1303. MANUSCRITO: (CONDADO EMPURIAS-CAPBREU). CAPBREU. RELACIÓN DE CENSOS Y OBLIGACIONES DE LOS PAYESES DEL SEÑORÍO DE EMPURIES. Manuscrito sobre pergamino. 8º mayor. 64 fol. numerados en arábigo. Escrito en catalán en una bonita y regular caligrafía gótica, de 19 líneas cada folio. Hay en algunos márgenes notas posteriores y al final, una más larga fechada en 1313, año en que sucedió a Hug IV su hijo Ponç VI. Los últimos cuatro folios tienen una leve pérdida en la esquina inferior derecha, y solo en el último afecta ligeramente el final de una línea de texto. Enc. en pergamino a la romana. Lleva un índice manuscito de dos hojas de papel, con caligrafía muy posterior (probablemente s. XIX), bastante deteriotado y remarginado burdamente y con sello húmedo del anterior poseedor. Las primeras líneas describen el por qué de este documento: ´Sapien toz que com la memoria dels homes sia deleznable, he les coses humanals tot dia amene varys esdevenimens. (...) daylo jo Huguet a Payerols de Conflent (...) de Vilagut cavaller, arequerer he ademanar he capbrevar totz los drets e tras possessions teneons esdevenimens cens les quals coses lo dit (...) Vilagut pren e pendra dou que raon & Castell Empurdan en tota la parrochia & San Martin de Laneres en totz los altres locs e parochias en les quals setenga res q lo del castell Empurdan. Et mandava que iuntar fer capbreu caquel en forma publica (...) que lo senyor Pons Hug comta dempuries e vescomta de Cabrera manan al notari...´ En 1303 se realiza este documento ante notario que constituye un censo y memoria de todas las posesiones y obligaciones de los habitantes de las tierras propiedad del condado del Empuries, con la fórmula ´jo reconech tener...´ en cada entrada. En el verso del fol. 8 hay una raspadura en la línea 18 que ha borrado de la memoria un nombre, se repite puntualmente en algún otro lugar. El conde Hug que menciona el texto, no es otro que Ponç V o Hug IV, que ostentó el condado desde 1277 hasta 1313, posteriormente este condado quedaría asimilado a la corona aragonesa, pero eso no ocurriría hasta 1325. A lo largo del escrito se detallan las villas, propiedades, rentas, familias, de los montes, y cualquier producción ya sea agrícola, animal u otro tipo de explotación (queserías, huevos, etc.) Al principio del escrito dice, que además de conde de Empuries, es vizconde de Cabrera (por matrimonio) pero no menciona el vizcondado de Bas (antigua casa de Besalú). Por un breve lapso de años el vizcondado de Bas había quedado entroncado con el condado de Empuries, pero en el año 1300 Jaume II, desairado por la amistad que el conde de Empuries profesaba a Federico II de Sicilia, confiscó el vizcondado de Bas. Este Capbreu refleja la necesidad del Hug IV de ordenar sus rentas y ante notario deja escrito todo lo que corresponde a su condado.

Terms and Conditions

1st. The starting price is the minimum price for which a lot can be adjudicated. This price should be understood to be the reserve price and under no circumstances will the lot be adjudicated for less than this.

2nd. The total invoice will include 20% (except in coin auctions 18%) on the hammer price plus shipping and/or insurance cost. The shipment of the articles adjudicated will be invoiced with a general nature, independently of the condition or residence of the winner of the bid, with VAT INCLUDED, covered by the Special Regime on used goods, objects of art, antiques, and collectors' items. Internet bidders will be charged of an additional 3% (Live Bidding fee)

3rd. If you are unable to attend the auction in person, please send in your bid as early as possible. The lots are sold at the lower price possible and not at the total of your bid. For example, a lot with an asking price of 1,000 for which you bid 3,000 and for which the highest bid other than yours is 1,500, will be adjudicated to you at the following bid (as per our bidding chart), in this case, 1,600. Some lots can have a reserve price imposed by de vendor. In case two bids are similar then winner is the one arrived before. The minimun bid for lots "libres" is t€.

4th. Bids must be made in EUROS. Any bid in other currency will be changed in â'¬UROS. Payments have to be made in â'¬UROS. The amount of the payments in other currency, will be subjected to the daily Bank exchange rate.

5th. Purchasers buying by post must make payment on receiving the invoice. On receiving the money, we will send the lots by post at your expense and risk, unless the purchaser has given other instructions.

6th. SOLER Y LLACH reserves the right to group together, at its criteria, two or more lots of the current auction, as well as to withdraw any lot.

7th. The auction house regulates the auction and in the case of any dispute between buyers, its decision is final.

8th. AUTHENTICITY. The authenticity of all the lots sold by SOLER Y LLACH is guaranteed. Any claim regarding authenticity should be sent to SOLER Y LLACH within 30 days from the date of the auction. Any claim made after this time will not be considered.
Lots described as collections or groupings cannot be subjected to any claim.

9th. The lots like: books, manuscripts, maps, posters and photography, will be auctioned in the state in which they are found, no claims will be accepted concerning restorations, damages, breakages, etc. Although the descriptions have been made with the greatest of care, purchasers should check out for themselves before the auction that the description coincides with their personal opinion about the state of the lot.

10th. PAYMENT IN INSTALMENTS FOR PURCHASES SUPERIOR TO 500 €. In this case, the purchaser should pay 30% of the total on receiving the invoice, and the rest within a maximum period of six months in equal monthly quotas.

At the end of each month, SOLER Y LLACH will charge the purchaser's account 0.50% interest on the outstanding balance.

The lots will remain with SOLER Y LLACH until payment has been completed. In accordance with part 8, the purchaser loses all rights to lodge a claim 30 days after the auction, and during this time he may examine the lots at SOLER Y LLACH.

11th. The lots adjudicated may be collected from our auction rooms at C/ Beethoven, 13, 08021 BARCELONA within 15 days after the auction.

12th. The lowest bid accepted for those ots with starting price "libre" is 5 euros.

13th. SOLER Y LLACH reserves the right of admission into its auction rooms and to refuse, at its criteria, any purchase order.

14th. OWNERSHIP. The lots will remain the property of the seller until payment has been cleared, which includes paying in cheques or any document.
