January 26, 1814, JOHN ADAMS ALS to RICHARD RUSH Regarding LAW + The WAR OF 1812

Lot 1: January 26, 1814, JOHN ADAMS ALS to RICHARD RUSH Regarding LAW + The WAR OF 1812

by Early American

December 13, 2014, 9:00 AM PST

Rancho Santa Fe, CA, USA

Estimated Price: $30,000 - $40,000

Description: AutographsJohn Adams Writes to Richard Rush, Comptroller of the U.S. Treasury and Soon to be Attorney General - "To push the War with Vigour, till We have a Peace, neither disgraceful to the Nation or the Government..." Important & Historic War of 1812 Period Content!JOHN ADAMS (1735 - July 4, 1826). 2nd President of the United States (1797-1801), American Founding Father, Lawyer, Statesman, Diplomat and Leading Champion of American Independence in 1776, Defended the British Soldiers involved in the "Boston Massacre," a Leading Federalist.January 26, 1814-Dated Autograph Letter Signed "John Adams", 1 page, 9.75" x 8", Quincy (MA), Choice Very Fine. Adams personally writes to Richard Rush (1780-1859), the son of Signer of the Declaration of Independence, Benjamin Rush. This very personal, highly intellectual Letter is regarding his "Hawkish" position on the successful conclusion to the War of 1812 and Richard Rush's ideas on the American Legal System, just days prior to his being Appointed as Attorney General of the United States. Adams opens his Letter with the wonderfully penned line; "If I may judge others by myself,...".From his position as Comptroller of the U.S. Treasury, Richard Rush functioned as one of President Madison's closest friends and confidential advisors throughout the War of 1812. He was one of the War "Hawk" who advocated War with Britain. In 1814 Madison offered Rush the choice of Secretary of the Treasury or Attorney General of the United States, of which positions Rush chose the latter. With his appointment as Attorney General, Rush became the youngest person to ever serve as the United States Attorney General. At this same time, the Attorney Generalship was only a part-time position, and so Rush also maintained his private law practice while he was in this office.Richard Rush was the 8th United States Attorney General under President James Madison, in office from February 10, 1814 to November 12, 1817. He edited a codification of United States laws during this time. Later, he became the United States Secretary of the Treasury under John Quincy Adams, as well as John Quincy Adams' Presidential Campaign Running Mate when he ran for re-election on the National Republican ticket in 1828. Rush also served as United States Minister to England and France at various times. Here, John Adams first comments upon a legal treatise written by George Hay (1765-1830). Hay was an American Jurist, who is best remembered as U.S. Attorney for the District of Virginia, in which capacity he conducted the prosecution of Aaron Burr for Treason. In the second paragraph, John Adams, is discussing "Universal Law," and refers to Sir William Blackstone (1723-1780), the British Jurist, whose history of the doctrines of English Law were very influential on jurisprudence in the United States. This Letter is in excellent quality, penned completely in John Adams' hand, upon clean period wove paper. The text is easily readable in rich brown, well written and clear. There are expected faint mailing folds, only one slight ink smear, attesting to its originality. Overall, it is of superior quality, one sided and perfect for display. This Letter is of important historical content. It reads, in full;"Quincy -- Jan 26. 1814 --- Dear Sir --- If I may judge of others by myself, Mr. (George) Hay had no cause of apprehension that he should be tedious: for when I had read the first page I could not lay aside the book til I had read the last. I know not when I have seen a discussion of any legal or political question pusued with so dispassionate a temper; or written with more perspicuity, accuracy of luminous arrangement. The author is Master of his Subject and all the Learning neccessary to support his Position. What can (Sir William) Blacstone mean by universal Law? Are the cannon Law and the feudal Law, universal Laws? Are the Pope or his eldest Son the Emperor universal Legislators? Is any Law universal, but the law of our natures, written on our hearts, and obligatory on all Men from their beginning and through all their dispersions? The Doctrine of Universal and perpetual, inherent and inalienable Allegiance has no other foundation, than in a degrading Superstition and an unrelenting Despotism. To push the War with Vigour, till We have a Peace, neither disgraceful to the Nation or the Government is the Sincere hope and ardent Wish of my heart: Your assurance therefore of a determined Spirit in all Branches of the Government, is delightful to me.Our northern gentry are foaming to Stop the Wheels: but all will end in securing their State Elections. --- I am &c (Signed) -- John Adams".Like his father, Richard Rush was born to serve his country. He served as Comptroller of the U.S. Treasury (1811), Attorney General (1814-17_, Secretary of State (1817), and Minister to Great Britain (1817-25). Later he served as Secretary of the Treasury (1825-28) and Minister to France (1847-49).

