CONDITIONS OF SALE

1) WRITTEN MANDATE (i.e. CONSIGMENT AGREEMENT): any item is offered for sale in Italy
by Itineris S.r.l., acting as exclusive agent in their own name and on behalf of each seller after entering into a written consignment agreement, pursuant to art. 1704 IT Cod.Civ.. Any effect of the sale will affect the seller, and Itineris S.r.l. it not liable by the buyer or any third parties in general other than for anytthing deriving from its role as agent.
2) MODIFICATIONS: these "Conditions of Sale" may be modified by a notice posted in the auction room or by an announcement made by the auctioneer before the auction start. Potential buyers are requested to consult the website www.itinerisaste.com to view the most updated catalogue of the lots present in the auction.
3) ESTIMATES: the estimates indicated in the catalogue are expressed in euros, constitute a mere indication and may be modified at any time and are unsuitable to generate any type of forecast on the price of the award.
4) DESCRIPTION OF THE LOTS - CONDITION REPORTS: any representation, written, oral or digital, including those published in the catalogue or in any report, guide, brochure or estimate, also related to the characteristics or quality of the goods, including the price or value, are the result of subjective evaluations and reflect opinions, and may be modified before the lot is offered for sale, including the period during which the lot is exposed to the public. Itineris S.r.l. can not be held responsible for errors or omissions relating to such descriptions, or in the event of counterfeiting, as no implicit or explicit guarantee is given with regard to the lots in auction. Furthermore, the images of the items presented in the catalogues or other illustrative material are used exclusively to identify the lot and can not be considered precise representations of the state of conservation of the goods placed at auction. In addition to the descriptions contained in the catalogue, on request Itineris provides condition reports on the status of each lot. The statements in the condition reports on the conservation status of the lots represent a mere subjective opinion not deriving from specific technical-professional knowledge of conservation or restoration and therefore does not constitute, for any reason, an element of declaration or guarantee that replaces the direct examination of the interested parties. The estimated weights of the gemstones, when not referred to a gemological certificate, are to be considered purely indicative. All watches are described as they appeared at the time of catalogueuing. As items of mechanical or electronic nature, they can show wear and defects, damage and consequent repairs and restorations and / or replacements of various non-original parts, including straps and buckles. For this reason Itineris
S.r.l. can not provide guarantees on the operating status or impermeability, or on the replacement of parts or on the restorations that have occurred, and the purchaser is responsible to verify personally, or with the advice of a trusted technician, the status of the lot of interest. For quartz watches, the operating status is indicated only when the battery is present and functioning. Buyers are informed that boxes, certificates and any accessories are not provided in the absence of specific indication in the catalogue.
5) EXHIBITION: the auction may be preceded by an exhibition of the lots, during which the Itineris experts will be available for any clarification; the exhibition aims to let examine the authenticity, attribution, conservation status, provenance, type and quality of the goods and clarify any errors or inaccuracies in which the catalogue was compiled. The person interested in buying a lot commits himself, before participating in the auction, to examine the property in depth, possibly also with the advice of an expert or a restorer of his trust, to ascertain all the characteristics. The lots placed at auction are sold in the state in which they are at the time of exposure, with any related defect and imperfection, and the lack of explicit references in the catalogue does not imply that they are exempt. No complaints are allowed after the award; neither Itineris S.r.l., nor its directors and employees, collaborators and consultants will be held responsible for any errors or omissions.
6) ITINERIS LIABILITY: except for the case of fraud, Itineris Srl, its administrators and its employees, collaborators and consultants will not be responsible for any acts or omissions relating to the presentation or running of the auction or for any question relating to the purchase of lots or failure to purchase. In any other case, Itineris's possible liability towards the Awardee in relation to the purchase of a lot by the latter is limited to the hammer price and the purchase commission paid to Itineris by the winning bidder / buyer. 7) PARTICIPATION IN THE AUCTION: it is possible to participate in the auction personally in the auction room, or even with written offers, by phone or via the internet, sending Itineris the appropriate form at least six hours before the beginning of the auction session or through authorized external providers. Itineris S.r.l. is not liable for inadvertently not executed offers, for errors related to the execution
of the same, for offers that are not readable, incorrect, or arrived late, and for any inconvenience or disruption concerning telephone lines or internet.
