• NON-PAYMENT
In conformity with Article 14 of Law #2000-642 cited above, in case of non-payment by the buyer, after notice and demand to pay requested by the seller has been ignored, the lot will be put back up for resale without the consent of the non-paying buyer. In this case, Enchères Rive Gauche reserves the right to claim from the non-paying buyer the amount of the difference between the original purchase price and the purchase price of the resale should it be inferior. If the consignee does not formulate his demand within one month, counting from the day of the sale, he cedes his right to Enchères Rive Gauche, by derogation of the law previously cited, to act in his name and for his account as Enchères Rive Gauche sees fit and proper, either in cancelling the sale or in bringing proceedings against him for the execution and payment of the sale. Enchères Rive Gauche reserves the right in particular to:

- claim from the non-payer interest on the whole of the sum owed at the legal rate applicable, plus a penalty of 5 points.

- claim and receive from the non-payer the reimbursement of all expenses incurred by Enchères Rive Gauche due to the non-payment.
- proceed to compensate with any sums which the non payer may be due from Enchères Rive Gauche.
Enchères Rive Gauche also reserves the right to reject all bids from the non-payer for future sales.

Buyers are expected to remove property rapidly so as to avoid fees for handling, eventual transfer and storage which become the responsibility of the buyer as soon as he has been named the successful bidder. Handling, transfer and storage are no longer the responsibility of Enchères Rive Gauche. It is the buyer's responsibility to insure his purchases as soon as he has been named the successful bidder since, from the moment of this commitment, all risks of theft, loss, damage or otherwise become his entire responsibility. Enchères Rive Gauche declines all responsibility for any damage in itself or the failure of the buyer to cover his risks against any damages.

Enchères Rive Gauche is a company selling property at public auction, governed by the measures under Law # 2000-624 of July 10, 2000. As such Enchères Rive Gauche acts as an agent for the seller who contracts with the buyer. The only legal reference regarding descriptions, estimates and conditions of sale is the French version printed in this catalogue.

Nobody will be allowed to bid without reception, before the beginning of the sale, of a credit card or cheque in order to guarantee the payment. If the bidder is not the buyer, those documents will be restored to him at the end of the sale.


The sale is conducted in Euros and is payable upon the fall of the hammer to Enchères Rive Gauche on behalf of whom the auctioneer is acting.

Enchères Rive Gauche reserves the right to put lots together or to separate them, as well as to pull any lot or part of a lot for a legitimate reason, without this engaging its responsibility. More generally, Enchères Rive Gauche reserves the right to organise the auction in the manner which it deems most appropriate. Property is usually auctioned in consecutive numerical order as the lots appear in the sale catalogue. In case of dispute during or after the sale, Enchères Rive Gauche reserves the right to determine the successful bidder, to continue the sale, to cancel the sale, or to reoffer and resell the article in dispute. Subject to the auctioneer's decision, the highest and last bidder for a lot will be the buyer, provided that his final bid on this lot will have at least equalled the reserve price.

If a reserve has been placed on a lot, Enchères Rive Gauche reserves the right to bid on behalf of the seller of this lot up to the reserve price. The seller will not be allowed to bid directly or indirectly on the lots which he has decided to sell at auction. The fall of the auctioneer's hammer signals the end of bidding. The announcement by the auctioneer that a lot has been "Sold" or any other equivalent, signals that a contractual agreement has been established between the seller and the buyer.

By bidding on a lot using any of the means proposed by Enchères Rive Gauche, bidders personally assume responsibility for paying the hammer price, plus the buyer's premium, together with any applicable sales or compensating use tax which may be due. Bidders are assumed to act in their own names and for their own accounts, except when a written prior agreement established prior to the sale has been established with Enchères Rive Gauche, mentioning that the bidder is acting as a representative for a third person recognized by Enchères Rive Gauche. Bidders acting for third persons, and these latter, are wholly and fully responsible for executing the engagements undertaken by all buyers according to the law and to the conditions of sale outlined in the present document. In case of dispute concerning this third person, Enchères Rive Gauche will hold the bidder solely responsible for the bid in question.