Lot 166: 1835 First Edition On Chief Justice John Marshall, by Joseph Story, Boston

by Early American

December 13, 2014, 9:00 AM PST

Rancho Santa Fe, CA, USA

Estimated Price: $300 - $400

Description: Post-Revolutionary War to Civil War1835 First Edition On Chief Justice John Marshall1835-Dated, First Edition Imprint entitled, "A DISCOURSE UPON THE LIFE, CHARACTER, AND SERVICES OF THE HONORABLE JOHN MARSHALL, LLD. CHIEF JUSTICE OF THE UNITED STATES OF AMERICA..." by Joseph Story, Boston, James Munroe and Company, Very Fine. This First Edition has its Original Printed Paper Wrappers, 74 pages, measuring 6" x 9.25" in overall pleasing condition. There is some light expected age and scattered minor foxing to the covers, while being complete, very clean and fully intact. It reviews John Marshall who was Appointed to the Supreme Court in 1811 by President Thomas Jefferson. in part:"Story quickly became an ally of John Marshall, a powerful supporter of Judicial Nationalism and a proponent of an expansive reading of the Constitution." Their compatible ideologies meant that they rarely found themselves on opposite side of an issue; Story concurred without further comment in the vast majority of the many opinions Marshall authorized during their shared tenure on the court. This volume was written shortly after Marshall's death in 1835, this work provides "a portrait of Marshall's mind."This copy is signed by its original owner, "E. Carrington Nov. 1835" on the front cover in the upper right margin. Edward Carrington was a Providence, Rhode Island merchant that made his fortune in the China Trade. An important and historic early First Edition, written about arguably America's most noted Chief Justice. A great item for any Government, Law or Political Collection.Edward Carrington (1775-1843) was born in New Haven, Connecticut. As a young man, he came to Providence, R.I., where he worked as a clerk and supercargo for local merchants Seth Wheaton, Samuel Butler, and Richard Jackson. He resided in Canton, China from 1802 to 1810, serving as American Consul, acting as an agent for other American merchants, and amassing a considerable fortune by trading on his own behalf. He returned to Providence in 1811, where he continued to invest in mercantile trading (to China, South America, Europe and other ports). In 1815, he took in partner Samuel Wetmore and founded the firm of Edward Carrington & Company. The firm was reorganized in 1821 to allow for the addition of W.W. Wetmore as a partner. Carrington also invested in the Blackstone Canal in the 1820s, and several textile mills such as the Hamlet Mill in Woonsocket. He suffered extensive losses on his investments in the late 1830s, when he gradually began to cede control over his business to his son Edward Jr. Edward Carrington Sr. married Lorania Hoppin (1774-1861).

1865 Lincoln Assassination Period Letter to the Quartermaster at Fortress Monroe

Lot 195: 1865 Lincoln Assassination Period Letter to the Quartermaster at Fortress Monroe