8) REGISTRATION TO THE AUCTION: whoever intends to compete in the auction room for any lot must register and get a numbered personal identification paddle that will be delivered by Itineris subject to providing personal data and identity documents. The paddle must be raised to compete for the auction. At the time of the award, who for any reason had not already done so, will have to inform Itineris about their personal data and show their identity document.
9) BILLING: each lot awarded in the auction room will be billed based on the general information and address given at the time of assignment of the numbered paddle.
10) REPRESENTATION AT AUCTION: it is possible to participate in the auction as a representative of a third person. On the occasion of the registration, the representative will have to present a proxy signed by the represented person with a copy of the identity document and of the tax code of the represented person and of the representative; in the event that the person represented is a company, the proxy must be signed by the legal representative or by an attorney with the power of signature, whose identity card and tax code must be attached to a document proving the
status. In any case, Itineris reserves the right to prevent participation in the auction to the representative when, at its sole discretion, it does not consider the power of representation to be demonstrated.
11) WRITTEN OFFERS: when the requested signed form is received by mail, email, fax or direct delivery to Itineris, written offers will be performed on behalf of the bidder at the lowest possible price, considering the reserve price of the lots and the other offers. Offer forms with unlimited amounts or no amount will not be considered valid. Itineris is not responsible for incorrectly completed forms. Before sending or submitting the form, the potential winner / purchaser must verify that the description of the lot indicated in the form corresponds to what he intends to purchase; in particular, the potential buyer is required to verify that there is a correspondence between the lot catalogue number and its description. In case of discrepancy between lot number and description, Itineris will make the offer on behalf of the potential buyer with exclusive reference to the lot number.
12) TELEPHONE BIDS: to participate in the auction via telephone offers is required registration with the appropriate form. Phone calls can be recorded.
13) INTERNET BIDS: to make offers via the Internet is required to register before the auction and accept the Conditions of Sale within the site www.itinerisaste.com or the websites of authorized providers. 14) AWARD: the lots are awarded to the highest bidder, natural or legal person, (i.e. winner or buyer) and for cash.
15) INCREASES OF OFFERS: the auctioneer leads the auction starting from the offer he considers adequate, with increases generally of 10% (ten percent) unless otherwise chosen. The auctioneer can make consecutive offers or in response to other offers in the interest of the seller until the reserve price is reached. In the case of offers of the same amount Itineris will only take into consideration the offer received first.
16) DISPUTE OF A LOT: in case of dispute over the awarding of a lot, at the unquestionable judgment of the auctioneer, the lot can be put back for sale during the auction and again awarded, or it can be withdrawn from the auction.
17) LOT MANAGEMENT the auctioneer, during the auction, has the right to combine and separate the lots and possibly change the sales order. The same may, at its sole discretion, withdraw the lots if the offers at auction do not reach the reserve price agreed between Itineris S.r.l. and seller. Itineris has the right to withdraw one or more lots from the auction at any time.
18) PARTICIPATION UNDER WARRANTY: Itineris S.r.l. reserves the right to subordinate the participation of a potential buyer to the presentation of bank references or to the deposit of an adequate guarantee to cover the entire price of the desired lots.
