January 26, 1814, JOHN ADAMS ALS to RICHARD RUSH Regarding LAW + The WAR OF 1812

by Early American

May 21, 2016, 9:00 AM PST

Rancho Santa Fe, CA, USA

Estimate: $25,000 - $35,000

Description: AutographsJohn Adams Writes to Richard Rush, Comptroller of the U.S. Treasury and Soon to be Attorney General - "To push the War with Vigour, till We have a Peace, neither disgraceful to the Nation or the Government..." Important & Historic War of 1812 Period Content!JOHN ADAMS (1735 - July 4, 1826). 2nd President of the United States (1797-1801), American Founding Father, Lawyer, Statesman, Diplomat and Leading Champion of American Independence in 1776, Defended the British Soldiers involved in the "Boston Massacre," a Leading Federalist.January 26, 1814-Dated War of 1812 Period, Important Autograph Letter Signed "John Adams", 1 page, 9.75" x 8", Quincy (MA), Choice Very Fine. Adams personally writes to Richard Rush (1780-1859), the son of Signer of the Declaration of Independence, Benjamin Rush. This very personal and intellectual Letter is regarding his "Hawkish" position on the successful conclusion to the War of 1812 and Richard Rush's ideas on the American Legal System, just days prior to his being Appointed as Attorney General of the United States. Adams opens his Letter with the wonderfully penned line; "If I may judge others by myself,...".From his position as Comptroller of the U.S. Treasury, Richard Rush functioned as one of President Madison's closest friends and confidential advisors throughout the War of 1812. He was one of the War "Hawk" who advocated War with Britain. In 1814 Madison offered Rush the choice of Secretary of the Treasury or Attorney General of the United States, of which positions Rush chose the latter. With his appointment as Attorney General, Rush became the youngest person to ever serve as the United States Attorney General. At this same time, the Attorney Generalship was only a part-time position, and so Rush also maintained his private law practice while he was in this office.Richard Rush was the 8th United States Attorney General under President James Madison, in office from February 10, 1814 to November 12, 1817. He edited a codification of United States laws during this time. Later, he became the United States Secretary of the Treasury under John Quincy Adams, as well as John Quincy Adams' Presidential Campaign Running Mate when he ran for re-election on the National Republican ticket in 1828. Rush also served as United States Minister to England and France at various times. Here, John Adams first comments upon a legal treatise written by George Hay (1765-1830). Hay was an American Jurist, who is best remembered as U.S. Attorney for the District of Virginia, in which capacity he conducted the prosecution of Aaron Burr for Treason. In the second paragraph, John Adams, is discussing "Universal Law," and refers to Sir William Blackstone (1723-1780), the British Jurist, whose history of the doctrines of English Law were very influential on jurisprudence in the United States. This Letter is in excellent quality, penned completely in John Adams' hand, upon clean period wove paper. The text is easily readable in rich brown, well written and clear. There are expected faint mailing folds, only one slight ink smear, attesting to its originality. Overall, it is of superior quality, one sided and perfect for display. This Letter is of important historical content. It reads, in full;"Quincy -- Jan 26. 1814 --- Dear Sir --- If I may judge of others by myself, Mr. (George) Hay had no cause of apprehension that he should be tedious: for when I had read the first page I could not lay aside the book til I had read the last. I know not when I have seen a discussion of any legal or political question pusued with so dispassionate a temper; or written with more perspicuity, accuracy of luminous arrangement. The author is Master of his Subject and all the Learning neccessary to support his Position. What can (Sir William) Blacstone mean by universal Law? Are the cannon Law and the feudal Law, universal Laws? Are the Pope or his eldest Son the Emperor universal Legislators? Is any Law universal, but the law of our natures, written on our hearts, and obligatory on all Men from their beginning and through all their dispersions? The Doctrine of Universal and perpetual, inherent and inalienable Allegiance has no other foundation, than in a degrading Superstition and an unrelenting Despotism. To push the War with Vigour, till We have a Peace, neither disgraceful to the Nation or the Government is the Sincere hope and ardent Wish of my heart: Your assurance therefore of a determined Spirit in all Branches of the Government, is delightful to me.Our northern gentry are foaming to Stop the Wheels: but all will end in securing their State Elections. --- I am &c (Signed) -- John Adams".Richard Rush served as Comptroller of the U.S. Treasury (1811), Attorney General (1814-17_, Secretary of State (1817), and Minister to Great Britain (1817-25). Later he served as Secretary of the Treasury (1825-28) and Minister to France (1847-49).

