CONDITIONS OF BUSINESS
These Conditions of Business are an extract and translation of key information from the::

The Auction House guarantees the authenticity and conformity of the catalogue description with the actual physical condition of the item.

All statements made during the sale supplement the catalogue.
The Auction House has sole discretion to withdraw any lot from the sale without any consequences.
The Auction House reserves the right to deny the participation in the auction to any person.
The Auction House does not take any responsibility for any latent physical and legal faults.
All claims, which may arise, will be settled according to the Polish law regulations.
The Auction House is not responsible for any failure of online bidding, resulting from internet connection failure or software malfunction.

Conditions of buying
All items put up for auction are on view in Auction House Gallery and directly before the sale in an auction room. The Auction House suggests to avail yourself of the opportunity to examine the items, their catalogue descriptions and actual actual physical condition.

Clients previously unregistered with the Auction House have to be authorized by submitting copy of valid passport/identification document. According to the Anti Money Laundering act we may require additional information as residence address, nationality, occupation or references from bank or well known auction houses.

The auction is conducted by an authorised person called the auctioneer. The auctioneer determines the bidding's progress, settles all disputes and names the Buyer of the item.
The highest bidder is the Buyer.
Total amount for purchased items should be paid within 7 days since the date of the auction.
The sale becomes effective and binding only after all money due to the purchase has been deposited on Auction House account.

If the buyer does not pay in time, the Auction House may nullify the purchase contract, charge interests and compensation, as well as to proceed to find another buyer either on subsequent auction or in gallery. In such case the Auction House reserves the right to setttle the contract at court and to charge all expenses to the buyer.

Persons previously unregistered with the Auction House wishing to make considerable purchases are kindly asked to contact the Auction House before the sale to discuss the terms of payment.

Payment

Payment
According to our terms you are obliged to pay for your lots within 7 days. You can pay us by bank transfer (our bank details are here) or credit card (up to 20 000 USD). We do not accept checks, nor American Express cards.
We accept payments in Euro, US dollars but the amount must be calculated in order to equal the value of the invoice in PLN. We use standard conversion rate of the day. We consider payment done , when our account is credited - the copies of wire transfer, electronical confirmations may not be accepted.

Buyer's Premium

The 25% commission (premium) shall be added to the hammer price.
This includes also the VAT tax.

IN SOME CASES FOLLOWING FEES WILL BE ADDED TO PREMIUM:


1. Artist resale fee (5/3 %) - according to the regulations in EU, artists or their legal inheritors are entitled to artist resale fee - it is 5% on hammer up to 50 000 euro and 3% for the part of above 50 000 euro. The fee is calculated on hammer price.
This fee applies to living artists and legally appointed inheritors for 70 years after the death of the artist.
You will see a mark at lot's description at items that are bound to this fee.

2. Import Vat (8%) - lots that were imported from outside European Union are subject to additional fee of 8% (calculated on hammer price) . However this fee is deductible if the lot will be exported outside of EU. Example - if a client buys such an item and will have it shipped to USA (or Israel, or Switzerland etc) then this fee will be refunded.

Export licence obligations

Lots younger than 50 years OR valued less than 40 000 PLN (ca 10 000 USD) can be exported with no fees.
However , in accordance to Polish law regulations all lots that do not comply with the a/m conditions are bound to export licence in case of shipping abroad.
The licence is free of charge but the administrative delays may take up to few months, and the licence may be refused if a lot has a great value for Polish culture.