19) AUCTION FEES (i.e. BUYER'S PREMIUM): for each lot the successful bidder will correspond to Itineris S.r.l. the buyer's premium including VAT, equal to 26% (twentysix) on the hammer price. Any additional charge or tax related to the purchase will in any case be borne by the winner. The successful bidder will have to make the payment no later than 5 (five) days from the day following the award and before withdrawing the goods at his care, risk and expense. In the event of non-payment, in whole or in part, of the total amount due by the seller within that period, Itineris S.r.l. will have the right, at its discretion, to: a) return the asset to the seller, claiming the payment of 35% (thirtyfive) of the hammer price as a penalty by the non-purchaser; b) take legal action to enforce the compulsory purchase

obligation; c) sell the lot by private-sale or in subsequent auctions on behalf and at the expense of the seller, pursuant to art. 1515 of IT Cod.Civ:, save in any case the right to compensation for damages.
20) After the aforementioned term, Itineris S.r.l. will in any case be exonerated from any liability towards the successful bidder in relation to the eventual deterioration or decay of the items and will have the right to be paid for each lot of custody rights as well as any reimbursement of expenses for transportation to another warehouse, charging the buyer € 15 for each day of deposit.
21) The transfer of ownership of the lot will take place only at the time of the full payment by the buyer of the amount due. Full payment means that the wire transfer or the bank cheque is registered on Itineris' bank account, or the cashier's cheque or cash within the permitted limit is consigned to Itineris' offices, or authorization from the credit card issuer is obtained. Any risk for loss or damage to the awarded item will be transferred to the purchaser from the time of the award. The buyer can require the delivery of the purchased goods only after payment to Itineris
S.r.l. of the entire hammer price, auction fees and any other relevant cost or refund. If Itineris were unable to deliver the purchased goods, the buyer will have the right to get back purely what has already been paid, renouncing in advance and explicitly to claim any increase or damage. In the event that the buyer assigns a third party to withdraw the lot, the latter must be provided with a written proxy issued by the purchaser and a copy of the document of the delegator and of the delegate.
22) The lots delivered by sellers subject to VAT, indicated in the catalogue with the symbol (§) will be subject, in addition to the auction commission, to VAT of 22% on the hammer price; the lots in temporary importation from countries not belonging to the EU, reported in the catalogue with the symbol (#) will be subject, in addition to the auction fee, to 10% VAT on the hammer price (deposit for VAT) refundable only in case of proven non-EU re- exportation occurred within three months from the date of sale.
23) NOTIFIED GOODS: for goods subject to notification by the Italian State pursuant to Legislative Decree 22.01.2004 n°42 (so-called Cultural Heritage Code) and subsequent modifications, buyers are required to comply with all law provisions in force on the matter. The buyer, in case of exercise of the right of first refusal by the Italian State, cannot claim from Itineris S.r.l. or from the seller any refund or cancellation of the auction commissions, nor any material or moral damage of any kind.
24) EXPORT FROM ITALY / IMPORT IN OTHER COUNTRIES: the export from Italy of objects by buyers resident or not resident in Italy is regulated by the legislation on notified goods, by national and international custom laws, currency and tax laws in force . It is higly recommended to abroad buyers to check their own legislation regarding the requirements prescribed for importing into their country the goods purchased. Itineris does not guarantee either the export from Italy or the import to other countries unless explicitly stated, and does not assume any responsibility towards the buyer for any export restrictions and subsequent import of the lots awarded, nor for any licenses, certificates that the same must obtain based on Italian, international or local legislation, the release of which is the buyer's responsibility; the failure to release or delay in the release does not constitute cause for resolution or cancellation of the sale, nor for late payment by the buyer of the total amount due, not even when Itineris has acted as an actor in the presentation of the relative requests to the competent authorities. Obtaining a license and/or import certificate does not guarantee the obtaining of a license or certificate for export and vice versa. All lots consisting of, or containing parts of plants or animals (for example ivory, coral, turtle, alligator skin, whale bones etc), regardless of age and value may need a license or export certificate and/or licenses and/or import certificates in some countries. It is higly advisable to abroad buyers to check their own legislation regarding the requirements necessary for importing into their country any goods constituted or containing protected species.
