The FW AUCTION auction house is the commercial name of the company FW AUCTION SRL under Belgian law, registered under the company number 0752926272 and having its registered office rue Dewez N° 29 at 5000 Namur Belgium.

The auctions organized by the Auction House FW AUCTION are subject to these conditions. Participation in the auction implies unconditional acceptance of these conditions. These conditions can be consulted by everyone in the catalog or other documents specific to the FW AUCTION auction house. They apply to all depositors and visitors:

-1. Potential buyers are invited to examine the properties that may interest them during the exhibitions organized before the auction.

Dimensions, weights and estimates are indicative only. The colors of the works in the catalog may be different due to the printing processes. The absence of any mention of condition in the catalog does not imply that the lot is in perfect condition or free from restoration, wear, cracks, relining or other imperfection. Goods are sold in the condition they are in at the time of sale. No complaints will be accepted once the auction has been declared, the prior exhibition having allowed the examination of the object. All indications appearing in the catalogues, advertisements, or other publication made by the auction house FW AUCTION are only indications, in no way engaging the responsibility of the auction house. They do not guarantee the author, the origin, the date, the provenance, the attribution, the estimate, the weight, the dimensions or the condition of the lot.

It is up to the buyer to personally ensure the accuracy of the information given in these various catalogues.

-2. The highest bidder last bidder will be the successful bidder. He will be obliged to pay the hammer price of the lot in cash, plus 28% for costs and VAT, together with the resale right when this is applicable to the work.

Buyers choosing the Drouot Digital platform will be billed an additional 1.8% including tax and an additional 5% excluding tax for Invaluable

-3.a. The sale is made according to the order established in the catalog and under the conditions of sale established by the FW AUCTION auction house.

The FW AUCTION auction house reserves the right to proceed with any meeting or withdrawal of lots, decision, refusal of any bid, without having to justify its decision.

The administrators and the bailiff reserve the right to challenge a sale in the event of a dispute or error in the award, to suspend a sale, to refuse a bid or to withdraw lots from the sale if they consider that the auctions are insufficient or do not occur freely. They also reserve the right to modify the numerical order of the catalog, to divide or combine lots.

Any dispute about an auction will be settled sovereignly by the bailiff instrumenting the sale. No appeal can be made against his decision.



-3.b. In the event of a double auction or late auction, both indoors and on the DrouotLive and Invaluable platforms, the lot may be put up for sale, with the agreement of the bailiff, at the amount of the highest bid, free to the parties. to raise new bids or withdraw. No appeal will then be possible. Only the confirmation of the auction house FW AUCTION is authentic as to the definitive adjudication of a lot and upon receipt of the adjudication slip after the sale.

-4. The buyer is deemed to act in his name and for his personal account, even for the lots he would have acquired as an agent. He is bound by the adjudication. However, the auction house FW AUCTION always remains free to refuse the auction, even after the end of the auction, without having to justify its decision.

-5. The risks pass to the purchaser upon auction. However, he will only become the owner upon full payment of the price and its accessories. Payment in cash is limited to 2,999 euros per slip The price of the sale by a trader of one or more goods for an amount of 3,000 euros, or more, can only be paid in cash for an amount not exceeding 10% of the sale price and provided that this amount is not greater than 2,999 euros, whether the sale is carried out in one operation or in the form of split operations which appear to be linked.
For purchases made remotely (Live, Purchase orders, Telephones), payment can be made directly by credit card only in the Auction House's offices (neither by phone nor via internet link). In case you cannot move, only bank transfer is possible.

-6. In accordance with Belgian legislation relating to copyright and related rights, the buyer is also, where applicable, liable for the resale right for the benefit of the artists and authors of the works sold, in addition to the total sale price of the property. . This obligation remains even in the event that the claim for these rights occurs after the sale and removal of the lot, without time limit.

- For works to which the resale right applies, from 2000 euros, the purchaser must pay in addition to the auction and the legal costs:

4% for the portion of the sale price up to €50,000
3% for the portion of the sale price between €50,001 and €200,000
1% for the portion of the sale price between €200,001 and €350,000
0.5% for the portion of the sale price between €350,001 and €500,000
0.25% for the portion of the sale price above €500,001
The total amount of the resale right is capped at €12,500

-7. Payment and collection of lots must be made after the sale or during the 5 days following the public sale, Monday to Friday from 10 a.m. to 12.30 p.m. and from 2 p.m. to 6.15 p.m. After this period, the FW AUCTION auction house reserves the right to put the outstanding lots back on sale for crazy bid and at the expense of the person to whom they were awarded, without prior notice.

-8. Anyone who buys via the Internet without having seen the lot(s) will not be able to contest the purchase in the event that the object(s) are non-compliant. Photos and additional details may be requested before any purchase via the Internet.

The buyer-bidder may participate in the auction by telephone or electronically. He will then have to confirm his participation by letter, by email, and provide all the information that would be required by FW AUCTION. The buyer-bidder authorizes FW AUCTION SRL to keep his data and to inform him by all means of future sales. Purchase orders will only be considered when received at least 24 hours before the sale. Requests for telephones are accepted from 50 euros and are worth a purchase order at the low estimate, whether the buyer-incher is reachable or not. FW AUCTION cannot be held responsible for errors by the buyer-bidder in indicating the lot number, or the telephone number where he should be called, his e-mail address or any problems with technical order in the establishment of communication.

FW AUCTION on live platform is an external service; FW AUCTION accepts no responsibility for the non-execution of an order or for errors or omissions that may occur in connection with the use of this service by the bidder, including for a loss of internet connection, a failure or problem with online auction software, hardware or system compatibility issue.

In all circumstances, the officiating hammer maker for FW AUCTION is sovereign to accept or refuse a bid or an adjudication without giving reasons, reserving the right to designate the successful bidder, to continue the sale or to cancel it, or to postpone a lot for sale or to withdraw it from sale.

-10. The buyer-bidder was able to assess the property sold in person during the exhibition prior to the public sale session, even when participating in the auction by means of remote communication.

-11. Any damage caused to the lots listed in the catalog, to other goods or to persons during the exhibition, deposit or removal of the goods must be compensated by the person in charge, the Auction House FW AUCTION not replacing not the responsibilities of others.

-12. In the event of a dispute, the courts of Namur will have sole jurisdiction.

Classic Cars / Ancestors (in addition to our sales conditions)

b. Vehicles are sold as is. The information given in the catalog is given for information only. Indeed, the condition of a car can vary between the time of its description in the catalog and that of its presentation for sale. f. The change of vehicle registration is at the expense and under the sole responsibility of the buyer.

g. The removal of the vehicles must be carried out for the day after the public sale. After this period, they will remain at the expense, risk and peril of their owner and their delivery can only take place once the storage costs have been paid. Agreements can be made in advance with the auction house.

h. Buyers must ensure that they have all documents and keys relating to their lot when they take it away.