by Early American

December 13, 2014, 9:00 AM PST

Rancho Santa Fe, CA, USA

Estimated Price: $800 - $1,000

Description: Abraham Lincoln Assassination Related Military Commission Trial of the Conspirators LetterJune 22, 1865-Dated, Abraham Lincoln Assassination & Trial Period, Manuscript Letter to the Quartermaster at Fortress Monroe, Virginia, regarding "Quick Passage," Choice Extremely Fine. This original, 1 page, 6.5" x 7.75" Manuscript Letter is very well written in dark brown ink on quality, wove period paper. It is extremely clean having nice eye appeal, embossed "North River" into the paper at the upper left corner, on centerfold, blindstamped June 22, 1865 - Fort Monroe, VA on the reverse and docket by "J.S. Stevenson - June 22-65" on its blank reverse. It was sent to the Quartermaster at Fortress Monroe, Virginia, by Major J.S. Stevenson, who was an Aide to Brevet Major General Robert Foster. Here he is seeking quick passage to Portsmouth (Virginia), as soon as possible. General Foster at this time was a Member of the Military Commission that was in the process of trying the Conspirators in the Lincoln AssassinationThis letter is dated on June 22, 1865, just a few days before the Commission would render its verdicts. It is a reasonable assumption that the haste shown in this letter may very possibly be related to the case of Mrs. Mary Surratt, whom many members of the Commission were reluctant to condemn, because of her being a woman. Further research may well prove this important historic assumption, having the likely possibility to be correct. If so, being related to the trial and use of the federal death penalty in American history, being for the first time actually used in the case of a woman, Mary Surratt, who was indeed hung.In the turmoil that followed the assassination, scores of suspected accomplices were arrested and thrown into prison. All the people who were discovered to have had anything to do with the assassination or anyone with the slightest contact with Booth or Herold on their flight were put behind bars.Among the imprisoned were Louis J. Weichmann, a boarder in Mrs. Surratt's house; Booth's brother Junius (playing in Cincinnati at the time of the assassination); theatre owner John T. Ford, who was incarcerated for 40 days; James Pumphrey, the Washington livery stable owner from whom Booth hired his horse; John M. Lloyd, the innkeeper who rented Mrs. Surratt's Maryland tavern and gave Booth and Herold carbines, rope, and whiskey the night of April 14; and Samuel Cox and Thomas A. Jones, who helped Booth and Herold escape across the Potomac. All of those listed above and more were rounded up, imprisoned, and released. Ultimately, the suspects were narrowed down to just eight prisoners (seven men and one woman): Samuel Arnold, George Atzerodt, David Herold, Samuel Mudd, Michael O'Laughlen, Lewis Powell, Edmund Spangler (a Ford's stagehand who had given Booth's horse to "Peanuts" Burroughs to hold), and Mary Surratt. The eight suspects were tried by a military tribunal ordered by now-President Andrew Johnson on May 1, 1865. The nine member commission was presided over by Major General David Hunter. The other eight voting members were August Kautz, Albion P. Howe, James A. Ekin, David Clendenin, Lew Wallace, Robert Foster, Thomas M. Harris and Charles H. Tompkins. The prosecution team included Judge Advocate General Joseph Holt, John A. Bingham, and H.L. Burnett. The transcript of the trial was recorded by Benn Pitman and several assistants, and was published in 1865. The fact that they were tried by a military tribunal provoked criticism from both Edward Bates and Gideon Welles, who believed that a civil court should have presided. Attorney General James Speed, on the other hand, justified the use of a military tribunal on grounds that included the military nature of the conspiracy and the existence of martial law in the District of Columbia. (In 1866, in the Ex parte Milligan decision, the United States Supreme Court banned the use of military tribunals in places where civil courts were operational.) The odds were further stacked against the defendants by rules that required only a simple majority of the officer jury for a guilty verdict and a two-thirds majority for a death sentence. Nor could the defendants appeal to anyone other than President Johnson. The trial lasted for about seven weeks, with 366 witnesses testifying. Louis Weichmann, released from custody, was a key witness. All of the defendants were found guilty on June 30. Mary Surratt, Lewis Powell, David Herold, and George Atzerodt were sentenced to death by hanging; Samuel Mudd, Samuel Arnold, and Michael O'Laughlen were sentenced to life in prison. Mudd escaped execution by a single vote, the tribunal having voted 5-4 to hang him. Edmund Spangler was sentenced to imprisonment for six years. Oddly, after sentencing Mary Surratt to hang, five of the jurors signed a letter recommending clemency, but Johnson refused to stop the execution. (Johnson later claimed he never saw the letter.)Surratt, Powell, Herold, and Atzerodt were hanged in the Old Arsenal Penitentiary on July 7, 1865. Mary Surratt was the first woman hanged by the U.S. government. O'Laughlen died in prison of yellow fever in 1867. Mudd, Arnold, and Spangler were pardoned in February 1869 by President Johnson. Spangler, who died in 1875, insisted for the rest of his life that he had no connection to the plot beyond being the man Booth asked to hold his horse.(From Wikipedia)