25) Any dispute, to be decided first in the scientific forum between a consultant of Itineris S.r.l. and an expert with the same qualifications appointed by the client, must be asserted in writing by registered letter with return receipt within eight days from the award. Once this deadline has expired, Itineris S.r.l ceases all liability. A valid recognized claim leads to the simple repayment of the sum actually paid, in exchange for the return of the work, in the same conditions as it was at the date of sale, excluding any other claim. In case of complaints founded and accepted by Itineris S.r.l. in relation to items counterfeited to art, provided that the relative written communication arrives to the same within three months from the discovery of the defect and in any case no later than five years from the date of sale, and always that the buyer is able to return the free lot from claims or from any claims by third parties and the lot is in the same condition in which it was at the date of sale, Itineris Srl may, at its discretion, cancel the sale and disclose to the successful bidder requesting the name of the seller, giving prior notice to the latter. In partial exemption from the above, Itineris S.r.l. will not refund the purchaser if the description of the lot in the

catalogue conforms to the opinion generally accepted by scholars and experts at the date of sale or indicates the authenticity or attribution of the lot as controversial, if on the date of publication of the lot the counterfeiting could only be ascertained by carrying out analyzes that were difficult to do, or whose cost was unreasonable, or which could have damaged and in any case led to a decrease in the value of the lot. Itineris S.r.l. will not respond in any way in the event that after the sale changes occur in the subjects deputed and accredited to issue the expertises related to the art-works. An asset that has been restored or subject to modification is not a forgery.
26) ARTIST RESALE RIGHT: if due, the payment of the c.d. "artist resale right" (introduced by IT Legislative Decree no. 118 of 13 February 2006, implementing Directive 2001/84 / EC) will be paid by the seller.
27) These Conditions of Sale are governed by Italian law and are tacitly accepted by all participants in the auction. Any dispute that may arise in relation to the application, interpretation, and execution of these Conditions of Sale is exclusively jurisdiction of the Law Court of Milan.
28) PRIVACY: Pursuant to art. 13 IT D.Lgs. 196/2003 | GDPR UE2016/679, Itineris, in its role as data controller, informs that the data will be used, using paper and electronic means, to be able to give full and complete execution of the purchase and sale contracts stipulated by the same company, as well as for the pursuit of any other service compliant to Itineris Srl. The conferment of data is optional, but is strictly necessary for the execution of contracts. The registration to the auctions allows Itineris to send the catalogues of next auctions and other informative material related to auction and sales.

1) MANDATO: i lotti sono posti in vendita da Itineris S.r.l., che agisce quale mandataria in esclusiva in nome proprio e per conto di ciascun venditore ai sensi dell'art. 1704 cod. civ.. Gli effetti della vendita influiscono sul venditore, e Itineris S.r.l. non assume nei confronti dell'aggiudicatario o di terzi in genere altra responsabilità oltre quella ad essa derivante dalla propria qualità di mandataria.
2) MODIFICHE: le presenti "Condizioni di Vendita" possono essere modificate mediante un avviso affisso nella sala d'asta o tramite un annuncio fatto dal banditore prima dell'inizio dell'asta. I potenziali acquirenti sono pregati di consultare il sito www.itinerisaste.com per prendere visione della catalogazione più aggiornata dei lotti presenti in asta.
3) STIME: le stime indicate nel catalogo sono espresse in euro, costituiscono una mera indicazione e possono essere in ogni momento modificate e sono inidonee a generare qualunque tipo di previsione sul prezzo di aggiudicazione.
