138. MISSEL de Jeane d’Arc. Paroissien Romain contenant Les Offices des Dimanches et des Fetes de l'Année en Latin et en Français. Limoges ca. 1905, Depelley i wspólnicy, 544 s. Pozłacany tzw. mszał, czyli modlitewnik lub parafialnik Joanny d’Arc dla każdego katolika składający się z kilku części. Pierwsza zawiera podstawowe modlitwy. Druga część składa się z Mszy Św. i nabożeństwa Nieszporów. Kolejna część to liturgia słowa ze Starego i Nowego Testamentu czytane na wszystkie niedziele i najważniejsze święta w roku liturgicznym. Ostatnia część to Msza św. w trakcie udzielania sakramentu małżeństwa i Droga Krzyżowa. Tekst zasadniczo paralelnie po łacinie i francusku. Posiada imprimatur abpa Limoges François-Benjamin-Josepha Blangera, który pełnił tę funkcję w l. 1883–1887. Całość kończy szczegółowy spis treści z indeksem modlitw. Modlitewnik zawiera 2 całostronicowe ryciny wg obrazów Rafaela i Rubensa. Każda strona zawiera także mini ryciny ze scenami z życia Joanny d’Arc i wzory geometryczno –roślinne. Oprawa z epoki, pełna brązowa złocona i tłoczona skóra w średnim stanie z minimalnymi przetarciami, szczególnie na rogach; na okładkach złocone wzory roślinne i na przedniej monogram „A.D.”; grzbiet tłoczony i pozłacany tytułem oraz wzorami geometryczno-roślinnymi; piękna zielona wyklejka z liliami burbońskimi na płótnie atłasowym, złocona sygnetami na skórze oprawy, ale niestety częściowo sklejona na przedniej części; wnętrze w db stanie; czasem plamy, ale suche; wszystkie brzegi kart są pozłacane; ogólnie stan średni.

Rules of auctions

I. Participation in the Auction
1. The Auction takes place on 8 October 2022, in Hotel Francuski in Kraków at 13 Pijarska Street, in the Restaurant Room, the Auction starts at 13.00. The Auction is organised by Derubeis Antique Bookshop.
2. The following are entitled to take part in the Auction: legal persons who have full legal capacity, as well as legal persons and organisational entities without legal personality but with legal capacity (are entitled to take part in the Auction).
3. Admittance to the Auction is open and requires only registration and provision of personal data (name and surname / name, address for service, and telephone number / email address) while collecting an auction bid paddle. The paddles shall be returned after the Auction has finished. The person collecting the paddle takes responsibility for the consequences of its use by third parties.
4. The Auction takes place simultaneously on the Internet, via the www.invaluabe.com website.
5. The persons who will deliver by the day prior to the Auction, i.e. 7 October 2022, by 18.00 the latest, by email or post to the address Antykwariat Derubeis, ul. Slowackiego 4/10, 32-020 Wieliczka, the purchase order in writing as set out in the form annexed to the Auction catalogue and available at the antique bookshop website www.derubeis.pl, can also take part in the Auction. The form must include the data identifying the Bidder (name and surname / name, address for service, telephone number / email address), the item number, the Author's name, the initial words of the title and the price limit. The form also includes information whether in the case of the same limits they may be increased. Orders and limits are confidential and a person entitled by the antiquity bookshop takes part in the Auction on behalf of the applicant. In the event of identical limits sent by post or email, the priority rule of 'first come, first served' will be applied, i.e. the Bidder who has placed the offer first, wins the Auction.
6. Telephone bidding is also possible during the Auction upon previous application and registration according to the rules specified in Point I. 5., except providing the limit.
7. The Auction organiser may exclude the persons violating the Auction rules and behaving contrary to the generally accepted rules of culture and social coexistence.
II . The Auction items and viewing them
1. The objects of the Auction are original period items, whose bibliographic descriptions are included in the catalogue.
2. The objects of the Auction may be viewed:
- on the day of the Auction, i.e. 8 October 2022, from 9.00, in Hotel Francuski in Kraków at 13 Pijarska Street, the Olympic Room, 1st floor;
- on 7 October 2022, from 10.00 to 17.00, the antiquity bookshop office in Wieliczka, 4/10 Slowackiego Street, only upon prior appointment by phone or email.
2. The preservation condition of papers is determined according to the international grading scale: UNC - Uncirculated, value ultimately not emitted, perfect condition; EF - Extremely Fine, very good condition; VF - Very Fine, good condition; F - Fine, poor condition. Each grade on the scale can be made more precise by adding '+' or '-'.
3. The preservation condition of antique prints, books, manuscripts, documents and engravings is descriptive with the abbreviation 'VG' standing for very good condition and 'G' - for good condition. For average and poor condition we do not use abbreviations in the catalogue description.
4. The description of items preservation should be understood with reference to their age: 'very good' condition of a 400-year-old print is not the same as of a 50-year-old book.
III . The conduct of the Auction, submissions and item purchase
1. Submissions in the Auction take place in the following ranges:
- PLN 50 to 200: + PLN 10
- PLN 200 to 500: + PLN 20
- PLN 500 to 1000: + PLN 50
- PLN 1000 to 2000: + PLN 100
- PLN 2000 to 5000: + PLN 200
- PLN 5000 to 10 000: + PLN 500
- PLN 10 000 to 20 000: + PLN 1000
- PLN 20 000 to 100 000: + PLN 2000
- above 100 000: + PLN 5000
2. The Auctioneer is entitled to freely combine or separate the items put up for sale, and to withdraw the items from sale without any express justification.