Premium: • BUYER'S PREMIUM

VAT: PRINCIPAL RULES CONCERNING THE VAT
Potential buyers are encouraged to inform themselves before the sale as to their situation in regard to the VAT, and that of the lots for sale.

- Margin Scheme
Enchères Rive Gauche will put lots under the margin scheme as defined by the measures instituted by the 7th European Community Directive from February 14th 1994. Under this regime, VAT is not charged on the hammer price, and the VAT included in the buyer's premium inclusive of tax, cannot be recovered. For this reason, the bill of sale does not list the VAT separately.

- Option for the "Régime général"
Companies within the European Community and subject to VAT which can prove by the presentation of their intraEC VAT number may opt to recover VAT. To do so, they must make a formal request to Enchères Rive Gauche immediately after the sale. The VAT at the applicable rate will thus be applied on the hammer price and on the buyer's premium and the bill of sale will list the VAT separately. The VAT appearing thus on the bill may be recovered, but lots thus acquired cannot be resold under the margin scheme.

- Lots exported after the sale
VAT, whether that charged in the buyer's premium or that charged at the moment of importation of the lot, may be retroceeded to buyers upon presentation of the documents prooving the exportation of the lot outside the European Union within three months after the sale. No time limit is required for non-resident professionals.

Diverse: • DEFINITIONS
"Reserve price": The auction price below which a lot will not be sold. If the lot has been estimated by Enchères Rive Gauche, its reserve price will not exceed the low pre-sale estimate given in the sale catalogue. "Hammer price": The highest bidding price which is at least equal to the reserve price. "Purchase price": The price owed by the "successful bidder" or "buyer", including the hammer price, plus the buyer's premium, together with any applicable sales or compensating use tax which may be due.

• WRITTEN OR ORAL INFORMATION
The descriptions of lots in the sale catalogue, condition reports, tags, and written or oral opinions are those given by Enchères Rive Gauche of its perception of the lots and not the affirmation of fact. As such, these descriptions do not constitute a warranty. The absence of indications pertaining to incident, accident, restoration, and / or any measures of conservation in no way indicates that the lot is exempt of all defects, of restoration or of measures of conservation. Any particular reference to a defect, restoration or measures of conservation does not imply the absence of other defects, restoration or measures of conservation. Estimations are furnished purely as an indication. Estimations cannot be considered as a guarantee. Estimations are listed in Euros.



• CONDITION OF LOTS
Enchères Rive Gauche recommends that potential buyers examine the lot or lots which interest them before the auction. Lots are usually on view before the sale, and condition reports are usually available on request. In any case, all lots are sold "as is" at the moment of the fall of the hammer, with their eventual imperfections or defects.



• PREEMPTION
In certain cases defined by law, the French State has a right of preemption on works sold at public auction. Should it exercise this right, the State substitutes itself for the highest bidder, as long as it invokes this right in a declaration by its official representative after the fall of the hammer, and confirms it within fifteen days from the date of sale. Enchères Rive Gauche cannot be held responsible for decisions taken by the French State concerning preemptive rights.


• OPPOSABILITY
The present conditions of sale are opposable to consignors, bidders and buyers, as well as to their representatives. By bidding at auction, bidders agree to be bound by these terms and conditions.

• MODIFICATIONS
All amendments to the present conditions of sale as well as modifications pertaining to descriptions, notifications or other declarations concerning a lot figuring in the sale catalogue or posted in the sale room are valid on condition that the aforesaid amendments or conditions have been the object of a written or oral announcement by the auctioneer, and made before the lot concerned is opened for bidding. These opinions will be noted in the sale record.

• AUTONOMY OF TERMS AND CONDITIONS
The terms of the present conditions of sales are independent of one another. The invalidity of any one of these measures does not imply that the others become inapplicable.

• COMPETENCIES
Any complaint is exclusively within the competence of the Courts with jurisdiction over them in Paris, France.