4) DESCRIZIONE DEI LOTTI - CONDITION REPORTS: ogni rappresentazione, scritta o orale, anche digitale, incluse quelle pubblicate su catalogo, relazione, guida, opuscolo o stima, relativa anche alle caratteristiche o qualità del bene, incluso il prezzo o il valore, sono frutto di valutazioni soggettive e riflettono opinioni, e potranno essere modificate prima che il lotto sia offerto in vendita, incluso il periodo durante il quale il lotto è esposto al pubblico. Itineris S.r.l. non potrà essere ritenuta responsabile di errori ed omissioni relative a tali descrizioni, né in ipotesi di contraffazione, in quanto non viene fornita alcuna garanzia implicita o esplicita relativamente ai lotti in asta. Inoltre, le illustrazioni degli oggetti presentati sui cataloghi o altro materiale illustrativo hanno esclusivamente la finalità di identificare il lotto e non possono essere considerate rappresentazioni precise dello stato di conservazione del bene posto in asta. Ad integrazione delle descrizioni contenute nel catalogo, Itineris rende disponibili, a richiesta, condition reports sullo stato di ciascun lotto. Quanto dichiarato nei condition reports sullo stato di conservazione dei lotti rappresenta un mero parere soggettivo non derivante da specifiche conoscenze tecnico-professionali di conservazione o restauro e pertanto non costituisce, ad alcun titolo, elemento di dichiarazione o garanzia che sostituisca l'esame diretto degli interessati. I pesi stimati delle pietre, laddove non sia presente un certificato gemmologico, sono da ritenersi puramente indicativi. Gli orologi sono descritti così come si presentavano al momento della catalogazione. In quanto oggetti d'uso di natura meccanica o elettronica, possono presentare usura e difetti, danni e conseguenti interventi di riparazione e restauro e/o sostituzioni di parti di varia natura anche non originali, compresi cinturini e fibbie. Per tale motivo Itineris S.r.l. non può fornire garanzie sullo stato di funzionamento o impermeabilità, né sulle sostituzioni di pezzi o sui restauri avvenuti e rimane responsabilità dell'acquirente verificare personalmente, o avvalendosi di un tecnico di fiducia, lo stato del lotto d'interesse. Per gli orologi al quarzo viene indicato lo stato di funzionamento solo ove sia presente e funzionante la batteria. Gli acquirenti sono informati che scatole, certificati e ogni accessorio non sono forniti in mancanza di specifica indicazione in catalogo.
5) ESPOSIZIONE: l'asta potrà essere preceduta da un'esposizione dei lotti, durante la quale gli incaricati di Itineris saranno a disposizione per ogni chiarimento; l'esposizione ha lo scopo di far esaminare l'autenticità, l'attribuzione, lo stato di conservazione, la provenienza, il tipo e la qualità dei beni e chiarire eventuali errori o inesattezze in cui si fosse incorsi nella compilazione del catalogo. L'interessato all'acquisto di un lotto si impegna quindi, prima di partecipare all'asta, ad esaminare approfonditamente il bene, eventualmente anche con la consulenza di un esperto o di un restauratore di sua fiducia, per accertarne tutte le caratteristiche. I lotti posti in asta sono venduti nello stato in cui si trovano al momento dell'esposizione, con ogni relativo difetto ed imperfezione, e la mancanza nel catalogo di riferimenti espliciti in merito non implica che ne siano esenti. Dopo l'aggiudicazione non sono ammesse contestazioni al riguardo; nè Itineris S.r.l., nè i suoi amministratori ed i suoi dipendenti, collaboratori e consulenti saranno considerati responsabili di eventuali errori od omissioni.
6) RESPONSABILITÀ DI ITINERIS: salvo il caso di dolo, Itineris S.r.l., i suoi amministratori ed i suoi dipendenti, collaboratori e consulenti non saranno responsabili per atti od omissioni relativi alla presentazione o alla conduzione dell'asta o per qualsiasi questione relativa all'acquisto dei lotti o al mancato acquisto. Negli altri casi l'eventuale responsabilità di Itineris nei confronti dell'Aggiudicatario in relazione all'acquisto di un lotto da parte di quest'ultimo è limitata al prezzo di aggiudicazione e alla commissione d'acquisto pagata a Itineris dall' aggiudicatario/acquirente.
