GENERAL CONDITIONS OF SALE

1. BASE PRICE
The lots are offered for sale at a base price indicated in the catalog, which corresponds to the minimum price below which bids for the lot will not be accepted.
2. SALE PROCEDURES
2.1. Lots are offered for sale at the public premises of Fidelis Auctions S.r.l., in Bologna, Piazza Dè Calderini 2/2, or occasionally at a different location if indicated in the auction catalog. Fidelis Auctions S.r.l. acts as exclusive agent but without representing the individual seller, whose name is recorded in the appropriate public registers at the company's headquarters.
2.2. The effects of the sale are binding on the seller; Fidelis Auctions S.r.l. assumes no responsibility towards the buyer or third parties beyond those arising from its role as agent.
2.3. Fidelis Auctions S.r.l. reserves the right to withdraw any lot from the auction.
2.4. Lots are awarded to the highest bidder. Payment must be made in full within 7 days of the auction via bank transfer, debit or credit card, cashier's check, or cash. In compliance with anti-money laundering regulations, cash payment is excluded for amounts exceeding €5,000.00, and any future legal changes will determine the maximum allowable cash payment. Payments by check or bank transfer are considered settled only upon verification of the transfer by our bank. Credit card transactions incur a service fee of 3%. No items will be delivered prior to full payment.
2.5. Within the same 7-day term, the buyer shall pay Fidelis Auctions S.r.l., to the following account:
1. Account Name: Fidelis Auctions S.r.l.
2. IBAN: IT56Y0707202405000000751426
2.6. For the validity of any award, each participant must complete a Participation Form before each auction, providing personal details and a valid identification document and tax code.
2.7. Fidelis Auctions S.r.l. may accept purchase mandates (written, telephone, or online bids) at predetermined prices, placing bids through the auctioneer in competition with attendees.
2.8. In case of two written bids for the same lot, the lot will be awarded to the participant whose bid was received first. Fidelis Auctions reserves the right to refuse bids from unknown or unreliable participants unless a deposit covering the bid is provided or suitable guarantees are offered. Upon award, Fidelis Auctions S.r.l. may request confirmation of the buyer's identity and appropriate, verifiable bank references, along with any other necessary or useful information for the purchase. In case of incorrect or incomplete information, including previously provided references, Fidelis Auctions S.r.l. reserves the right to revoke the lot award.
2.9. Pursuant to Article 1229 of the Italian Civil Code, Fidelis Auctions S.r.l. disclaims any liability regarding the description of lots in catalogs, brochures, on its website, or any other promotional material. Such descriptions and illustrations are purely indicative and cannot create any reliance by auction participants, who are responsible for examining the condition of each lot in advance, carrying out or commissioning any necessary inspections.
2.10. In view of the above, Fidelis Auctions S.r.l. organizes a preview of the lots at its premises well in advance of the auction date, allowing clients to verify quality, type, condition, authenticity, and provenance. Measurements in catalogs are given in the order: height, width, depth. Interested buyers may request a condition report via email free of charge for any lot(s) of interest.
2.11. It is assumed that the buyer, regardless of the participation method, has had the opportunity to examine the lot. In any case, Fidelis Auctions grants each buyer a 14-day right of withdrawal if the work is verified as inauthentic by the relevant archives. After this period, the contract with the auction house is irrevocable, and authenticity is deemed verified; any late disputes may only be raised against the seller.
2.12. If bids are received before a lot is put up for auction, bidding will start from the last maximum bid received.
2.13. The buyer, having fully paid the hammer price and auction fees, must collect the purchased lots at their own care, risk, and expense within 7 days of the auction. Late collection without prior agreement incurs a fee of €5 per day. Upon agreement, Fidelis Auctions S.r.l. may organize packing, transport, and insurance of the lot at the buyer's expense and risk.
2.14. Fidelis Auctions S.r.l. reserves the right to agree with buyers on special payment terms, allow installment payments, store lots privately or publicly, sell uncollected lots privately, insure awarded lots, manage disputes with buyers, and generally undertake any actions deemed necessary to recover amounts due.
2.15. Fidelis Auctions S.r.l. assumes no responsibility regarding export restrictions or permits that buyers must obtain according to current law.
2.16. These conditions of sale, published on the website https://fidelisaste.com/ , are deemed accepted by all auction participants and are available upon request. Any disputes fall under the exclusive jurisdiction of the Court of Bologna
