SALE CONDITIONS
Lots are offered for sale by Guidoriccio Casa d'Aste - Gestifrem S.r.l., a company with its registered office at Via Massetana Romana 54, 53100 (SI) - VAT: 01206850529, acting on behalf of the Seller as a mandate. The Seller refers to the individual or legal entity owning the lot offered for auction by Guidoriccio Casa d'Aste. Goods may be sold in groups of lots or individually, at the unquestionable discretion of the Auction House. Auctions will be held in venues open to the public and online.
Items are sold and awarded to the highest bidder. In case of disputes among multiple winners, the Auctioneer, at their unquestionable discretion, may put the item back up for auction, and it may be re-awarded in the same auction. Regardless, the winning bidders who raised disputes are bound to their previous bids that led to the new award. If there is no new award, the Auctioneer, at their unquestionable discretion, will communicate the winning bidder. Transfers of already awarded lots to third parties are not accepted. Guidoriccio Casa d'Aste holds only the winning bidder responsible for payment. Therefore, participating in the auction on behalf of third parties must be communicated in advance.
Guidoriccio Casa d'Aste reserves the right to withdraw any lot from the auction. The auctioneer conducts the auction starting from the bid they deem most appropriate, considering both the value of the presented lot and competing bids. The auctioneer may make consecutive bids or respond to other bids until the reserve price is reached. The starting price is usually below the market value, and bids are typically around 10% of the last bid. In any case, the auctioneer may vary the bids during the auction. The auctioneer has the authority, at their unquestionable discretion, to merge and/or separate lots and change the order of sale. The auctioneer may, at their unquestionable discretion, withdraw lots that do not reach the agreed reserve price between Guidoriccio Casa d'Aste and the Seller.
In addition to the winning bid, the Winning Bidder agrees to pay Guidoriccio Casa d'Aste, for each lot, a buyer's premium including VAT equal to 25% of the winning bid. For lots in temporary importation from non-EU countries, in addition to the auction fees mentioned above, if the Winning Bidder is a resident of an EU country, they must pay any other taxes resulting from the importation and reimburse all expenses necessary to convert the import from temporary to permanent. Please note that if the Seller is a VAT-registered entity, the Winning Bidder must also pay the resulting taxes.
To ensure the transparency of the auction, anyone intending to make bids must complete a participation form with personal data, duly signed. Guidoriccio reserves the right to verify the provided references and refuse participation in the auction to undesirable individuals.
Auctions are open to the public and without any obligation to purchase. Lots are usually sold in sequential numerical order as listed in the catalog. The auction will mainly take place online directly on our website www.asteguidoriccio.it. The bid is binding and cannot be withdrawn in any way at any time. It is advisable to carefully read our sales conditions.
Guidoriccio may accept mandates for purchase (through both written and telephone bids), making bids through the auctioneer, competing with participants in the room. To access this service, completely free of charge, you must fill out the appropriate form found in the catalog, at our offices, or by requesting it at
[email protected] (with a copy of an identity document attached). The lots will be purchased at the lowest possible price due to other bids in the room. In case of identical bids, the written bid takes precedence over the oral one. In the case of two identical written bids, not surpassed by room or telephone bids, Guidoriccio will consider the one submitted first as the winner. This service will be guaranteed within the limits of the available lines at the time and in the order of receipt of requests. Nevertheless, it is advisable to still indicate a bid that will allow us to act on your behalf only if it is impossible to contact you. Guidoriccio reserves the right to refuse, at its unquestionable discretion, offers from unknown and/or undesirable buyers.
Guidoriccio acts exclusively as an agent of the Sellers, disclaiming any responsibility for the description of the items in the catalogs and any other illustrative publication. All descriptions of goods are purely illustrative and indicative and do not create any reliance of any kind on the Winning Bidders, and Guidoriccio provides no guarantee regarding the attribution, authenticity, or origin of the items for sale, for which the Seller remains solely responsible. The auction will be preceded by an exhibition of the items to allow a thorough examination by prospective buyers. They, under their total and complete responsibility, can verify all the qualities of the items, such as authenticity, condition, type, material, and origin, of the items up for auction. In the case of jewelry, it is possible to view them only by appointment on the days indicated on our website. If the lots are not located at the auction house, and for those unable to physically attend the exhibition, future buyers are encouraged to request a detailed condition report on the conditions of each lot from our experts. All items are sold "as seen." After the award, no one can hold Guidoriccio or the Sellers responsible for the lack of any quality of the items awarded. Guidoriccio will not be responsible for any errors or forgery made on purpose. Despite possible references to experts external to the auction house, Guidoriccio does not guarantee their accuracy or authenticity. Any disputes must be submitted in writing within 10 days and, if deemed valid, will only result in the refund of the amount paid without any other claims.
Alongside each lot description in the catalog, an indicative estimate may be provided for potential buyers. In any case, all lots, depending on market interest, can reach prices both higher and lower than the estimated values. Estimates printed in the auction catalog may be subject to revision and do not include the buyer's premium and VAT. Each lot will be awarded only if the reserve price is reached.
Items for sale are considered used/antique items and, as such, are not subject to Consumer Code, according to the provision of Article 3, letter e) of Legislative Decree no. 206/2005.
Payment for lots must be made in Euros within 48 hours of the award, through three methods: 1) cash, respecting the limits of the current regulation at the time of payment, 2) POS, 3) bank transfer payable to Gestifrem S.r.l. Bank Banca Centro Toscana - Umbria Credito Cooperativo Iban IT80E0707514200000000739653 . In case of non-payment, while reserving the right to obtain compensation for any additional damages, Guidoriccio may: a) return the item to the unsold Seller and demand payment from the unsuccessful Winning Bidder for lost commissions; b) take action to enforce the obligation to purchase; c) sell the lot privately or in subsequent auctions, to the detriment of the unsuccessful Winning Bidder, withholding any deposits paid as a penalty.
Lots must be collected within 14 days of the award. Packaging and transportation arrangements will be agreed upon at
