TERMS & CONDITIONS

1. Participating in an Auction
By bidding at auction, you agree that these Conditions of Sale, as modified by any additional notices or terms published on our or any auction platform website that hosts this action are your entire agreement with the Seller and National Artifacts, Inc. and that they govern all bidders.

2. Minimum Bids; Reserves
All lots have a minimum bid designated in the catalog and the on-line listing. Certain lots may also have a reserve, which is the confidential price below which the lot will not be sold. The reserve is almost always geater than the minimum bid. If the bidding does not meet the reserve at the close of the auction, the lot will be designated as "passed" or "unsold."

3. Buyer's Premium
A buyer's premium will be added to the hammer price and is payable by the purchaser as part of the total purchase price for the benefit of NA. The buyer's premium is calculated as follows:

Twenty-five percent (25%) of the hammer price for lots paid by cashier's check, money order, wire transfer or certified, cashier's, bank or personal check within seven (7) days of the date of the invoice;
Twenty-eight percent (28%) of the hammer price for lots paid by any means more than (7) days after invoices are sent out.
To comply with legal obligations to which we are subject and cooperate with regulators and law enforcement bodies; and
For other purposes that we tell you about specifically when you register or provide data about yourself to us.
4. Registering to Bid
To bid, you must next accept these Terms & Conditions of Sale and the Terms of Use. You may then place bids once the auction has opened. You agree that all bids that you submit are final and irrevocable. NA reserves the right, in its sole discretion, to refuse your participation before, during, or after the sale.

5. Bidding
Provided the lot has met the reserve amount - The bidder who places the highest bid accepted by NA will be the purchaser of the lot. NA has absolute discretion in all matters relating to bidding, including, but not limited to, identifying the winning bidder, handling mistakes or errors in bidding, re-opening bidding, cancelling the sale, and re-offering the property for sale. NA may place bids below the reserve on behalf of the Seller, either consecutively or in response to other bids. Neither NA nor the Seller is liable for any errors in the bidding process.


Other Bidding
NA reserves the right, in its sole discretion, to execute written or telephonic bids, but shall have no obligation to do so and shall not be liable for any errors or omissions in executing such bids should it agree to do so.

6. Bidding Increments
When bidding, you will be able to view the current high bid for each lot. The bidding will proceed in the following increments, subject to NA's discretion:

7. Postponement; Withdrawal
NA reserves the right to postpone any auction or withdraw any lot before, during, or after the sale; we shall have no liability whatsoever for such withdrawal. NA may also, in its sole discretion, extend the closing time for any Lot.

8. Bidders
By participating in the sale, you represent, warrant, and agree that:

Neither you individually nor--if "you" are a company or other entity--any person who owns, partly owns, or controls the company or entity, are subject to trade sanctions, embargoes, or any other restriction on trade in the jurisdiction in which you or it does business, as well as under the laws of the European Union, the laws of England and Wales, or the laws and regulations of the United States (collectively, "Sanctioned Person(s)");
Where acting as agent (with NA's prior written consent), your principal is not a Sanctioned Person(s), nor owned (in whole or in part) by a Sanctioned Person(s), nor controlled by a Sanctioned Person(s);
None of the purchase price will be funded by any Sanctioned Person(s), nor will any party involved in the transaction, including, but not limited to, financial institutions, freight forwarders or other forwarding agents, or any other party, be a Sanctioned Person(s), nor owned (in whole or in part) by a Sanctioned Person(s), nor controlled by a Sanctioned Person(s), unless such activity is authorized in writing by the government authority having jurisdiction over the transaction or in applicable law or regulation; and
You are financially sound and know when and how you will pay for the lot if you are the winning bidder.
Your bidding is consistent with federal and state antitrust law and is not the product of any collusive, anticompetitive or other illegal agreement, arrangement or conduct.
NA may request a government-issued identification containing a photograph, such as a passport, identity card or driver's license, or comparable documents in the case of an entity, including evidence of beneficial ownership of the entity, in order for you to register to bid or following the sale. NA will use this information to verify your identification and screen for regulatory and financial risk. Additionally, NA may conduct a World-Check check for screening and due diligence purposes.

9. Authenticity Guarantee
Trading Cards and Game Tickets
All sales of trading cards and game tickets encapsulated by a Third-Party Grading company ("TPG") (including, but not limited to, PSA, Beckett (BGS, BVG and BCCG) and SGC) are final and not subject to return.
NA does not guarantee that a lot graded by a specific TPG will receive the same grade from another TPG. A difference in opinion between TPG companies is not a basis for rescinding a sale of the lot.
The sale of ungraded trading cards and game tickets are final and not subject to return.
Population report information is accurate up to the time in which a lot is posted for auction and is subject to change. National Artifacts is not liable if information changes during the auction.