7) PARTECIPAZIONE ALL'ASTA: è possibile partecipare all'asta personalmente in sala, o anche con offerte scritte, telefonicamente o via internet, facendo pervenire ad Itineris l'apposito modulo almeno sei ore prima dell'inizio della sessione d'asta o tramite providers esterni autorizzati. Itineris S.r.l. non si assume alcun tipo di responsabilità per offerte inavvertitamente non eseguite, per errori relativi all'esecuzione delle stesse, per offerte non leggibili, errate, o arrivate in ritardo, e per qualsiasi disguido o disservizio inerente le linee telefoniche o la linea internet.
8) REGISTRAZIONE ALL'ASTA: chi intenda concorrere all'aggiudicazione in sala di qualsiasi lotto dovrà registrarsi ottenendo una paletta identificativa personale numerata che verrà consegnata da Itineris dopo che l'interessato avrà fornito le proprie generalità ed esibito il proprio documento di identità. La paletta dovrà essere alzata per concorrere alla gara d'asta. Al momento dell'aggiudicazione, chi per qualsiasi motivo non avesse già provveduto, dovrà comunque comunicare a Itineris le proprie generalità ed esibire il proprio documento di identità.
9) FATTURAZIONE: ciascun lotto aggiudicato in sala sarà fatturato in base alle generalità e indirizzo rilasciati al momento dell'assegnazione della paletta numerata.
10) RAPPRESENTAZIONE IN ASTA: è possibile partecipare all'asta in qualità di rappresentante di una terza persona. Il rappresentante, in occasione della registrazione all'asta dovrà esibire una delega sottoscritta dal rappresentato con allegati copia del documento di identità e del codice fiscale del rappresentato e del rappresentante; nell'ipotesi in cui il rappresentato sia una società, la delega dovrà essere sottoscritta dal legale rappresentate o da un procuratore dotato di potere di firma, la cui carta di identità e codice fiscale dovranno essere allegati alla procura. In ogni caso, Itineris si riserva la facoltà di impedire la partecipazione all'asta al rappresentante quando, a suo insindacabile giudizio, non ritenga dimostrato il potere di rappresentanza.
11) OFFERTE SCRITTE: le offerte scritte pervenute con la sottoscrizione del relativo modulo di richiesta tramite posta, email, fax o consegna diretta presso Itineris saranno eseguite per conto dell'offerente al minimo prezzo possibile, considerato il prezzo di riserva dei lotti e le altre offerte. I moduli di offerta con importi illimitati o privi di importo non saranno considerati validi. Itineris non è responsabile per moduli erroneamente compilati. Prima dell'invio o della consegna del modulo, il potenziale aggiudicatario/acquirente deve verificare che la descrizione del lotto indicata nel modulo corrisponda a ciò che intende acquistare; in particolare il potenziale acquirente è tenuto a verificare che vi sia corrispondenza tra il numero di catalogo del lotto e la sua descrizione. In caso di discrepanza tra numero di lotto e descrizione, Itineris formulerà l'offerta per conto del potenziale acquirente con esclusivo riferimento al numero di lotto.
12) OFFERTE TELEFONICHE: per la partecipazione all'asta tramite offerte telefoniche è necessaria la registrazione con l'apposito modulo. Le telefonate potranno essere registrate.
13) OFFERTE VIA INTERNET: per effettuare offerte via internet occorre registrarsi prima dell'orario dell'asta ed accettare le Condizioni di Vendita all'interno del sito www.itinerisaste.com o dei siti internet dei providers autorizzati.
14) AGGIUDICAZIONE: i lotti vengono aggiudicati al miglior offerente (persona fisica o giuridica, "aggiudicatario" o "acquirente") e per contanti.
15)INCREMENTI DELLE OFFERTE: il banditore conduce l'asta partendo dall'offerta che considera adeguata, con incrementi generalmente del 10% (dieci per cento) salvo diversa sua scelta. Il banditore può fare offerte consecutive o in risposta ad altre offerte nell'interesse del Venditore fino al raggiungimento del prezzo di riserva. Nell'ipotesi di offerte di pari importo Itineris terrà in considerazione solo l'offerta ricevuta per prima.
