TERMS AND CONDITIONS OF SALE
PLEASE NOTE THAT ALL WINNING BIDDERS AGREE TO THE FOLLOWING:
FULL PAYMENT BY INVALUABLE AUTOPAY OR BANK WIRE MUST BE RECEIVED BEFORE PICK UP
NO ADDITIONAL PRODUCT INFORMATION IS AVAILABLE.
IF ITEMS ARE NOT PICKED UP WITH 15 DAYS, ALL MONIES PAID ARE FORFEITED AND ITEMS ARE DEEMED ABANDONED. THERE WILL BE NO REFUNDS.
The terms and conditions of auction purchases ("Sale") are outlined here and are applicable to any and all sales made through Robert Slawinski Auctioneers, Inc. ("Auctioneer"). This includes sales completed in person, online, or absentee/phone bid. All sales will be completed at the discretion of the Auctioneer and the Auctioneer reserves the right to cancel any sales and deny future transactions with any customer ("Buyer") if these terms are not met. All merchandise brought to sale by Auctioneer has been consigned by independent owners ("Consignor).
Bidder acknowledges all terms and conditions of sale by Robert Slawinski Auctioneers. It is the responsibility for bidders to inspect the images or in person. All lots have sufficient detail images. There are no other information other than provided in the description. All items SOLD AS IS, WHERE IS. If items are not picked up or shipped by buyer within 15 days, the items will be deemed abandoned and the buyer agrees to forfeit all monies proceeds. In the event the item is returned as no fault to auction house, the buyer agrees to pay a 30% return fee.
Buyer is responsible for pick up or arrange of shipment of their winning lots with 3rd party shipper.
This AUCTION USES AUTOPAY by INVALUABLE. If you have winning bids, you agree to have your credit card on file charged by INVALUABLE for all your winning items shortly and automatically after the conclusion of the auction.
BEFORE THE SALE
All buyers are strongly advised to inspect all items before auction as all items are sold AS IS, WHERE IS. Although Auctioneer makes every effort to express accurate descriptions and commentary given to Buyers online, in Auctioneer's catalog, marketing material or verbal interactions, Auctioneer makes no guarantee or warranty of any kind with respect to the physical condition, size, quality, rarity, medium and materials, age, authenticity, provenance, culture, source, or historic significance of any goods. Any condition statement is given as a courtesy, and is only an opinion, not a statement of fact. Robert Slawinski Auctioneers, Inc. shall have no responsibility for any error or omission. The absence of a condition statement does not imply the lot is in perfect condition, or completely free from wear and tear, imperfections, or the effects of aging. Employees, consignors, or any other representative of Robert Slawinski Auctioneers, Inc. are not authorized to provide written or verbal guarantees. Buyers must depend on their own review of the merchandise.
All merchandise is sold AS IS, WHERE IS, regardless of condition, or additional review of merchandise gained after the sale. ALL SALES ARE FINAL.
We reserve the right to require deposits for all lots or on selected lots or if you don't have bidding history or have open disputes with any auction house.
If a deposit is required, the amount of deposit required have to be by bank wire transfer into the bank account information below by the Friday before auction day.
A receipt will be emailed to you once the bank wire is received by the due date.

Online Bids are accepted at the Auctioneer's discretion. Only those who submit for registration (48) hours prior to auction date will be guaranteed consideration for registration. All those submitting less than 48 hours before the start of an auction are only approved based on the discretion of the Auctioneer. Bidder Approval Forms required to be completed for online bidding consideration can be found on Auctioneer's website: www.slawinski.com. The Buyer is responsible for all bids made on their online bidding account. All bids received via online bidding platforms will be final. The auction house does not have access to your bidding accounts. Please contact support@invaluable for bidding assistance.
Auctioneer and its employees shall not be held liable for any damages or injury to person or property sustained as a result from handling merchandise including, but not limited to lifting, moving, loading, or packaging of merchandise before or clerking error after the sale. Buyer is responsible for the packing, loading and removal of all merchandise.