Comics and Video Games
All sales of comics and video games that have been graded by Certified Guarantee Company ("CGC") with respect to comics, or Watta Games or Video Game Authority ("VGA") with respect to video games, are final and not subject to return.
NA does not guarantee that a lot graded by CGC, Watta Games or VGA will receive the same grade from another TPG. A difference in opinion between TPG companies is not a basis for rescinding a sale of the lot.
The sale of ungraded comics and video games are final and not subject to return.
Other Lots Authenticated by a TPG
The sale of any other lot that has been authenticated by a TPG is final and not subject to return.
All Lots Are Sold AS IS, WHERE IS unless stated in lot's description. There are NO RETURNS or REFUNDS for ANY reason. We try to describe items as accurately as possible, but it is your responsibility to ask questions and request photos BEFORE the auction. We are not graders, please rely on your own comfort levels as we do not guarantee any item will get particular grade (s). If an item has a COA or LOA it is listed as such, or it is stated if there is none. If you are not 100% confident and comfortable please do not bid on the lot.
NA has the sole discretion to waive any of the above requirements.

You agree and understand that the rescission of a sale and the refund of the original purchase price paid is your sole remedy and in lieu of any other remedy which might otherwise be available to you. Neither NA nor Seller shall be liable for any special, punitive, incidental, consequential, or other damages incurred or claimed including, but not limited to, lost profits or interest.

Condition, etc.; As Is
We guarantee the authenticity of the lot to the extent described in the Authenticity Guarantee, and that you will receive good title to the lot to the extent required by law. Otherwise, you agree that each lot is sold "as is" and in the condition that it is in at the time of the auction. Neither NA nor the Seller makes any representations or warranties of merchantability, fitness for a particular purpose, correctness of the catalogue or other images, or descriptions of the physical condition, size, quality, rarity, importance, medium, provenance, exhibitions, literature, or historical relevance of any lot. No statement anywhere, whether oral or written, whether made in the catalogue, an advertisement, a bill of sale, or elsewhere, can be relied on by you or others to be a warranty, representation, or shall give rise to the liability of NA or the Seller. Images and condition reports are not meant to be complete or a substitute for assessing the condition of the lot yourself or through an agent you may engage; they are for guidance only. Nothing in any written or oral descriptions of a lot constitutes a representation of fact; they represent the opinions held by NA.

10. Viewing
NA will attempt to arrange appointments for viewing of the property at NA's location when possible prior to the close of the auction. Please contact NA directly or at [email protected] to arrange a viewing. In addition, there are multiple images of the lots available at online on the bidding platform you are using. If you'd like additional info or pics please request before the auction starts, contacting us as the auction is LIVE on the day of the auction is unlikely to yield you any information. Do not bid on any lot (s) you are not completely comfortable with as there are NO RETURNS or REFUNDS for any reason unless NA allows such at our sole discretion.

11. Winning Bidder's Obligations
Subject only to these Conditions of Sale, the closing of the lot establishes a binding contract and the winning bidder. NA will email an invoice in the name of, and with the address registered for the bid, to the winning bidder, which cannot be transferred to other accounts, names, or addresses without NA's explicit agreement in writing.

Payment
Unless otherwise agreed by NA in writing, the winning bidder must pay the full price invoiced (including buyer's premium, applicable tax, and other amounts due), so that it is received by NA in good, cleared funds within seven (7) days of the close of the auction. NA will email the invoice to the buyer the first business day after the close of the auction.
NA accepts payment by personal, certified, cashier's or bank checks, money order, wire transfer, credit card (Visa, MasterCard, American Express and Discover) and cryptocurrency (BTC, LTC or ETH). Please note that (i) wire transfers in the amount of $1,000 or less will incur a $25.00 processing fee; (iii) NA will hold for seven(7) business days lots paid for by personal check.
NA, may in its sole discretion, grant purchasers extended payment terms prior to auction.
Tax
Unless exempted by law, the purchaser will be required to pay New Jersey sales tax on the total purchase price, including the buyer's premium, on any property picked up or delivered in New Jersey, regardless of the state or country in which the purchaser resides or does business. In addition, unless the purchaser provides NA with a valid resale certificate prior to shipment, the purchaser will be required to pay applicable sales tax where NA determines, in its sole discretion, that it is legally obligated to collect such tax.

If the lot is delivered to a state where NA is not required to collect sales tax, it is the responsibility of the buyer to self-assess any sales tax, use tax or valued-added tax (VAT) and remit it to the taxing authorities in that state or country.

