Accepted forms of payment: bank/wire transfer. Payments up to EUR 4,000 also by VISA or Mastercard. Payments to Villa Grisebach shall be made in Euro. If payments are made in a foreign currency, an exchange loss, if any, shall be borne by the Buyer. Cheques and other non-cash payments will be accepted as conditional payment only.
All taxes, costs and charges in connection with the payment (including the
bank expenses charged to Villa Grisebach) shall be borne by the Buyer.

Shipping

All transportation and insurance charges are at expense of the buyer.

Buyers Premium: a) Standard Taxation (marked "R")
Villa Grisebach charges a premium of 22% on the hammer price.
Droit de Suite (artist's resale rights)
Villa Grisebach charges the buyer a flat rate of 1.5% based on the
hammer price up to a maximum amount of EUR 12,500.00 as a
pro rata compensation for the legal obligation of the resale right
(droit de suite) duty on all original works of art as well as original
photographic works, whose originators did not decease 70 years
before the end of the calendar year of the sale. Villa Grisebach will
pay the resale right (droit de suite) duty accordingly.
Value-Added Tax
The statutory VAT is added to the hammer price, the premium as well
as the flat rate for the pro rata compensation of the resale right
(droit de suite) duty in the case of buyers residing in the EU (European
Union). (A 7% VAT-rate is currently imposed on original works of art
and, a 19% VAT-rate on photographic works as well as reproductions
and serigraphs.).
b) Differential Taxation
For buyers residing within the EU the purchase price will be subject to
the differential taxation according to § 25a UStG (German VAT Code)
unless otherwise noted. Villa Grisebach will charge a premium of 30%
on the hammer price. Such premium includes the flat fee for the pro
rata compensation of the resale right (droit de suite) duty as well as the
statutory VAT that will not be disclosed separately in the invoice.
At the request of buyers who are entitled to deduct the input tax (VAT)
a regular invoice can be issued pursuant the provisions of the standard
taxation. Such request must be specified when applying for the paddle.
An amendment is not feasible once the invoice is issued
c) Special Provisions for Importation and Exportation, Exemption from Value-
Added Tax
No value-added tax will be charged for works of art, which are to be
delivered
- into countries outside the European Union (EU) or
- into countries within the EU to entrepreneurs for commercial purposes
and where the same have indicated their turnover tax identification
number when receiving their Bidder's number pursuant to § 2 sub-para. 1.
If Buyers residing outside the EU take with them the work of art bought
atthe Auction to countries outside the EU, they have to furnish a security in
the amount of the statutory value-added tax. This tax will be refunded
when the Buyer presents within one month of the receipt of the work of art
proof for the exportation and purchase issued by a customs office of the
EU ("Ausfuhr- und Abnehmernachweis"). Import turnover tax and customs
duties accruing abroad shall be borne by the Buyer.
d) The aforementioned policies under lit a) b and c as well as lit b) and c)
are in conformity with current legislation and the conventional practice
of the German fiscal authority. They may be subject to change.
