Catalogue Note: James Brown (Scottish/American, 1770-1852) came to Richmond, VA in 1785 as an agent of London merchants, Donald & Burton. In 1797, he formed Brown & Burton with Robert Burton (1747-1806). After Burton's death Brown remarried his widow, Anna Pitfield (Braddock/Braddick) Burton, and became a member of the firm Brown, Rives & Co. which would become one of the foremost commission houses in Virginia. Several miniature portraits in this sale depict members of the same family which descended together through the Burton/George family of Richmond: lot 2365 the portrait of Anna Burton, lot 2367 the portrait of Major Byrd George, and lot 2366 the Lawrence Sully portrait of a semi-nude woman.

Charles Balthazar Julien Févret de Saint-Mémin (1770-1852), a French nobleman, came to New York in 1793 and began making portraits in 1796. With the help of the Physiognotrace, a mechanical device that allowed for the relatively easy creation of profile portraits, Saint-Mémin produced hundreds of portraits in New York, Philadelphia, Baltimore, and elsewhere on the East Coast from 1793 to 1814. Saint-Mémin returned to France in 1817 and worked as director of the Musée des Beaux-Arts de Dijon until his death. Maurice Tristant was born on March 13, 1773, in Verdun, Meuse, France to Hubert and Barbe Benoit Tristant. He married Marguerite Toussaint (1779-?) or Manheulles, Meuse, France on June 9, 1800. The couple had one son, Henry Louis, born on July 29, 1806, and one daughter, Ursule, born on October 24, 1811. Maurice died on April 8, 1824. The historical record does not suggest that the Tristants had any familial or professional ties to the United States, so the circumstances surrounding the commission of these portraits are presently unknown.

Biography: "Charles Balthazar Julien Fevret de Saint-Memin was a member of the French hereditary nobility, and came to New York City in 1793, at the age of twenty-three as a former military officer exiled by the events of the French Revolution. In New York, Saint-Memin turned to the arts to support himself, his parents, and his sister. With some training in drawing and an aptitude for precision, he taught himself the art of engraving. First, he made a few landscapes and city plans, and then, in 1796 he took up the profession of portraitist. In 1798 he moved the portrait business to Philadelphia and his parents and sister settled in nearby Burlington, New Jersey. In Philadelphia, and later in Washington D. C., Saint-Memin's sitters included senators, congressman, and cabinet members in the federal government. He also attracted local merchants and landowners, French emigres like himself, and members of the United States Army, Navy, and Marines. From 1803 until 1809, Saint-Memin traveled south. His visit to Richmond in 1807-1808 was particularly successful. He made more than 120 portraits in less than a year, a record number for him. His arrival in the summer of 1807 was undoubtedly timed to coincide with the trial of Aaron Burr for treason, which began on August 3; Burr was acquitted in September. During this period, the population of the city almost doubled with witnesses, Burr partisans, and curious spectators. Many of them commissioned the artist to make their portraits, including John Marshall, the presiding judge at the trial. St. Memin and his family returned permanently to France in 1814, after the overthrow of Napoleon and the restoration of the Bourbon monarchy. Several large sets of his engravings were later compiled from hundreds of duplicates that the artist owned. The two largest sets-at the National Portrait Gallery and the Corcoran Gallery of Art-have inscriptions that provide the identifications for many of the portraits. School of Charles-Balthazar-Julien-Févret de Saint-Mémin (French/American, 1770-1852), "Profile Portraits of Judge Hugh Nelson and Eliza Kinloch Nelson", 19th c., 2 multi-colored chalks on woven beige paper, unsigned, full identifications on handwritten ink labels en verso of backing boards, sights 20 3/4 in. x 14 3/4 in., black-and-gilt-decorated verre églomisé mats in matching frames. (2pcs.). Provenance: Neal Auction, Sept. 13, 2014, lot 235. Note: These fine drawings are a reprise of Saint-Mémin's typical style, on lightly-tinted paper, at precisely his standard size; they are displayed in black-painted and gilt-decorated glass mats very similar to the originals in the State Department. The inscription labels found here en verso, evidently of the 19th c.together with Saint-Mémin's standard small circular engraving at the National Portrait Gallery in Washington, labeled in the artist's own hand, "Nelson 1808" tell us that Mr. and Mrs. Nelsonthen respectively 40 and 27 years oldsat for Saint-Mémin (using his famous technique of the 'physiognotrace') in Richmond, during his sojourn there from early July of 1807 to April or early May of 1808. Hugh Nelson (1768-1836) was born in Yorktown and studied law at the College of William and Mary at Williamsburg. Nelson was a younger associate of Thomas Jefferson's; the latter's father, dying in 1757 when Jefferson was only 14, had appointed as his executor, and as his son's guardian, the eminent physician and statesman Dr. Thomas Walker (1715-1794), whose son John was Jeffersons classmate. John Walker (1744-1809), only one year younger than Jefferson and perhaps his closest friend, also attended William and Mary with him, and made Jefferson one of the groomsmen at his marriage in 1764 to Elizabeth Moore. The Walkers' only daughter Mildred was married in 1781 to a young Congressman from South Carolina, Francis Kinloch of Charleston. That couple had only one daughter, Eliza; she was almost the same age as Jefferson's own daughters, and given Jefferson's closeness to both the Nelson family and especially his neighbors and close friends the Walkers, it is hardly surprising that Hugh Nelson in fact married Eliza Kinloch in 1799. Hugh and Eliza (the subjects of these two drawings) moved permanently to Albemarle County in 1802, and on the deaths of both her parents in 1809, she and her husband inherited their estate, "Belvoir," where they raised their ten children. Hugh Nelson represented his county in the Virginia Assembly from 1805 to 1809, while also being a magistrate in the state's General Court; in 1811 he was elected to the U. S. Congress, in which he served for a dozen years. He resigned that position in 1823 to accept his friend James Monroe's appointment as minister plenipotentiary to the Court of Spain, where he remained until 1825. Throughout his years of public service, he stayed in close touch with Thomas Jefferson, until the latter's death in 1826; a large selection of Nelson correspondence is preserved in the Library of Congress. Hugh Nelson served a final brief term in the Virginia House of Delegates in 1828-29; he also participated on several occasions in the General Convention of the Protestant Episcopal Church in America. He was, perhaps, principally celebrated for his extraordinary recallmainly deriving from his long friendship with Jefferson and his intimate contact with Monroeabout the lives of the Founding Fathers. From the papers of the Dr. Joseph Warren family of Boston, (the Hero of Bunker Hill). Per Massachusetts Historical Society: "Beginning in the 1820s, the United States government collected portrait paintings of American Indians for its 'Indian Gallery,' as a way to preserve a visual record of a race that most considered doomed to extinction in the face of western expansion and by the perceived inability of natives to adapt to modern American culture." The Profile Artist Saint-Memin offered watercolor portraits for the first time around 1802, perhaps in response to competition from other artists. Between 1803 and 1807, he made about 100 portraits in Baltimore and about 130 in Washington. He also portrayed several Indian visitors to Washington, most of whom came to the capital after the Louisiana Purchase of 1803.