Title
Title to, and right to possess, a lot will not pass until NA has received the full purchase price in good, cleared funds. NA is not obligated to release a lot to the winning bidder unless he, she, or they have paid the full purchase price (inclusive of the buyer's premium, taxes, and any other costs identified by NA).

Shipping and Collection of Property
No lot will be released or shipped to a purchaser until NA has received full payment in good, cleared funds.
Purchasers who have completed payment may arrange to pick up the lots at NA's New Jersey location. In such instances, NA will collect New Jersey sales tax from the purchaser unless the purchaser has a valid New Jersey resale certificate. Please note that lots cannot be picked up in person at or immediately after the conclusion of a live auction.
Fed Ex or UPS (for lots shipped internationally) to a physical address (i.e., not to a PO Box). Invoices greater than $500.00 will require an adult signature to accept delivery.
Lots shipped via Fed Ex, UPS or USPS shall be covered by the carrier's insurance and buyer will be charged $1.60 per $100 of insurance. NA shall otherwise have no liability for loss or damage to the lots.
Extremely large or heavy items may require special shipping arrangements; NA recommends that bidders contact us before bidding on such items to determine the approximate shipping cost.

Concerns about Funds
NA has the right to refuse to accept payment if, in its sole discretion, it has concerns about the accuracy of any of the representations and warranties above, payment comes from a source other than the registered winning bidder identified by NA as the purchaser of record, or if it believes that accepting the payment would be unlawful or may subject NA to any liability.

Unmet Payment Obligations
Without prejudice to any rights the Seller may have, if you fail to pay the full purchase price invoiced (including buyer's premium, applicable tax, and other amounts due) for a lot in good, cleared funds within seven (7) days of the close of the auction, we may in our sole discretion exercise one or more of the following remedies:

Pay for the lot in full using the credit card that you provided us at the time you registered to bid;
Cancel the sale of the lot, retaining any partial payment as liquidated damages;
Charge interest at 1.5% per month from the date payment became due until the date the full purchase price is received in cleared funds;
Resell the lot by auction or private sale, it being understood that in the event such resale is for less than the original hammer price plus buyer's premium for that lot, the initial purchaser will remain liable for the shortfall together with all costs incurred in connection with such resale;
Commence legal proceedings to recover the hammer price plus buyer's premium for that lot, together with interest, reasonable attorney's fees, and the costs of such proceedings;
Set off the outstanding amount remaining unpaid by the purchaser against any amounts which we may owe the purchaser in any other transactions; and/or
Release information about the winning bidder sufficient to enable the Seller to recover the amounts due from the auction, plus costs and reasonable attorneys' fees, in legal proceedings or otherwise.
12. Resolving Disputes
We hope never to have any disputes with you but, if we do, we will first try to resolve it amicably if we (in our sole discretion) believe that we reasonably can. If we do not resolve the dispute, this section contains the important terms to which you and other bidders agree by participating in the auction.

Governing Law and Jurisdiction
These Conditions of Sale, as well as bidders', the purchaser's, and our respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of New Jersey.

Dispute Resolution
The Parties agree that any disputes, claims or controversies arising out of or relating to this Agreement shall be submitted to JAMS, or its successor, for mediation. If the matter is not resolved through mediation, the parties submit to the exclusive jurisdiction of the United States District Court for the District of New Jersey or, if jurisdiction in such court is lacking, the courts of the State of New Jersey in connection with the filing of a lawsuit. The prevailing party shall be entitled to collect its costs, including reasonable attorney's fees.

Limitation of Liability
Under no circumstances shall the aggregate liability of NA and the Seller to a purchaser exceed the purchase price actually paid. NA will not be liable for any errors or failures to execute bids or for any errors or failures caused by (i) a loss of connection to the internet or to NA's or a 3rd party's online platform or website by either NA or a bidder; (ii) a breakdown or problem with NA's online platform software, a 3rd party auction platform's software or website; or (iii) a breakdown or problem with a bidder's Internet connection, mobile network or computer.

ALL SALES ARE FINAL - There are NO RETURNS or REFUNDS for Any reason, please only bid when/if you are 100% comfortable with the description and photos of the item you intend to bid on.

SHIPPING AND HANDLING TIME - We pack and ship items in-house, unless the item (s) need (s) to be insured for more than $10,000 in which case we, at our discretion, may bring items to be packed and shipped at a UPS Store. All items will be fully insured. Buyer is solely responsible for all shipping and handling and insurance costs, please factor that into your decision when bidding.

*Please allow 3-4 weeks for delivery of your item (s) once you pay in full. We ship as fast as we possibly can, but since we pack and ship in-house and we pack very securely, it takes time to get over 700+ lots together for shipping. Be patient please.
