CONDITIONS OF SALE
GENERAL TERMS AND CONDITIONS OF SALE
BUYER'S COMMISSION
The buyer shall pay ARTESIA, in addition to the hammer price, a buyer's premium of 25% VAT included.
TERMS AND INFORMATION FOR BUYERS
The sale is subject to French law and these general terms and conditions. It is important to read the following conditions carefully. Information is provided on how to buy at auction. Our team is available to answer your questions and provide assistance.
VAT
VAT will only be refunded on the buyer's premium to non-EU residents, provided they submit a written request to the accounting department within three months of the sale, along with a copy of the third copy of the export customs document (DAU), which must list ARTESIA as the consignor and the buyer as the consignee. The export must be completed within the legally required timeframe.
CITES REGULATIONS
The documents provided by ARTESIA for CITES-listed items under annexes A, B, or C of Regulation CE338/97 are valid only within the EU. Export to a non-EU country requires an export or re-export permit from the CITES management authority in the buyer's country of residence. We advise you to contact the CITES authority in the destination country to confirm whether the item can be imported. Some countries may refuse to issue permits based on their own regulations. These procedures are the buyer's responsibility and at their expense.
BEFORE THE SALE
Indicative Nature of Estimates
Estimates are provided as a guideline. Any bid within the low and high estimate range has a reasonable chance of success. However, we recommend consulting us before the sale, as estimates may be subject to change. The estimates listed in the sale catalogue do not include the buyer's premium.
Condition of Lots
We are available to provide detailed condition reports for all lots. All items are sold "as is" at the time of the sale, with their imperfections or defects. The dimensions, colors, and weight of objects are provided for reference only and are not contractually binding. No claims will be accepted regarding minor restoration or small defects.
It is the responsibility of each potential bidder to examine each lot before the sale and rely on their own judgment regarding the characteristics and possible restorations or repairs. No claims will be accepted once the hammer has fallen.
Pre-Sale Exhibition
The pre-sale exhibition is open to all. ARTESIA strives to present the objects in the safest possible manner. Any handling not supervised by ARTESIA is at your own risk.
BIDDING
Bidding Process
Bids can be placed in person, by phone, or through a written absentee bid. Bids are conducted in euros and announced by the auctioneer exclusive of buyer's premium and VAT. Bidders are presumed to be aware of the applicable fees and taxes.
The highest bidder and last offer will win the lot. In case of a dispute at the time of the sale, where two or more bidders simultaneously place an identical bid (whether verbally, by sign, or online), and claim the item at the same time after the word "sold" has been pronounced, the item will immediately be re-offered for sale at the proposed price, with the public invited to bid again.
Absentee Bids
If you are unable to attend the sale, we will be happy to execute written absentee bids on your behalf. You must provide a copy of a valid identity document and a bank statement. This service is free and confidential.
Lots are purchased at the lowest possible price, considering the reserve price and other bids. If identical absentee bids are received, the first one submitted will be given priority.
Always specify a maximum bid limit. Unlimited or "buy at any price" orders will not be accepted. The auctioneer is not liable for failure to execute an absentee bid, particularly in the case of a late order.
Written absentee bids can be sent by email to contact@artesia-encheres.com or submitted to staff on-site. Please ensure that your absentee bids are received at least 24 hours before the sale.
Remote Bidding
If you cannot attend the auction in person, you can bid directly:
By telephone - Due to the limited number of telephone lines, arrangements must be made at least 24 hours before the sale to secure this service, subject to availability.
Online - Through our partner platform "Drouot Digital." An additional fee of 1.5% excl. VAT applies for this service.
THE SALE
Conditions of Sale
As indicated above, the auction is governed by the terms listed in this catalogue. Anyone intending to bid must read these terms carefully. They may be amended by display in the auction room or by announcements made by the auctioneer.
Access to Lots During the Sale
For security reasons, access to the lots is prohibited during the sale.
Conduct of the Sale
The order of the catalogue will be followed during the sale. Bidding will start at a level determined by the auctioneer. The auctioneer reserves the right to place consecutive bids or to respond to other bids on behalf of the seller up to the reserve price.
