Your bid constitutes a legally binding contract.
By bidding with Art Lovers Anonymous Auctions either directly or through an online bidding platform (e.g. Invaluable or AuctionZip), you are agreeing to abide by all associated auction terms.
Bidder approval is at the sole discretion of Art Lovers Anonymous Auctions.
1. The auctioneer reserves the right to reopen bidding on a sold lot (under extreme circumstances only) and is the sole determinant concerning all bid disputes and the final authority in regard to all auction terms and conditions.
2. All auction lots sold are subject to a buyer's premium. Payment in full is due on date of sale for lots won.
3. Unless exempted by law, all purchases are subject to a 7% FL state sales tax. FL state sales tax does apply to out-of-state, non-tax exempt buyers.
4. SALES TAX EXEMPTIONS: Florida law requires that all dealers must have a valid signed tax exemption certificate on file with us. Out of state dealers must provide a copy of their current exemption certificate.
5. Phone and absentee bidding directly with our auction house, and not through a third party company such as Invaluable, is offered as a courtesy. We are not responsible for errors or unexecuted absentee or telephone bids. (Bidders may place bids themselves online.)
6. All absentee bids must be in written form. We cannot accept verbal absentee bids. Submitted bids that are not commensurate with our standard Bid Increments will be rounded up to the appropriate level.
7. Make sure that you have the correct lot number! If you accidentally bid on a lot and win, you are still liable for payment as we are liable to the consignor.
8. Absentee bidders may be in competition with various INTERNET bidders (bidding in real time via computer) or PHONE bidders (bidding in real time via telephone).
9. Successful bidders are required to contact us to confirm receipt of invoice and to make arrangements for payment and shipping or pick up. EMAIL IS PREFERRED. Unless otherwise stated the deadline to contact us is 5:00 PM ET on the Monday following the auction. Calls to our office should be made during OUR business hours.
10. Payment for lots won as an absentee, phone, or Invaluable bidder is due within 2 days of the auction.
11. Any special payment arrangements must be pre-approved by an authorized representative of Art Lovers Anonymous Auctions. Such arrangements must be requested in writing, and authorization must be obtained prior to bidding.
12. Accounts that are unpaid after 5 days of the sale date will be subject to a 2% monthly finance charge; administrative fees may also apply.
13. The buyer is liable for all fees/costs associated with the collection of balances due, including attorney's fees.
14. Unless prior arrangements have been made with us, any merchandise not removed within 2 weeks of the sale date will be subject to a storage fee. Any merchandise not removed or consigned within 60 days of the sale date will be considered abandoned.
15. REFUNDS will be given at the sole discretion of the auctioneer and will only be considered on lots that are determined not to be authentic or have major damage or significant restorations/repairs that were not outlined in the condition report. All requests for refunds must be submitted in writing (email is acceptable, send to
[email protected]) with substantiating photographs. Additionally:
Refund requests in regard to authenticity must also include at least one supporting written and signed statement from an authority recognized by the auctioneer.
All other refund requests, including any substantiating documentation, must be received in our office within 25 days of the auction date. (Absolutely no refunds will be accepted after this deadline.)
Lots cataloged without circa dates are not guaranteed as to age.

Once a refund is approved AND the complete lot is returned to the satisfaction of the auctioneer (in the same condition in which the buyer received it), a full refund of the hammer price and buyer's premium will be issued. We do not refund shipping cost nor do we offer partial refunds.
16. Additional conditions of sale may apply, as noted on our website and/or as announced by the auctioneer prior to the auction.
These terms and conditions, as well as the respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of Florida. The purchaser shall be deemed to have consented to the jurisdiction of the state courts of, and the federal courts sitting in, the State of Florida.
Placing a bid is a guarantee that you will pay for the item and if your bid is not withdrawn before a sale then you will be subject to follow through with payment. All Sales are final. When and if there is an issue, we will review the situation and decide whether or not you are eligible for a refund. All items are subject to 25% buyers premium and we do not offer pick up options, if you are local, we can schedule a hand delivery for an oversize items (45 x 40 inches) or an item over 1000 dollars, otherwise all items will be sent using Fedex or usps. We reserve to right to cancel any item after the close of a sale although these cases are extremely rare. All items will be packaged with the utmost care and we will cover insurance up to 1000 dollars that will be included in your shipping fee. We do our own in house shipping to anywhere in the US and international other then companies banned from fedex international shipping. All items are sold as is and we do our best to work with various reputable consignors and describe items as best as we can, while we dont offer Certificates or guarantees we do ask that you contact us with as many questions and request additional pictures before an auction so you can make the best possible determination before placing your bid. We always work with our customers when possible, so we ask that you please message us for clarification on any issues before filing a complaint or dispute.