16) CONTESTAZIONE DI UN LOTTO: in caso di contestazione sull'aggiudicazione di un lotto, a insindacabile giudizio del banditore, il lotto oggetto di disputa potrà essere rimesso in vendita nel corso dell'asta stessa e nuovamente aggiudicato, oppure potrà essere ritirato dall'asta.
17) GESTIONE DEI LOTTI: il banditore, durante l'asta, ha facoltà di abbinare e separare i lotti ed eventualmente variare l'ordine di vendita. Lo stesso potrà, a proprio insindacabile giudizio, ritirare i lotti qualora le offerte in asta non raggiungano il prezzo di riserva concordato tra Itineris S.r.l. e venditore. Itineris ha la facoltà di ritirare dall'asta in qualsiasi momento uno più lotti.
18)GARANZIE DI PARTECIPAZIONE: Itineris S.r.l. si riserva il diritto di subordinare la partecipazione all'asta di un potenziale acquirente alla presentazione di referenze bancarie oppure al deposito di adeguata garanzia ad intera copertura del possibile prezzo di aggiudicazione dei lotti desiderati.
19) PAGAMENTO DEL LOTTO - DIRITTI D'ASTA: l'aggiudicatario corrisponderà a Itineris S.r.l. i diritti d'asta comprensivi di IVA, per ciascun lotto, pari al 26% (ventisei per cento) sul prezzo di aggiudicazione. Qualunque ulteriore onere o tributo relativo all'acquisto sarà comunque a carico dell'aggiudicatario. L'aggiudicatario dovrà effettuare il pagamento prima di ritirare la merce a sua cura, rischio e spesa entro e non oltre 5 (cinque) giorni decorrenti dal giorno successivo all'aggiudicazione. In caso di mancato pagamento, in tutto o in parte, dell'ammontare totale dovuto dall'aggiudicatario entro tale termine, Itineris S.r.l. avrà diritto, a propria discrezione, di:
a. restituire il bene al venditore, esigendo a titolo di penale da parte del mancato acquirente il pagamento del 35% del prezzo di aggiudicazione;
b. agire in via giudiziale per ottenere l'esecuzione coattiva dell'obbligo d'acquisto;
c. vendere il lotto tramite trattativa privata o in aste successive per conto ed a spese dell'aggiudicatario, ai sensi
dell'art. 1515 del codice civile, salvo in ogni caso il diritto al risarcimento dei danni.
20) CUSTODIA DEL BENE: decorso il termine di cui sopra, Itineris S.r.l. sarà comunque esonerata da ogni responsabilità nei confronti dell'Aggiudicatario in relazione all'eventuale deterioramento o deperimento degli oggetti ed avrà diritto a farsi pagare per ogni singolo lotto i diritti di custodia oltre a eventuali rimborsi di spese per il trasporto ad altro magazzino, addebitando all'acquirente 15€ per ogni giorno di deposito.
21)PROPRIETÀ DEL LOTTO: il trasferimento della proprietà del lotto avverrà soltanto al momento dell'integrale pagamento da parte dell'acquirente dell'ammontare dovuto. Per integrale pagamento si intende l'accredito effettivo sul conto corrente di Itineris del bonifico o dell'assegno bancario, o la consegna di assegni circolari o di contanti nel limite consentito. Qualunque rischio per perdita o danni al bene aggiudicato si trasferirà all'acquirente dal momento dell'aggiudicazione. L'acquirente potrà ottenere la consegna dei beni acquistati solamente previa corresponsione a Itineris S.r.l. dell'intero prezzo di aggiudicazione, diritti d'asta e ogni altro costo o rimborso inerente. Qualora Itineris fosse impossibilitata a consegnare i beni acquistati, l'acquirente avrà diritto alla semplice restituzione di quanto già pagato, rinunziando preventivamente ed esplicitamente alla richiesta di qualsiasi maggiorazione o danno. Nel caso in cui l'acquirente incarichi un terzo di ritirare il lotto, quest'ultimo dovrà essere munito di delega scritta rilasciata

dall'acquirente nonché fotocopia del documento del delegante e del delegato.?
