All property offered and sold through Fukuoka Yumekai Auction shall be offered and sold on the terms and conditions set forth below. By registering to bid and/or by bidding at auction, whether present in person or by agent, by absentee bid, telephone, internet or other means, the buyer agrees to be bound by these terms and conditions.
ALL SALES ARE FINAL. ALL PROPERTIES SOLD AS IS. NO RETURNS. NO EXCEPTIONS.
The standard buyer's premium is 21% of the hammer price. Any bids sent to us via Invaluable Auction websites attract an additional 5% charge on top, making a total of 26% of the hammer price. The extra 5% covers the service charges made by Invaluable Auctions.
1. BEFORE THE AUCTION
Though all descriptions, condition reports and other statements (including artist, period, materials, dimensions, or provenance and commentary) are believed to be correct, neither the auctioneer nor the consignor makes any warranties or representations of any kind with respect to merchandise. All dimensions and weights are approximate only. Images and colors might slightly differ from the actual item when printed or viewed onscreen.
Goods are sold 'as is' at the moment of the adjudication. The condition of lots can vary due to age, previous damage, restorations, or general signs of use. This implies that lots offered will rarely be in perfect condition. Buyer shall not rely on the auctioneer, employees, the catalog description, or advertisements in any part, and must rely only on his own inspection and opinions of all items. We offer a preview and high resolution photos for potential buyers to review and make their own conclusions about the piece. Additional information (and/or pictures) need to be requested at least 24 hours before the auction. If the conditions of a lot are not described in the catalogue, this does not mean that the item has no weakness or defects. Bidders must review the lots before the auction, and bear all responsibilities (including but not limit to legal liability and/or responsibility) of his/her bidding acts. No employee is authorized to make any warranties, expressed or implied, on behalf of Fukuoka Yumekai Auction.
Fukuoka Yumekai Auction is not responsible for the research and provenance of each item, and is not responsible for authenticity, genuineness of, estimated selling price of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse.
2. REGISTRATION TO BID
If you have not bid with Fukuoka Yumekai Auction before, you must register at least 24 hours before the auction to allow us enough time to process and approve your registration.
The following documents will be needed:
• For individuals: photo identification (ID card, passport or driving license) ; proof of current address (if the current address is not shown on the identity document), i.e. utility bill or bank statement.
• For businesses: Certificate of Incorporation or similar documents that show the name, address, and VAT number of the company
Depending on the items of your interest, you may be required to place financial references and/or require a deposit as a condition of allowing you to participate in our auction. Deposit paid can be charged against your invoice value, any eventual surplus will be refunded within 3 business days after the auction. Any losses or expenses from foreign currency conversion involved in the refund will be borne by you. In the event insufficient documentation is provided or any procedures including but not limited to anti-money-laundering checks are not meeting our expectations, we may refuse your registration to bid or cancel the contract for sale made between you and the seller.
The auctioneer will accept bids in the saleroom, by telephone or online. Bidding by telephone must be transmitted to the auction house no later than 24h before the auction. The success of telephone bidding cannot be guaranteed due to circumstances that are unforeseen. Buyers should be aware of the risk and accept the consequences should contact be unsuccessful at the time of Auction. Written Bids are to be sent to the auction house no later than 24h before the auction. In the event of identical written bids, the earliest received will take precedence. By online bidding through Invaluable, the bidder agrees to pay 5% internet surcharge fees in addition to the buyer's premium. Fukuoka Yumekai Auction accepts no responsibility for any errors, failure to execute bids or any other miscommunications regarding this process. It is the online bidder's responsibility to ensure the accuracy of the relevant information regarding bids, lot numbers and contact details.
3. DURING THE AUCTION
Fukuoka Yumekai Auction reserves the right to refuse any bid, withdraw any lot from sale, to place a reserve on any lot and to advance the bidding at the auctioneers discretion:
Absentee bids must follow auction increments and any bids that don't follow the steps will be rounded up to the nearest acceptable bid.
Subject to the auctioneer's discretion, the highest bidder accepted by the auctioneer will be the buyer and the striking of his hammer marks the acceptance of the highest bid and the conclusion of a contract for sale between the Seller and the Buyer. Risk and responsibility for the lot (including frames or glass where relevant) passes immediately to the Buyer.
4. AFTER THE AUCTION
In addition to the hammer price, the buyer agrees to pay to Fukuoka Yumekai Auction the buyer's premium. For in-house, telephone and written bids, buyer's premium is 21% of the hammer price. Any bids sent to us via Invaluable Auction websites attract an additional 5% charge on top, making a total of 26% of the hammer price. The extra 5% covers the service charges made by Invaluable Auctions.
It is the bidder's responsibility to check with Fukuoka Yumekai Auction after the auction if they were successful. If you are the highest bidder on an item, you will receive an invoice by email within 3 business days with instructions regarding payment and shipment of your item. Please make sure to check your spam folder if you suspect to have won a lot during the sale but have not received an invoice yet.
The buyer is due to settle the payment within 7 business days after receiving the invoice. The payment should be made by Wire Transfer.
The buyer is responsible for any bank fees and charges applicable for the transfer of funds into Fukuoka Yumekai Auction's account.
If a buyer fails to make the full payment by the due date, Fukuoka Yumekai Auction will be entitled to take one or more of the following steps:
a. Cancel the sale of the lot. In this case, we may decide the resell the lot. The non-paying bidder will still be held responsible for any negative difference in the realised price or any other financial damages caused. He/she has no right to claim a possible positive difference on the realised price.
b. hold you legally responsible and may begin legal proceedings to recover all losses caused
c. take the owed amount from other sources that Fukuoka Yumekai Auction may owe you (deposits, settlements, etc.)
d. reveal your identity and contact details to the seller
e. reject all future participation and bids made by you or on behalf of you
f. take any other actions we see appropriate
By placing a bid you are entering a legal and binding contract. Upon placing a bid, you are promising to pay for your purchases in a timely manner according to terms of this agreement. Non-paying bidders will be added to the No Bid list. For each unpaid item, 30% of its hammer price will be charged as the non-payment fee which will be added to your bill for Legal & Processing fees. We will turn it over to our collection agency and will prosecute to the full extent of the law. Please do not bid if you do not intend to pay.
The buyer will not acquire title for the lot until Fukuoka Yumekai Auction receives full payment in cleared funds, and no goods under any circumstances will be released without confirmation of cleared funds received. This applies even if the buyer wishes to send items interstate or overseas.
The Buyer shall collect purchased lots within 30 days from the auction day unless otherwise agreed in writing between Fukuoka Yumekai Auction and the Buyer. After this period, all uncollected goods will be put in paid storage at the cost of the buyer. Once items have been placed in storage, a storage fee will be charged. Unless agreed upon otherwise in writing, if the item(s) have not been collected 6 months after the auction, we may decide to sell the items and pay you the proceeds after subtracting all owed storage fees.
Please note that lots include components in specimens of animals and plants included under CITES, if exported, will require a CITES permit to leave Japan.
Fukuoka Yumekai Auction will be able to suggest local, national and international carriers and takes no responsibility whatsoever for the actions of any recommended third party carrier. Fukuoka Yumekai Auction can pack and handle goods purchased at the auction by agreement, however will take no responsibility for damage, a charge may be made for this service. All packing, shipping, insurance, postage & associated charges will be borne by the purchaser.