Typed Letter Signed THEODORE ROOSEVELT as 26th President of the United States

Lot 94: Typed Letter Signed THEODORE ROOSEVELT as 26th President of the United States

by Early American

December 13, 2014, 9:00 AM PST

Rancho Santa Fe, CA, USA

Estimated Price: $16,000 - $18,000

Description: AutographsTheodore Roosevelt The Conservation President Promotes a Conference for "Conservation of our Natural Resources"THEODORE ROOSEVELT (1858-1919). Twenty-Sixth President of the United States (1901-1909). Roosevelt was also the first of only three sitting presidents to have won the Nobel Peace Prize. He launched the Bull Moose Party that called for far-reaching progressive reforms.November 11, 1907-Dated, Important Content Typed Letter Signed, "Theodore Roosevelt" as President, 3 pages, measuring 10.5" x 8" at Washington, Choice Extremely Fine. This Letter is to Joseph H. Kibbey, Governor of Arizona, upon official White House stationery. It is sent together with a December 3rd, 1907 Joseph H. Kibbey Typed Letter Signed, 1 page, stating Kibbey will attend the conference regarding protecting our nation's natural resources being organized by Roosevelt. In the body of the Letter, Roosevelt writes, in full: "My dear Governor:The natural resources of the territory of the United States were, at the time of settlement, richer, more varied, and more available than those of any other equal area on the surface of the earth. The development of these resources has given us, for more than a century, a rate of increase in population and wealth undreamed of by the men who founded our Government and without parallel in history. It is obvious that the prosperity which we now enjoy rests directly upon these resources. It is equally obvious that the vigor and success which we desire and foresee far this nation in the future must have this as its ultimate basis. In view of these evident facts it seems to me time for the country to take account of its natural resources, and to inquire how long they are likely to last. We are prosperous now; we should not forget that it will be just as important to our descendants to be prosperous in their time as it is to us to be prosperous in our time. Recently I exprest the opinion that there is no other question now before the nation of equal gravity with the question of the conservation of our natural resources; and I added that it is the plain duty of those of us who, for the moment, are responsible, to make inventory of the natural resources which have been handed down to us, to forecast as well as we may the needs of the future, and so to handle the great sources of our prosperity as not to destroy in advance all hope of the prosperity of our descendants. "t is evident that the abundant natural resources on which the welfare of our nation rests are becoming depleted and in not a few cases are already exhausted. This is true of all portions of the United States; it is especially true of the longer settled communities of the East. The gravity of the situation must, I believe, appeal with special force to the Governors of the States because of their close relations to the people and their responsibility for the welfare of their communities. I have therefore decided, in accordance with the suggestion of the Inland Waterways Commission, to ask the Governors of the States and Territories to meet at the White House on May 13, 14, and 15, to confer with the President and with each other upon the conservation of natural resources. It gives me great pleasure to invite you to take part in this conference. I should be glad to have you select three citizens to accompany you and to attend the conference as your assistants or advisors. I shall also invite the Senators and Representatives of the Sixtieth Congress to be present at the sessions so far as their duties will permit. The matters to be considered at this conference are not confined to any region or group of States, but are of vital concern to the Nation as a whole and to all the people. These subjects include the use and conservation of the Mineral Resources, the Resources of the Land, and the Resources of the Waters, in every part of our territory. In order to open discussion I shall invite a few recognized authorities to present brief descriptions of actual facts and conditions, without argument, leaving the conference to deal with each topic as it may elect. The members of the Inland Waterways Commission will be present in order to share with me the benefit of information and suggestion, and, if desired, to set forth their provisional plans and conclusions. Facts, which I cannot gainsay, force me to believe that the conservation of our natural resources is the most weighty question now before the people of the United States. If this is so, the proposed conference, which is the first of its kind, will be among the most important gatherings in our history in its effect upon the welfare of all our people. --- I earnestly hope, my dear Governor, that you will find it possible to be present. --- Sincerely yours, (Signed) Theodore Roosevelt".President Theodore Roosevelt's contributions to the cause of conservation were immense. He had a passionate interest in the national forests, in reclamation of arid Western lands by irrigation, and in the conservation of water power and other natural resources. From the very beginning of his Presidency, Roosevelt expressed his support of conservation. In his first message to Congress (1 December 1, 1901), he remarked: The forest and water problems are perhaps the most vital internal problems of the United States. Later in his administration, in his seventh annual message to Congress, Roosevelt again warned: To waste, to destroy, our natural resources - to skin and exhaust the land instead of using it so as to increase its usefulness - will result in undermining in the days of our children the very prosperity which we ought by right to hand down to them amplified and developed. His opponents were the land-robbers, the mine-grabbers, and the wood-pulp pirates who fought him at every point. They were vicious adversaries who appealed to the old laws to discredit and damn the proposed reforms. The May, 1908 conference of governors took place as scheduled; after the conference, which was attended by the governors of most of the states (as well as elder statesmen of every persuasion), Roosevelt appointed a Conservation Commission on 6 June 1908, with Gifford Pinchot as its head. During his terms in office, Roosevelt reserved some 125 million acres in national forests, 68 million acres of coal lands, and 2,500 water-power sites. Roosevelt worked for beauty, reserving National Parks for the use and delight of the American citizenry for generations to come.