Blank Ship's Passport Signed by John Quincy Adams & James Monroe

by University Archives

May 19, 2016, 10:30 AM EST

Westport, CT, USA

Estimate: $1,200 - $1,500

Description: Ship's Passport signed in full by the 5th and 6th U.S. Presidents, James Monroe and John Quincy AdamsJAMES MONROE (1758-1831) JOHN QUINCY ADAMS (1767-1848) Party Printed Document Signed "James Monroe" as President and "John Quincy Adams" as Secretary of State, 1p, 10" x 13.75", Washington, no date, but 1817-1825 . Scalloped top edge. Ships Papers signed in blank, not filled in. On vellum. Since this document was never issued, the seal was evidentially removed by the Collector of the Port. Two heavy horizontal folds ,other folds, one passing vertically through first "o" in Pres. Monroe's dark signature. Two vignettes at top center, one depicting a clipper ship, the other, beneath it, a seascape with lighthouse near a town with numerous ships pictured. Fine condition. This document was signed in blank in Washington, D.C., by President Monroe and Secretary of State Adams to be sent to a United States port to be filled out, signed, and issued from there by the Collector of the Port. The Collector, or an assistant, would fill in the name of the ship and all the required information.John Quincy Adams was James Monroe's only Secretary of State, serving from 1817 until 1825 when he succeeded Madison as President. It is probable that when Ships Papers signed in blank by Monroe's and Adams' successors, John Quincy Adams and Henry Clay, reached a Collector, he put aside the blank Monroe/Adams Ships Papers and replaced them with the newly signed Adams/Clay documents, although the previously signed ones could also have been legally used.In full, "By the President of the United States of America Suffer the ____ master or commander of the burthen of ____ tons or thereabouts mounted with ____ guns navigated with ____ men To Pass with her ____ Company Passengers Goods and Merchandize without any hindrance seisure or molestation the said ____ appearing by good testimony to belong to one or more of the Citizens of the United States and to him or them only. President Millard Fillmore honors an autograph request for collector Louis Cist

by University Archives

May 19, 2016, 10:30 AM EST

Westport, CT, USA

Estimate: $300 - $400

Description: Millard Fillmore fulfills a request for his autograph!MILLARD FILLMORE (1800-1874) Autograph Letter Signed, "Millard Fillmore," as Vice President, 1 page, 7.5" x 9.5", Buffalo, November 8, 1849, to noted collector Louis Jacob Cist (1818-1885) honoring an autograph request. Laid in to a larger sheet, expected folds, very light soiling, else fine.Fillmore writes, in full: "I am honored by the receipt of your note of the 3d inst. requesting my autograph; which I accord with pleasure but as not deemed worthy of a place in the collection of those distinguished names to which you allude. "From the library of John Augustin Daly (1838-1899). Daly, one of the most important figures in nineteenth-century American theater, worked as a critic, manager, playwright and stage director. At the time of his death, he owned two major theaters, one in New York and the other in London. Daly is considered personally responsible for the careers of such acting greats as John Drew Jr. Maurice Barrymore, Fanny Davenport, Maude Adams, Sara Jewett, Isadora Duncan, Tyrone Power, Sr. and many others.Daly was also an avid book lover and collector, amassing an enormous library of books and original manuscripts. That collection was dispersed in an epic, two-week auction at the American Art Association in New York in March 1900. The present letter was part of an extra-illustrated volume, described in the catalog as a "Unique copy, with autograph letters of all the Presidents inserted..." Walter Benjamin, writing in The Collector, described the sale as a "blaze of glory, due to the total having reached nearly $200,000." Benjamin attributed the sale's incredible success to "a small bookseller on 42d street, who appeared at the sale with apparently unlimited cash, and was soon the master of the situation." That "small bookseller," was George D. Smith (d. 1920), who, up until that time, had been an obscure and unsuccessful book dealer who began his career in 1883 with Dodd & Mead. Smith would dominate the market for the next two decades, working as an agent for some of the wealthiest collectors in the country—most notably Henry E. Huntington, for whom Smith purchased a portion of the Duke of Devonshire Library in 1914 for $1.5 million (American Art Association, Catalogue of the Valuable Literary and Art Property Gathered by the Late Augustin Daly, New York, 1900; The Collector, New York, May 1900, 1-2; Publisher's Weekly, March 13, 1920, 801; Ibid, March 21, 1914, 1008; "Geo. D. Smith Dies in HIs Book Store, New York Times, March 5, 1928, 13).The extra-illustrated volume of presidents from which this piece derives fetched $850, nearly four times above the going rate for presidential sets at the time. According to Walter Benjamin, Smith quickly resold the volume for $1,000. The collection did not surface again until it appeared in a minor auction in early 2016. (The Collector, New York, May 1900, 1-2)Provenance: John Augustin Daly; American Art Association, New York, March 19, 1900, Lot 3122; George D. Smith, New York.

Early ALS President John Tyler recommending Marine Corps appointment 1819

by University Archives

May 19, 2016, 10:30 AM EST

Westport, CT, USA

Estimate: $500 - $600

Description: An early letter from John Tyler recommending a man for a Marine Corps appointmentJOHN TYLER (1790-1862) Autograph Letter Signed, "John Tyler," 1 page, 7.5" x 9.25" Charles City, Virginia, November 1, 1819, address in his hand on the verso to "T[h]e Hon[orable] The Secretary of the Navy Washington." Laid into a larger sheet, expected folds, light toning and soiling, else fine.Tyler writes in full: a"Mr. John Travis of this State, is an application for some appointment in the marine corps and will present you testimonials of merit of the most respectable character. The family from which he springs is, and has been from a remote period, distinguished for their ardent attachment to the institutions of their country, and I have no doubt that should Mr Travis meet with your countenance you will never have cause to regret it."From the library of John Augustin Daly (1838-1899).