DURING THE SALE
The auctioneer is acting as agent only to the sale of merchandise and is not responsible for any actions of Consignors. This auction is being conducted in pursuant to section 2328 of the commercial code, 535 of the penalty code and all provisions of the auction license act. In accordance to the California state law, all items are subject to a confidential reserve unless otherwise stated. Auctioneer reserves the right to withdraw any lots from the sale and to deny Buyer's participation during a sale for any reason. Auctioneer reserves the right to reverse any sale due to any reason including clerking errors. Auctioneer shall not be held responsible for clerking errors due to online platforms or staff clerking errors. Auctioneer reserves the right to reject any bid or eject any person from the Auctioneer's premises and auctions.
Upon the occurrence of a dispute during or after a sale, Auctioneer's decision will be FINAL.
All information regarding merchandise is subject to clarification, changes or disclaimer at the time the item is being auctioned and will be sold based on Auctioneer's verbal or written information at time of the Sale.
All bids via phone, fax, email, or in person are final and binding regardless of Buyer's input errors. Auctioneer also does not accept liability for technology, website or internet failure, or unforeseen circumstances that may influence the execution of bids.
PAYMENT
Full payment includes hammer price, buyer's premium and all applicable taxes. All sales are final regardless of method of bidding or payment options. Auctioneer does NOT accept PayPal and does not take credit card information over the phone. No checks or credit cards accepted at the Sacramento Pick Up Site. Full payment must be received before pick up. Robert Slawinski Auctioneers uses the INVALUABLE Autopay and your credit card on file will be charged immediately after the auction has ended. Please submit payments by using the PAY NOW button on the INVALUABLE invoice. A 3% credit card processing fee applies to all credit card transactions by INVALUABLE. Auctioneer also accepts bank wires. Auctioneer may, at their discretion, hold merchandise until wired funds clear bank account. If payment is not received within (5) business days of the sale, Auctioneer reserves the right to cancel sale and resell merchandise at a public or private sale. Failure to provide payment will result in revoking the Buyer's right to participate in future sales with Auctioneer.
Payment options and terms for each type of auction participation is outlined below.
Online Bidding at INVALUABLE: All purchases are subject to a 25% Buyers Premium. Your credit card on file will instantly and automatically be charged by INVALUABLE at the end of the sale when the invoice is sent out. If credit card was not successfully charged by INVALUABLE, full payment must be made within (3) business days of sale by bank wire. Payment terms are INVALUABLE payment system or bank wire transfer. All successful online Buyers will be emailed an invoice within immediately at the end of a sale from INVALUABLE with a PAY NOW button to submit payment. A 3% credit card processing fee from INVALUABLE applies. You can also submit payment by personal check or bank wire. If the Buyer does not receive notification within (24) hours Buyer remains responsible for all items purchased and retains the responsibility of providing payment. If Buyer fails to provide cleared funds within five business days of the sale, they will receive a negative feedback report associated with their online auction profile and will not be permitted to registration for future sales.
International Payment: Any Buyer submitting payment from outside the U.S. (regardless of method of bidding) must be either use the INVALUABLE PAY NOW button in the invoice or submit by bank wire transfer. A bank transfer is only considered complete after Auctioneer has received the FULL amount due according to the Buyer's invoice. While issuing a wire transfer, all fees, exchange rates and other administrative fees are the responsibility of the buyer and are in addition to the total amount due to Auctioneer. All sales and money transfers are conducted in USD currency. No foreign checks will be accepted. Auctioneer does NOT accept PayPal. Auctioneer may, at their discretion, hold merchandise until payment has been cleared.
Taxes: State and local taxes (9.25%) will be applied to all merchandise collected in person at Auctioneer's located in Sacramento, California. Buyer will be exempt from taxes if Buyer presents to Auctioneer a current resale license number or if merchandise is shipped directly out of California using a common carrier.