Portrait of an American Gentleman. Charles Balthazar Julien Févret de Saint-Mémin (1770-1852). Black and white chalk on pink paper. 27 1/4 inches x 20 3/4 inches sheet. According to Dr. Ellen Miles of the National Portrait Gallery, "This portrait has, at times, been titled by owners as A Philadelphia Gentleman. Indeed, the artist did reside in Philadelphia for a time although he is also known to have worked in Baltimore, Annapolis, Washington, Richmond and Charleston. Drawn in chalk, the image was created with the aid of a physionotrace. E. P. Richardson comments in Painting in America that Saint-Mémin's "profiles have something of the clear, elegant formality of an enlarged cameo" and this exactly describes this particular drawing. Unsigned Portrait of Henry Latimer Attributed to Charles Baltahzar Julien Fevret De Saint-Memin (French 1770-1852, active in the United States 1793-1814), Circa. 1800. Charcoal and Black, White and Gray Chalk Drawing on Canvas Prepared with Salmon Painted Background. Dr. Henry Latimer (April 24, 1752 - December 19, 1819) was an American physician and politician from Newport, in New Castle County, Delaware. He was elected to the Continental Congress from Delaware, and was a member of the Federalist Party, who served in the Delaware General Assembly, as U.S. Representative from Delaware, and U.S. Senator from Delaware. Latimer was born in Newport, Delaware, son of James Latimer, Sr. and Sarah Geddes. His father was a wealthy grain shipper and politician, who was a member of the House of Assembly in the 1778/79 session and a member of the Delaware convention that ratified the U.S. Constitution on December 7, 1787. Latimer's brother, George, also served in the House of Assembly from the 1779/80 session through the 1781/82 session. Later he moved to Philadelphia where he became Speaker of the Pennsylvania House of Representatives in 1794. Latimer studied medicine, and attended the College of Philadelphia (now the University of Pennsylvania) in Philadelphia and graduated in 1770, going to University of Edinburgh Medical School in Scotland in 1775 to complete his education. Returning in the midst of the American Revolution, he served in the "Flying Hospital," a mobile surgical unit of the Continental Army. He was at the Battle of Brandywine and continued through the end of the war. Elected to the Continental Congress on April 8, 1784, Latimer never attended the session that spring in Annapolis, Maryland and was replaced. Like his father and brother, he was elected to the House of Assembly and served from the 1787/88 session through the 1790/91 session. He was the Speaker in that last session. Latimer lost the 1792 election for the U.S. House to Major John Patten by thirty votes, but contested Patton's election to the U.S. House. The Federalist majority there reviewed the ballots cast, and based on a confusing law requiring the names of two candidates on the ballot, disqualified enough of Patton's votes to award the seat to Latimer. Amidst considerable bitterness, he was seated February 14, 1794. After once again losing an election to Patten in 1794, Latimer resigned from the U.S. House on February 7, 1795 when he was elected by the Delaware General Assembly to the disputed and long vacant U.S. Senate seat of retired U.S. Senator George Read. After finishing Read's term, he was reelected in 1796, and served until February 28, 1801, when he also resigned. Some believe that the reason for his resignation was that he was unhappy over the tactics of his political opponents who were still bitter over the circumstances of the contested election in 1792. At various times Latimer was a member of the Wilmington Academy board, director of the Bank of Delaware, president of the First Agricultural Society of New Castle County, and president of the Board of Trustees of Newark College. He was a charter member of the Delaware Medical Society Oval image measures 21" x 15" in a silvered and gilt molded frame 27-1/4" x 21-1/4" overall. Pencil, Charcoal and White Chalk on Paper Portrait of William Barton (1754-1817) by Charles Baltahzar Julien Fevret De Saint-Memin (French 1770-1852, active in the United States 1793-1814), Circa. 1802. William Barton was born April 11, 1754 in Philadelphia, in the Province of Pennsylvania. His father, Rev. Thomas Barton was an Irish immigrant from Carrickmacross who had opened a school near Norristown, Pennsylvania in 1751. His mother was Esther Rittenhouse, sister of astronomer David Rittenhouse, for whom William would later write a biography. William's brother, Benjamin Smith Barton, would later become known for his work as a botanist. William grew up in Lancaster, Pennsylvania. In 1775, with the American War of Independence under way, he went to England, where he studied heraldry. During his time in Europe, he also met some of his maternal relatives in the Netherlands. He returned to Pennsylvania in 1779 and was admitted to the bar of the Supreme Court of Pennsylvania, setting up a practice in Philadelphia. In 1781, he married Elizabeth Rhea, niece of Continental Congressman Jonathan Bayard Smith. They had five daughters and four sons, including botanist William P.C. Barton. It was also in 1781 that Barton published Observations on the Nature and Use of Paper Credit. The same year, the University of Pennsylvania awarded him an honorary Master of Arts degree, and in 1785, the College of New Jersey (later known as Princeton University) followed suit. In 1786, Barton published The True Interests of the United States and particularly of Pennsylvania considered with Respect to the Advantages Resulting from a State Paper Money. Image size 17-1/2" x 13-1/2", in a gilt molded frame, 23" x 19-1/4" overall. Condition: good with some tears. (2000-4000)

