the sole judge of the method to be used for shipment. Packing and shipping costs will be noted on the final invoice sent to successful bidders after the sale, and are based on the actual costs involved. Be advised that a full commercial invoice must accompany any purchase shipped outside Italy.
In case of lots considered arms or antiques for Italian law, we need an official permit from the local bureau before sending the items and delivery time for purchases shipped by our premises is approximately six weeks from receipt of payment.

In case you wish to personally pick up your paid items please contact us before. Please be mindful that only people authorized by the Italian police can transport arms (including but not limited to swords, daggers, firearms, poled weapons) through Italian territory.
The exhibition area of the Auction House is open for pick-ups Monday through Friday from 9:30 am until 5:30 pm.

Contract

As part of signing up to participate in an auction through online bidding, all users agree to the terms and conditions of the auction before placing a bid. Once the winning bid has been accepted, you are the legal owner of the lot and are required to settle payment.

Buyers Premium

The Auction House takes a commission charge of 25.06% of the hammer price (included Italian IVA taxes, not refundable).