STORAGE
Immediate removal of purchased merchandise is requested when payment is received, and shall be done at the expense, liability and risk of the Buyer. All arrangements for removal will be at the convenience of Auctioneer. For paid items, failure to pick up, ship or remove merchandise immediately after completion of payment within the (5) business days following sale completion will be subject to storage fees of ($10.00) per day per item and revokes the right for returns. Auctioneer will apply any deposit to loss, damages, and expense incurred in the resale of merchandise not paid for in full or removed in the time specified and shall retain any balance as liquidated damages.
SHIPPING
Buyers are fully responsible for shipment of merchandise including all packing, and customs fees. Auctioneer can provide a list of recommended independent shippers upon request, but does not accept responsibility of any agreements reached between Buyer and shippers, or any resulting loss, damage or delay resulting in the use of the shipper.

Buyer gives up his or her right to return items for any reason if after payment is made and the item is not retrieved within 15 days.
SALE of SPECIFIC and/or RESTRICTED GOODS
SALE OF AUTOMOBILES:
TRAILER PICK UP ONLY. BUYERS MUST SIGN RELEASE OF LIABILITY FORMS AND DMV FORMS AT TIME OF PICK UP.
FORM OF PAYMENT ONLY: WIRE TRANSFERS. WE DO NOT ACCEPT CREDIT CARDS ON SITE OR PERSONAL CHECKS FOR AUTOMOBILE SALES. NO PICK UPS ALLOWED BEFORE FUNDS HAVE BEEN SUCCESSFULLY RECEIVED BY AUCTIONEER.
All Vehicles sold at Robert Slawinski Auctioneers are sold "As-Is, Where-Is, With All Faults", With No Warranty, Expressed or Implied, Including But Not Limited To, Any Warranty of Fitness or Merchantability. Any and all information provided by Robert Slawinski Auctioneers in writing, verbally, or in image form pertaining to any auction item, including (when available) the Vehicle Identification Number and License Plate Number, is solely for the Buyer's convenience. License plates may be removed from the Vehicle at any time and are not included in the purchase; images (if available) are provided solely for Buyer's convenience.
Robert Slawinski Auctioneers makes NO WARRANTY as to Vehicle conditions, Title status, or as to the accuracy of the information; all are statements of opinion, including physical description, and are NOT to be relied upon as statements or representations of fact. No physical or mechanical inspections have been performed by Robert Slawinski Auctioneers. Vehicles are NOT test driven for function or performance; Robert Slawinski Auctioneers does not verify driveability or attest to the condition, or soundness of the Vehicle. Robert Slawinski Auctioneers does not inspect or attest to the completeness of any Vehicle; components, options, or equipment may have been modified, or removed (E.G., Catalytic Converter, ECM, Spare Tire, Etc.) and their presence or condition are not guaranteed. No guarantee as to the condition of the Powertrain, Emission System, Drivetrain, Suspension, Electrical Systems, or any other components are expressed or implied. Once a Vehicle is removed from the facility, the Buyer accepts Vehicle AS-IS, there are No Returns, Refunds, or Recourse, under any circumstances. All Sales Are Final!
Images or videos provided by Robert Slawinski Auctioneers are NOT intended to meticulously document and display every condition or aspect of the Vehicle; damages might not be plainly visible without a detailed examination of the Vehicle. Buyer should exercise extreme caution and shall not rely on Vehicle information, images, or videos in deciding whether or how much to bid on a Vehicle. It is the buyer's sole responsibility to investigate and confirm all Vehicle information prior to placing any bid.
Material handling equipment is used to move Vehicles at the facilities, as such; Robert Slawinski Auctioneers will not recognize any claim of damage resulting from the general handling or pullout of a Vehicle.
Writing, Stickers, or Decals visible to Buyers on Vehicle are for Internal Use Only. This information is NOT for Buyer use or reference. Buyer should exercise extreme caution and shall not rely on this information in determining the Vehicle condition or deciding whether or how much to bid on a Vehicle.
Auction Terms and Conditions and/or Auction Fees displayed on our website, printed on auction lists, announced during the auction, or displayed at our facility become part of this agreement by reference. Buyer understands they have read and agree to the "Auction Terms and Conditions" and "Auction Fees" as set forth by CCAA.