3. In the event of explicitly justified objection to the offer closing the bidding, expressed by the participant of the bidding immediately after its completion, the Auctioneer is entitled to conduct the bidding again.
4. The highest Bidder becomes the Purchaser.
5. Bidding for an item closes with the fall of the hammer and the Auctioneer's announcement 'sold' (French adjugé). According to the Civil Code, the Bidder thus enters into the agreement to sell and from that moment is obliged to purchase the item.
6. All the prices in the catalogue are reserve prices. There is no possibility of bidding below their limits. The items can also be purchased at the reserve prices without submission.
7. All final prices are gross prices and they do not include any additional commissions, organisational charges or implicit costs. Commission of auction house is 10%. The additional charges will be delivery costs determined individually in accordance with the Purchaser's requirements, however, not lower than the rate of the Polish Post for insured shipments with the 'fragile' option. The rates for the services provided can be found on the Polish Post website: cennik.poczta-polska.pl.
8. The property rights to the purchased item pass onto the Buyer once the entire payment has been made. There is no possibility of an instalment scheme. The payment can be made during the auction or immediately afterwards, in cash or by debit card. In the days following the Auction, payments can also be made by bank transfer to the Derubeis Antique Bookshop business account in PLN: 11 1240 5080 1111 0010 3286 0929, or in EUR: 20 1240 5080 1978 0010 4342 8635. For incoming foreign transfers the IBAN format is respectively: PL 11 1240 5080 1111 0010 3286 0929, or PL 20 1240 5080 1978 0010 4342 8635, BIC/SWIFT: PKOPPLPW.
9. As the transaction confirmation, the Purchaser receives a till receipt. An invoice may be issued upon request. In order to receive an invoice, the Bidder is required to provide such information while registering for the Auction and to provide invoice data: full company name (or name and surname), address, and Tax Identification Number (Pl NIP).
10. The Buyer is obliged to pay the purchase price for the item and collect it within 14 days after the Auction.
11. In the event of not paying for or not collecting the item within 14 days after the Auction, a storage fee of PLN 10 per day of warehousing the item will be charged.
12. The lack of payment of the item purchase price does not exempt the Bidder from covering any costs arising from winning the item, including potential claims of the consigner or the item owner.
13. The Purchaser has a right of withdrawal from the purchase agreement within 14 days after the Auction only if the catalogue description of the item differs considerably and evidently from its actual condition. In disputed cases, the Buyer's claims can only be taken into consideration after a delivery of a reliable expert opinion within this time limit.
14. The Auction organiser does not bear responsibility for any hidden physical or legal defects of the won items.
15. The Jagiellonian Library and the National Library, as well as the museums included in the List of Registered Museums in Poland, have pre-emptive purchase rights at the hammer prices, on the condition they declare their interest in buying immediately after the Auction closing at the latest.
16. Please note that, according to the Polish law: the Act of 18 March 2010 on the Amendment to the Act on the Preservation and Protection of Historic Monuments and on the Amendments to other laws (Dz. U. of 2010, No. 75, item 474),taking abroad publications worth more than PLN 6,000, and documents worth more than PLN 16 000, from more than 100 years ago, and manuscripts worth more than PLN 4,000 from more than 50 years ago, requires the Minister of Culture and National Heritage assent. No shipping beyond the borders of Poland above these limits.
IV . Personal Data Processing
1. The Bidder, by providing their personal data in the registration process before the Auction or in writing, agrees that their personal data will be processed by Derubeis Antiquity Bookshop in order to participate in the Auction in accordance with the Personal Data Protection Act of 10 May 2018 and the Act on Electronically Supplied Services of 18 July 2002. The administrator of the personal data of the Auction participants is Derubeis Antiquity Bookshop Kamil Swiderski, located in Wieliczka, 32-020, ul. Wygoda 16. The Bidder has the right to access their personal data, to rectify it and to object to its processing, as provided for in the Act. The Antiquity Bookshop informs that providing personal data by the Bidder is voluntary, yet it is indispensable for the proper conduct of the Auction.
2. All personal data of the bidding participants is confidential and will only be administered by the Antiquity Bookshop. The data will not be given to third parties.
3. The Bidder agrees to receive commercial and marketing correspondence from the Antiquity Bookshop also in the electronic form. Such consent may be withdrawn at any time.
5. According to the regulations in force (the Act on Counteracting Money Laundering and Financing of Terrorism, Dz. U. of 16 November 2000, No. 116, item 1216, as amended), the Antiquity Bookshop is obliged to collect personal data of the clients who make transactions worth more than EUR 10,000.
6. According to the regulations in force (Dz. U. of 4 December 2017, item 2249), the Antiquity Bookshop is obliged to collect personal data of the Auction participants who make transactions worth more than PLN 10,000. The data (name, surname, PESEL number) should be stored in the so-called Registration Book of the Monuments Accepted or Offered for Purchase and the Issued Expert Evaluations, in force since December 2017.
V. Final Provisions
1. In matters not governed by these rules, the relevant regulations of the law in force, in particular the Civil Code, will be applicable.
2. Participation in the Auction is synonymous with the acceptance of the terms and conditions specified in these rules.
