Terms and Conditions

1. All property is sold AS IS. It is the bidder’s responsibility to determine the exact condition of an item by personal inspection or by contacting McMasters Harris with any questions or concerns prior to placing a bid. McMasters Harris makes every effort to provide an accurate description of each item and to point out damage, if noted. However, neither McMasters Harris Auction Co. nor the consignor makes any guarantees with respect to the property, and neither shall be responsible for accuracy of description, attribution, provenance or condition of any item.

2. Buyer’s Premium: 14.5% (discounted 2.5% for cash or check) will be added to the hammer price for Gallery purchases. 17.5% will be added to the hammer price for Artfact Live! purchases.

3. Shipping Costs: A packing charge of $5.00 per item will be added to all Internet and absentee purchases. In addition, buyers will be responsible for postage and postal insurance.

4. Payment: All accounts must be settled immediately upon conclusion of the auction. We accept Visa, MasterCard, Discover, and American Express; PayPal is also accepted for Artfact Live! payments.
For Live Internet, absentee and phone purchases, McMasters Harris will charge the credit card on file with our company within 5 days of the conclusion of the auction.

5. Reserves: Unless explicitly stated otherwise by Auctioneer, each lot or item is being sold with reserve as a reserve auction. These terms are applicable to all reserve auctions. The Auctioneer and seller reserve the right to withdraw any property before and during the sale of such property. The seller reserves the right to reject any and all bids for any reason. The Auctioneer, at its sole and complete discretion, may reject a nominal and/or fractional bid advance. Auctioneer reserves the right to place a bid on any lot on behalf of the seller up to the amount of the reserve, if any. Auctioneer will not specifically identify bids placed on behalf of the seller.

6. On the fall of Auctioneer’s hammer or otherwise announcing the item sold, title passes to the successful bidder, subject to the conditions set forth herein. At that time, the bidder assumes full risk and responsibility for the item and agrees to pay the purchase price plus any pertinent fees and/or tax.

7. If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, McMasters Harris Auction Co. may exercise all of its rights and remedies under the law including, without limitation, a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser’s breach and/or b) offering at public auction, without reserve, any lot or item for which the purchaser has failed to pay in full the purchase price, holding the purchaser liable for any deficiency plus any costs of sale.

8. Absentee bids and phone bids, if any, are offered to bidders who are unable to attend personally. These bids and/or left bids are executed competitively by a member of our staff. In the case of identical bids from attending and absentee bidders, preference will be given to the attending bidder. McMasters Harris Auction Co. accepts no responsibility for any errors in the execution of absentee bids. All items sold AS IS.

9. Live Internet bidding is offered as another means of participating at our auctions. Bidders shall not hold the auctioneer, his client nor his staff responsible for failure in execution of bidding or bid acceptance on this Internet bidding system. It is our best attempt to execute the bidding as timely and accurately as possible. Certain human and technical elements and limitations can have an effect on the process, such as computer experience, human error, loss of Internet connection, slow connection speed, and web server failure.

10. Registration: All bidders must register their name, permanent street address and phone number prior to the auction. Internet bidders are required to register and establish an account with McMasters Harris Auction Co. This may be accomplished by providing any of the following: Credit card information, a Bank Letter of Credit, Certified or Bank Check, Personal/Company Check accompanied by a Letter of Guarantee or Wire Transfer of Funds (contact McMasters Harris Auction Co for instructions).

11. All purchases are subject to state sales tax unless purchaser possesses a sales tax exemption number.

12. The auction company reserves the right to refuse service to any person.

13. All announcements made day of auction take precedence over any and all written or verbal statements.

14. The Uniform Commercial Code and the laws of The State of Ohio pertain to this auction.

15. All auctioneers are licensed according to the Auctioneer Licensing laws of The State of Ohio.

16. By bidding on any item, the bidder shows acceptance of these terms and all other terms announced at the time of sale.

Credit Cards

We accept credit cards for payment for any winning online bidders at all sales. We require credit card information to bid, and may use it for payment if you are the winning bidder.

Payment Information

All accounts must be settled immediately upon conclusion of the auction. Personal checks for Gallery items only will be accepted only if credit has been established with McMasters Harris Auction Co. or if a bank authorization has been received guaranteeing a personal check. McMasters Harris Auction Co. reserves the right to hold merchandise purchased by personal check until the check has cleared the bank. Purchaser agrees to pay McMasters Harris Auction Co. a handling fee of $25 for any check dishonored by the bank. We also accept Visa, MasterCard, Discover, and wire transfer; PayPal is also accepted for Artfact Live! payments.
