Conditions of sale

art.1 - EURANTICO Auction House acts as agent in the name of each consignor who is on the appropriate registers of the Public Security Authority and therefore does not assume, towards the buyers, any liability deriving from the aforementioned capacity as agent. All liability pursuant to art. 1476 et seq. of the civil code remains with the owner-client.

art. 2 - The display preceding each sale is made for the purpose of thoroughly examining the condition and quality of the objects. Consequently, the successful bidder may not contest any errors or inaccuracies in the information contained in the auction catalogue or in the explanatory notes, or any discrepancies between the photographic image and the object of display and sale, and, therefore, the non-correspondence (even if related to the year of execution, to the references to any publications of the work, to the execution technique and to the material on which, or with which, it is made) between the characteristics indicated in the catalogue and the actual characteristics of the object awarded. After the award and collection, any disputes must be submitted in written form within ten days and if considered valid will only entail the reimbursement of the sum paid without any other claim.

art. 3 - The items are awarded to the highest bidder. The buyer, on the hammer price, will pay 29.40% including auction fees and VAT.

art. 4 - In the event of disputes regarding the awarding of an item, the Auction House Manager has the right to resume the auction starting from the initial auction base or the offer previously made.

art. 5 - The buyer, within ten days of the sale, having paid the price and the fees for auction fees, must collect what was purchased, at his own risk and expense. After this period, the Auction House will be exonerated from any liability towards the successful bidder in relation to any deterioration or decay of the items and will have the right to apply a penalty for each lot, for storage, equal to € 25.00 per day for furniture and € 10.00 per day for objects.

art. 6 - EURANTICO Casa d'Aste, as well as its employees, staff, collaborators and experts, cannot in any case be held responsible for any errors in the description of the works, for their incorrect attribution, authenticity and provenance, as they are the expression of their own opinions in accordance with the standards of diligence reasonably expected from an auction house.

art. 7 - The auctioneer may vary the order provided in the catalogue in the auction and will have the right to merge or divide the different lots.

art. 8 - Buyers are required to comply with all current legislative provisions relating to the objects subject to notification, with particular regard to articles 2, 3 and 5 of Law no. 1089 of 1.6.1939 and the Regulation of 30.1.1913 and subsequent amendments and additions. The export of objects by buyers resident and non-resident in Italy is regulated by the aforementioned legislation as well as by the customs and currency laws in force. The successful bidder, in the event of the exercise of the right of pre-emption by the State, will not be able to claim from the Auction House or the seller any reimbursement and any interest on the price and commissions already paid.

art. 9 - These conditions of sale are automatically accepted by those who participate in this sale. For any dispute, the jurisdiction of the Court of Viterbo is established.