Vehicle Condition: Vehicles are NOT test driven on open roads or operate over 5-mph while at the facility. Vehicle may have modified, or missing components (including catalytic converters) and their presence or condition are not guaranteed. General conditions are provided in the online Vehicle profile and is solely for the Buyer's convenience; these conditions are not complete, and Robert Slawinski Auctioneers is not responsible for the accuracy, or incomplete descriptions. It is strongly recommended that Buyer obtain a Carfax or similar report prior to placing any bid.
No Guarantee of Authenticity for Jade: Due to the fact that jade can be bleached and dyed among other techniques, Robert Slawinski Auctioneers CANNOT GUARANTEE the authenticity of the COLOR, AGE, or QUALITY of any jade items sold. All Jade will be sold AS-IS, without any warranties. All sales are final in Jade purchases, NO RETURNS will be accepted. Judgment of such qualities is the sole discretion of the Buyer.
No Guarantee of Authenticity for Chinese Paintings: Robert Slawinski Auctioneers CANNOT GUARANTEE any aspect of the Chinese Paintings sold including authenticity, origin, age, quality, medium or provenance. However, a return may be permitted within (7) days of Buyer receiving the purchased merchandise (as recorded by their shipping tracking number provided by shipping company) if the Buyer can provide sufficient evidence to Robert Slawinski Auctioneers that the item is not authentic. If Robert Slawinski Auctioneers is satisfied with the information presented by the Buyer, and the item remains in the same condition as when it was sold, the merchandise must be received back into the possession of the Auctioneer within (10) days of Buyer's request for a return for a full refund of the purchase price, shipping costs excluded. All refund proceedings must be completed within (30) days of the auction date.
Endangered Species and CITES Permits: Robert Slawinski Auctioneers adheres to the California and Federal laws pertaining to the sale of items containing endangered or protected species, and WILL NOT ACCEPT LIABILITY of items that may include any material such as ivory, rhinoceros horn, tortoise shell, coral, endangered woods, and whalebone. In the event an item is found to contain any amount of these products, it is the SOLE RESPONSIBILITY OF THE BUYER to perform their due diligence and acknowledge any laws and regulations that apply to purchasing, importation and exportation laws.
WINE
Due to California state licensing regulations, all wine must be shipped to the buyer's address. No In-person pickups are permitted.

Artist or Maker: This indicates that the work is, in our best judgment by the named artist or maker.
Attributed to (Artist or Maker): This indicates that the work is, in our best judgment, probably the work of the name artist or maker, but it is less certain than the preceding category. Bearing the Signature, (Artist or Maker): Although the work is apparently signed by the named artist or maker, no claim to authenticity is implied Style of (Artist or Maker); Manner of (Artist or Maker); or After (Artist or Maker): all of these terms indicate that the work resembles the named artist or maker, may bear their signature, but in our best judgment is not by the named artist.

If the lot is not qualified for in house shipping, then buyers are responsible for their own pick ups and shipping or third party shipping. Please have your shipper all ready to pick up your lot within 5 days at the location. Buyers are responsible for arrangement and cost of shipment of merchandise including all packing, and customs fees. Auctioneer does not accept responsibilities of any agreements reached between Buyer and shippers, or any resulting loss, damage or delay resulting in the use of the shipper. Auctioneer reserves the right to deny their service of shipping for any reason. Any and all liability of the Auctioneer is relinquished after (5) days past the sale date regardless of time item was paid for in full or how and/or when it was shipped or if merchandise has yet been received by Buyer. Buyer also acknowledges that all items must be picked up or shipped within 5 days of auction. If items are not picked up or shipped by buyer within 5 days, the items will be deemed abandoned and the buyer agrees to forfeit all monies proceeds paid. In the event the items are returned as no fault to auction house, the buyer agrees to pay a 30% return fee.
Storage: Storage at a warehouse in Felton, California is available upon request by the buyer. Buyer will be responsible for delivery fee to the storage facility and storage will be $10.00 per day. Delivery Fees and storage fees must be paid in advance.
