In State and Nature Laws , Pufendorf presents his theory on natural sociability of men, that, in opposition to Hobbes theory, guides them to accept a set of rules given by God, leading to Constitutions written by men. According to that, the treatise seems to be a kind of justification of absolutism. Samuel Von Pufendorf (Dorfchemnits, 1632-Berlin, 1694), German philosopher and theologian, follower of the doctrine of natural law by Ugo Grozio, focused on harmonizing the first enlightenment thinking to the Cristian theology. To Major General Winfield Scott with instructions for the forced removal of the Cherokees to beyond the Mississippi. Each leaf is tipped to a larger sheet. Folds are strengthened on verso. Some dampstaining and toning. Letter is bound with a typed transcript in a quarter morocco and buckram case with gilt lettering on spine; staining to cover.The Indian Removal Act was signed into law by Andrew Jackson on May 28, 1830. It authorized the President to grant unsettled lands west of the Mississippi in exchange for Indian lands within existing states. Although a few tribes went peacefully, many tribes resisted, and the Cherokees brought lawsuits. In Worcester v. Georgia, the U.S. Supreme Court ruled that the Cherokee nation was free from the law of individual states, but Jackson, knowing that the Court had no way to enforce its mandate, ignored the Court and continued with his removal plan. The Treaty of New Echota was signed on Dec. 29, 1835, by a minority Cherokee faction without the approval of the Cherokee National Council or the signature of Principal Chief John Ross; nonetheless, the U.S. Senate amended and ratified this treaty in March 1836. The Indians were given two years to leave and in May 1838, forcible removal began.Van Buren's instructions to General Scott read, in part: "If on your arrival in the Cherokee Nation, propositions should be made to you by the party opposed to emigration, the acceptances of which you shall have good reason to prevent the shedding of blood, & secure & expedite the voluntary emigration of the whole nation, you are authorized to receive & transmit them to the Department of War for the consideration of the President & Senate: Provided the said proposition do not, to any degree, impugn the Treaty [of New Echota] with the execution of which you are charged, or materially change any of its provisions, & particularly that which provides for their emigration to the west.... [N]o stipulation shall be entered into that shall effect injuriously & against their will the individual rights of any of the Citizens of the States in which the indians now reside, & which are secured to such Citizens by the laws of such States & founded upon the Treaty. For these purposes & to meet the contingency referred to, you are here appointed a Commissioner, & authorized to conclude an arrangement of the nature herein described, with the said indians subject to the approbation or rejection of the President & Senate....In such proceedings, the known Chiefs & their Adherents, of the party heretofore opposed to emigration may, if you find it necessary, be put upon a footing of equality with the other part of the nation, taking care not to sign any stipulation which may injuriously affect the true interests or just pride of the latter. To the ends contemplated by these instructions any reasonable sum of money, not exceeding 300,000 dollars, to be paid by the United States after the execution of the stipulations by the said Indians, may be agreed upon; but the discretionary authority hereby conferred upon you is made subject to the following absolute restriction, viz;; that no proposals are to be received from the Indians until the great body of the Chiefs, Head Men & People of the remaining Cherokees have been distinctly informed, that the said proposals are based upon their certain & speedy removal to their new Homes, that the only object in view is to make that removal more satisfactory to them, & that no delay, in the execution of the Treaty, not really indispensable, is to [be] occasioned by any of the proceedings authorized by these instructions."Federal groups and state militias began removing Indians forcibly from their homes with little but the clothes on their backs, ignoring warnings to treat them kindly. Food and medicine were in short supply and water was scarce and often contaminated. Many died along the way, possibly as many as one fifth of the Cherokee Nation. The last Indians arrived in the west on March 24, 1839, following what could truly be called a Trail of Tears. The $300,000 mentioned in Van Buren's letter was apparently not used by General Scott to aid the Indians' removal and $5 million, which was promised to the Cherokees in the Treaty of New Echota, was never paid. Autograph poem signed ("S.F. Smith"), being