Historic BARON FRIEDRICH VON STEUBEN Autograph Letter to ALEXANDER HAMILTON

Lot 114: Historic BARON FRIEDRICH VON STEUBEN Autograph Letter to ALEXANDER HAMILTON

by Early American

December 13, 2014, 9:00 AM PST

Rancho Santa Fe, CA, USA

Estimated Price: $18,000 - $20,000

Description: AutographsBaron von Steuben Pens His Reaction to Alexander Hamilton Regarding the Rejection by Congress of General George Washington's Defense Proposals "Sentiments on a Peace Establishment" Advocating the Establishment of a Permanent Army & National MilitiaBARON FRIEDRICH WILHELM AUGUST HEINRICH FERDINAND von STEUBEN (1730-1794). Major General of the American Continental Army during the Revolutionary War; one of the Fathers of the Continental Army; wrote "Regulations for the Order and Discipline of the Troops of the United States."c. 1783 Revolutionary War Era, Important Historic Content, Autograph Letter Signed, "Steuben" as Advisor to General George Washington, to Alexander Hamilton, written in French, 1 full page, measuring 9' x 7.5", Quarto, no date or place (c. Spring/Summer of 1783), Choice Very Fine. At the time of this remarkable Letter, Baron von Steuben was serving as a Military Adviser to General George Washington. His military service lasting until his final discharge from the Continental Army on March 24, 1784. (Von Steuben had served in the Army throughout the Revolutionary War without pay. Finally, in 1790, Congress granted him a lifetime pension of $2,800.) This Letter is written to Alexander Hamilton (1755- 1804), who was then serving as a Member of the Continental Congress (1782-83). On April 7, 1783, Alexander Hamilton was appointed a Member of a Committee, also including James Madison, Samuel Osgood [replaced on May 6th by Samuel Holton], James Wilson and Oliver Ellsworth, to consider the proper arrangements to be taken in case of a General Peace. Thus, in the Spring of 1783, Baron von Steuben first assisted General George Washington in his preparation of a plan for the future defense of the United States, and towards for the demobilization of the existing Continental Army.George Washington presented to Congress his plan in regarding the new nation's future military needs. His "Sentiments on a Peace Establishment" which advocated the establishment of a small permanent army and a national militia, was rejected. Washington's emphasis on military preparedness, a select Militia, and a "Peacetime Standing Army" to protect republican institutions from foreign invasion and domestic insurrection, never stood a chance of enactment. Congress had traditional fears of a "Standing Army" in Peacetime, coupled with the nation's financial weakness. Here, translated, Baron Von Steuben pens, in full:"Where were you Hamilton when that sentence was pronounced which the Minister of War put into execution? It is finished. The blow is accomplished. I shall take care not to paint a picture of what I saw - of what I heard - and still less of what / felt since the arrival of the good man, whose portfolio was always Pandora's Box for this poor and respectable loved one.See how my garden is destroyed, my friend. The fate of our ancient colleagues is hard - hard beyond expectation. As the truth of the scene surpasses the appearance, I do not wish to attempt to trace it.Remember my friend, that I am in the service of the