CHARLES BALTHAZAR JULIEN FEVRET DE SAINT-MEMIN (FRENCH / AMERICAN, 1770-1852) VIRGINIA PORTRAIT, chalk on paper, depicting Dr. Amos Newhall (1773-1835) of Essex County. Period, and probably original gilt frame and glass with eglomise mat. According to Norfleet, Amos Newhall first appears on the Essex Co. tax records in 1810. He was listed as a doctor in 1813, and paid taxes on seven slaves, four horses, and a gig. The 1814 tax records indicate his ownership of 361 acres of land located 18 miles SE of the Court House. According to the 1830 Federal census for Essex Co., there was a total of 15 people residing in his household including four slaves. 21 3/4" x 16" sheet, 26" x 19 1/2" overall.

Copper plate 2 3/4 x 2 1/2 inches. The handwritten passport dated "Versailles, le 24 Novembre 1784" and signed "Louis" (Louis XVI). Black and white crayon on paper, bust-length profile portrait c. 1799, 19 x 14 1/2 in. (sight), in a replaced eglomise mat with oval aperture, and period molded giltwood frame. Condition: Minor toning, repaired tears, l.r and l.l., not examined out of frame. Provenance: A photocopied old auction description with image of this work is affixed to the backing. It states the provenance as: Henry N. Paul, Philadelphia, Pennsylvania; Samuel Paul, son; by descent in family. Also "Literature: E. Dexter, The St. Memin Collection of Portraits (1862), p. ? pl. 481." Additionally a fragment of an early label is affixed to the backing.