the first stanza, 1 page, 6" x 4", no place, March 13, 1893. Poem headed: "America." In full: "My country 'tis' of thee, / Sweet land of liberty,/ Of thee I sing; / Land where my fathers died, / Land of the pilgrims' pride / From every mountain side / Let freedom ring." After a visit to Germany in 1831, 23-year-old theological student Samuel Francis Smith, impressed that German children started their school day by singing a hymn, wrote a patriotic hymn using a simple German melody. Coincidentally, the melody was the same as that of the British national anthem, "God Save the King." Smith jotted down the complete hymn on a piece of scrap paper within half an hour, and the result, "America," was first sung at a children's celebration in Boston's Park Street Church on July 4, 1832. George Gershwin used Smith's phrase "Of Thee I Sing" as the title of his 1932 Pulitzer Prize-winning musical, and the Reverend Dr. Martin Luther King, Jr. quoted the entire first stanza as he concluded his "I have a dream" speech in front of the Lincoln Memorial in 1963. Toning on edges with some show-through.Pioneering Scottish economist John Law writes concerning the increase in orders in the price of gold and silver coins and metal…Law writes in full: I am sending you copies of the decision of the council held the 5th of this month, of which I informed you in my letter yesterday, concerning the increase in orders in the price of gold and silver coins and metal, and the rebate of four pence [sous] per pound [livre] it grants to those who pay the duties subject to those four pence per pound in banknotes. And His Majesty is also willing to offer ten percent to those of his subjects who will pay in banknotes what they owe in per capita levy, poll tax, and other taxes that are not subject to the four pence per pound. But since this decision contains several additional important provisions concerning payments that can only be made or offered legally for sums of one hundred livres and above in banknotes, I feel I should add to my previous letter the comment that H[is] R[oyal] H[ighness] wants you to insure that all these provisions are strictly observed in a timely manner, as it is his intention that those who disobey them shall be dealt with harshly. The same attention should be paid to the decision of last February 27 which sets the sums that each individual or community can keep, and which forbids any person from making payments of one hundred livres and above in anything but banknotes. I will be carefully keeping H.R.H. informed on a regular basis of any opinions you pass on to me on this subject. Do not doubt his extreme gratitude for the diligence and care you will exert to insure the success of these different arrangements, whose sole object is to increase circulation and the advantages of trade…LawLaw first achieved notice for his project to establish a state bank to issue paper money on the security of land, a scheme rejected by the Scottish parliament on 27 July 1705. By late May 1716, having won over the French regent (Philippe II, Duke of Orleans) with his plans to revive France’s moribund economy, Law and several colleagues were granted a charter for a general bank. Buoyed by its rapid success and the associated industrial expansion, Law soon turned to the organization of a French firm to rival Britain’s East India Company, simultaneously hatching a plan to develop French holdings in America. In August 1717, his Company of the West was accorded rights to the Louisiana Territory, including lands drained by the Mississippi, Ohio and Missouri Rivers. Incensed at the financial privileges granted to a foreigner, Law’s “System” soon faced opposition from parliament, but by December 1718 the conflict was resolved with the conversion of the General Bank into the Royal Bank, with notes guaranteed by the King. By June, Law’s enterprise, now renamed the Company of the Indies, had absorbed its competitors for France’s non-European trade, and in August assumed most of the national debt, becoming France’s leading creditor. On 5 January 1720, Law was appointed comptroller-general of finances and on 23 February the Company of the Indies merged with the Royal Bank. However, the intense speculation fostered by Law’s high shareholder dividends continued to deplete the bank’s available specie, leading to panic when the bank note was devalued to one-half on 21 May. On the 27th, the very day the decree was withdrawn, the now-disgraced Law was relieved of his position, and within a few months had left the country. Accompanied with: A printed copy of the above-mentioned decision and a letter dated 1719 from one Vaslin to a Mrs. Lambert in Orleans concerning the investment of funds, recommending her purchase of land in Mississippi, and lauding the profits of Laws’ enterprise. $8,000 - $12,000