Continental Congress - of its representatives. Do not allow my fate to be determined by a County man. When it is time, give me guidance with your advice. You have always honored me with your friendship, and I flatter myself that I am worthy of it.Will you leave to the good man the formation of your Peace Establishment? If that is so, take up the pen and cross out my name. I am not of his county, nor in any way of his sentiments.I am enclosing here the copy of an address from the officers of your line, from these same officers that I have never praised with low flattery and of whom is required as strict subordination as in the most generously paid army. This address pays tribute to their sentiments, and is the consolation of my old age. My heart is oppressed, Hamilton. A line from you will comfort the sorrows of your old friend. I flatter myself that you will write by the first post. --- (Signed) Steuben".One year later, in the Spring of 1784, Baron von Steuben was to present to George Washington a further plan for establishing a "Continental Legion" and a National Militia in times of Peace. In a Letter to Baron von Steuben dated March 15, 1784, Washington wholeheartedly agreed with von Steuben's proposal, writing:"... It was no unpleasing, and flattering circumstance to me, to find such a coincidence of ideas as appear to run thro' your plan, and the one I had the honor to lay before a Committee of Congress in May last. Mine however, was a hasty production, the consequence of a sudden call, and little time for arrangement. Yours of maturer thought and better digestion, I, at the same time that I hinted the propriety of a Continental Militia; glided almost insensibly into what I thought would, rather than what I conceived ought to be a proper peace Establishment for this Country."On June 2, 1784, Henry Knox, the Ranking Senior Military Officer, discharged, upon the direct order from Congress, all but 80 Soldiers. However, on the very next day, Congress erected the first National Peacetime Military Force in American history, in recommending that several States furnish 700 men from their militias to serve one year terms of service. An extraordinary, historically significant, original Baron von Steuben Autograph Letter with superb associations to the likes of Alexander Hamilton. FRIEDRICH WILHELM LUDOLF GERHARD AUGUSTIN von STEUBEN, (1730-1794). Famous as a Prussian-born American Revolutionary War Soldier. Came to America in 1777, recommended to General George Washington by Benjamin Franklin. Baron von Steuben reported to Washington at Valley Forge Camp on February 23, 1778, and was designated Inspector General of the Continental Army, invested with the task of training the Continental Army.Successful in his reorganization of the army, he was Commissioned a Major General and engaged the British at Monmouth and Yorktown. Von Steuben became Washington's trusted adviser. After an honorable discharge from the army after the Revolutionary War, he was one of the Founders of the "Society of the Cincinnati "(1784), which was open to all former officers who served honorably during the American Revolution. Other Co-founders included: Henry Knox (1750-1806) and Jedidiah Huntington (1743-1818).He became a naturalized American citizen (Pennsylvania, 1783; New York, 1786), and settled in New York State (1784-94).
