FW AUCTION Auction House is the trade name of FW AUCTION SRL under Belgian law, registered under company number 0752926272 and having its registered office at rue Dewez N ° 29 in 5000 Namur Belgium.
Auctions organized by the FW AUCTION Auction House are subject to these conditions. Participation in auctions implies unconditional acceptance of these conditions. These conditions can be viewed by everyone in the catalog or other documents specific to the FW AUCTION auction house. They apply to all depositors and visitors:
-1. Potential buyers are invited to examine properties that may interest them during exhibitions organized before the auction.
Dimensions, weights and estimates are only indicative. The colors of the works in the catalog may be different due to the printing process. The absence of a condition statement in the catalog does not imply that the lot is in perfect condition or free from restoration, wear, cracks, relining or other imperfection. The goods are sold in the condition they are found at the time of the sale. It is the buyer's responsibility to personally ensure the accuracy of the information given in these various catalogs.
-2. The highest bidder to the last bidder will be the successful bidder. He will have the obligation to pay the auction price of the lot in cash, increased by 28% for costs and VAT, without prejudice to the resale right when this is applicable to the work.

-3. The auction house FW AUCTION reserves the right to refuse any auction, to proceed with any decision, assembly or withdrawal of lots without having to justify its decision. The sale is made in the order established in the catalog and under the sales conditions established by the FW AUCTION Auction House. The administrators and the judicial officer reserve the right to protest a sale in the event of a dispute or an auction error, to suspend a sale, to refuse an auction or to withdraw lots from the sale if they consider that the auctions are insufficient or are not done freely. They also reserve the right to change the numerical order of the catalog, to divide or combine lots. Any dispute about an auction will be settled sovereignly by the bailiff handling the sale. No appeal can be made against his decision.
-4. The buyer is deemed to act in his name and for his personal account, even for the lots which he has acquired as an agent. He is bound by the auction. However, the auction house FW AUCTION always remains free to refuse the auction, even after the end of the auction, without having to justify its decision.
-5. The risks pass to the purchaser upon auction. However, he will only become the owner upon full payment of the price and its accessories. - For works to which the resale right applies, the purchaser must pay in addition to the auction and legal fees:
4% for the portion of the sale price up to € 50,000
3% for the portion of the sale price between € 50.001 and € 200,000
1% for the portion of the sale price between € 200,001 and € 350,000
0.5% for the portion of the sale price between € 350,001 and € 500,000
0.25% for the portion of the sale price over 500,001 €
The total amount of the resale right is capped at € 12,500

Payment and collection of the lots must be made after the sale or during the 5 days following the public sale, from Monday to Friday from 10 a.m. to 12 p.m. and from 2 p.m. to 5 p.m. After this period, the auction house FW AUCTION reserves the right to put back the overdue lots for sale due to a wild auction and at the expense of the party to whom they were awarded, without prior notice.
-8. Anyone who buys via the Internet without having seen the lot (s) will not be able to contest the purchase in the event that the object (s) are non-compliant. Photos and additional details may be requested prior to any internet purchase.
The buyer-bidder can participate in the auction by telephone or electronically. He must then confirm his participation by letter, by email, and provide any information that would be required by FW AUCTION. Buy orders will only be taken into consideration when received at least 24 hours before the sale. Phone requests are accepted from 50 euros and are worth a purchase order at the low estimate.
