1. Kunstauktionshaus Georg Rehm Organisation für Auktionen GmbH (hereinafter referred to as the "Auctioneer") organizes the auction as an intermediary (commercial broker) in the name and for the account of the Consignors. It is guaranteed that the Consignors can be named. The Auctioneer shall assert all rights of the Consignor arising from the sale in the Consignor's name on the basis of corresponding authorization. The auction will be conducted by the sworn and publicly appointed auctioneer Christoph Neureuther. The auction is voluntary. The conditions apply accordingly to the private sale.
2. The auctioneer reserves the right to combine or separate lots in the catalog, to offer them out of sequence, to withdraw them or to auction them subject to reservation.
3. All items to be auctioned may be inspected and examined prior to the auction. The items are used and will be auctioned in the condition in which they are at the time of the sale. Catalog descriptions are for information purposes only and are not part of the contractually agreed condition of the items and, in particular, are not guarantees in the legal sense. The state of preservation is not consistently mentioned in the catalog, so that missing information also does not constitute a quality agreement. The same applies to verbal or written information of any kind as well as the description of the items when they are called up.
4. Warranty claims must be asserted directly with the consignor. The Auctioneer's claims shall remain unaffected by this. The Auctioneer undertakes to forward to the consignor of the defective item without delay any justified complaints of defects submitted by the successful bidder within the statutory warranty period. The auctioneer assumes no liability for defects insofar as he has complied with the duties of care incumbent upon him. In the event of a slightly negligent breach of material contractual obligations, the Auctioneer shall be liable up to the amount of the limit or estimated price.
5. Claims for damages against the auctioneer can only be asserted by the bidder
a) in the event of an intentional or grossly negligent breach of duty by the Auctioneer or a legal representative or vicarious agent of the Auctioneer;
b) in the event of damage resulting from injury to life, body or health due to a negligent breach of duty by the Auctioneer or a legal representative or vicarious agent of the Auctioneer;
c) in the event of culpable breach of essential contractual obligations, insofar as the achievement of the purpose of the contract is jeopardized, with regard to the foreseeable damage typical of the contract. Otherwise, liability for damages is excluded.
6. The highest bid is accepted after three calls; usually the bid is increased by 10%. Written orders must be received by the close of the viewing period. In the case of identical written bids, the one received first shall be considered. The auctioneer may withdraw the sale and offer the item again if there are disputes or other doubts about the sale or if a bid submitted in good time has been overlooked.
7. In the case of conditional sales, the bidder is bound to his bid for four weeks; in this case, the sale is non-binding for the auctioneer. Any claims of the bidder against the auctioneer are excluded if the conditional sale is not carried out. If a condition sale is not approved by the consignor or if someone bids the limit, the item can be sold to the higher bidder without further inquiry.
8. With the acceptance of the winning bid, the risk of loss, damage or confusion etc., which we are not responsible for, shall pass to the purchaser, the purchaser also bears the burdens. Ownership shall not pass to the purchaser until the auctioneer has received the full payment. The shipment of auctioned items shall be at the expense and risk of the successful bidder.
9. Acceptance of the bid obliges the bidder to take delivery. In the case of purchase for a third party, the bidder shall be jointly and severally liable with the third party. The items are to be accepted immediately after the auction.
10. The purchase price is made up of the amount on which the sale is made (hammer price), a premium of 22% of the hammer price and the respective statutory VAT, which is only charged on the premium. For live bidders, the premium is increased by 3% or 5% depending on the provider. The invoice amount is due with the hammer sale and payable in cash. If the auctioneer has agreed to non-cash payment, all costs, taxes and payment fees incurred as a result (including bank charges deducted from the auctioneer) shall be borne by the buyer. If the purchaser is in default of payment, interest of 8% above the base interest rate shall be charged as default damages, without prejudice to further claims, unless the successful bidder can prove that the damages are lower. In addition, the auctioneer may choose to demand fulfillment or, after setting a deadline, damages for non-fulfillment; the damages may also be calculated in such a way that the item is auctioned again in a further auction and the defaulting buyer has to pay for the lower proceeds compared to the previous auction and the special costs of the repeated auction, including the auctioneer's fees.
11. Objects from the National Socialist era are only offered and sold by us in accordance with §§ 86 / 86a StGB and may only be used for the purposes described in § 86 para. 3 StGB, i.e. for civic education, art or science, research or teaching, reporting on current events and history or for similar purposes. This also applies to sales to third parties. The Auctioneer reserves the right to prohibit the sale to persons who cannot provide a guarantee for the use specified in § 86 Para. 3 StGB.
12. The place of performance for the transfer of ownership of the auctioned goods shall be the Auctioneer's business premises in Augsburg. If the buyer is a merchant or has no general place of jurisdiction in Germany or another EU member state, the exclusive place of jurisdiction for all disputes shall be Augsburg. German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
Shipping Instructions

Dear customers,
please collect your purchased items from us within two weeks after the end of the auction yourself or via a forwarding agent. In individual cases, we will ship items that need to be transported safely within the EU for you with DHL or Intex. The costs for packaging, insurance and shipping are borne by the buyer, these are to be clarified individually, but amount to at least 20 € per package within Germany. In this case, packaging and shipping will only take place after receipt of payment of the separate shipping invoice and may take up to 2 weeks after receipt of payment due to the large number of shipments after the auction.