22)IVA: lotti consegnati da venditori soggetti IVA, indicati in catalogo con il simbolo (§) saranno soggetti, oltre alla commissione d'asta, ad IVA del 22% sul prezzo di aggiudicazione; i lotti in temporanea importazione da paesi non appartenenti alla UE, segnalati in catalogo con il simbolo (#) saranno soggetti, oltre alla commissione d'asta, ad IVA del 10% sul prezzo di aggiudicazione (deposito per acconto IVA doganale) rimborsabile solo in caso di provata riesportazione extra UE avvenuta entro tre mesi dalla data di vendita.
23)BENI NOTIFICATI: per i beni sottoposti alla notifica da parte dello Stato ai sensi del D.Lgs. 22.01.2004 n°42 (c.d. Codice dei Beni Culturali) e successive modifiche, gli acquirenti sono tenuti all'osservanza di tutte le disposizioni legislative vigenti in materia. L'aggiudicatario, in caso di esercizio del diritto di prelazione da parte dello Stato, non potrà pretendere da Itineris S.r.l. o dal venditore alcun rimborso o annullamento neanche delle commissioni d'asta, né di danni materiali o morali di alcun tipo.
24) ESPORTAZIONE DALL'ITALIA / IMPORTAZIONE IN ALTRI PAESI: l'esportazione dall'Italia di oggetti da parte degli acquirenti residenti o non residenti in Italia è regolata della normativa sui beni notificati, dalle leggi nazionali e internazionali doganali, valutarie e tributarie in vigore. Si consiglia di controllare le proprie legislazioni circa i requisiti necessari per le importazioni nel proprio paese dei beni acquistati. Itineris non garantisce né l'esportazione dall'Italia né l'importazione in altri paesi salvo esplicita indicazione, e non assume alcuna responsabilità nei confronti dell'acquirente in ordine ad eventuali restrizioni all'esportazione e successiva importazione dei lotti aggiudicati, né in ordine ad eventuali licenze, certificati o attestati che lo stesso debba ottenere in base alla legislazione italiana, internazionale o locale, il cui rilascio è a carico dell'acquirente; il mancato rilascio o il ritardo nel rilascio non costituisce causa di risoluzione o di annullamento della vendita, né di ritardato pagamento da parte dell'acquirente dell'ammontare totale dovuto, neanche quando Itineris si sia fatta attrice della presentazione delle relative richieste alle autorità competenti. L'ottenimento di una licenza e/o di un certificato di importazione non garantisce l'ottenimento di una licenza o di un certificato per l'esportazione e viceversa Tutti i lotti costituiti da, o contenenti parti di piante o animali (ad esempio avorio, corallo, tartaruga, pelle di alligatore, ossa di balena etc), a prescindere dall'età e dal valore potrebbero necessitare di una licenza o di un certificato per l'esportazione e/o di licenze e/o certificati per l'importazione in alcuni paesi. Si consiglia di controllare le proprie legislazioni circa i requisiti necessari per le importazioni nel proprio paese di beni costituiti o contenti specie protette.
25) CONTESTAZIONE SCIENTIFICA: ogni contestazione, da decidere innanzitutto in sede scientifica fra un consulente di Itineris S.r.l. ed un esperto di pari qualifica designato dal cliente, dovrà essere fatta valere in forma scritta a mezzo di raccomandata a/r entro otto giorni dall'aggiudicazione. Decorso tale termine cessa ogni responsabilità di Itineris S.r.l.. Un reclamo riconosciuto valido porta al semplice rimborso della somma effettivamente pagata, a fronte della restituzione dell'opera, nelle stesse condizioni in cui si trovava alla data della vendita, esclusa ogni altra pretesa. In caso di contestazioni fondate ed accettate da Itineris S.r.l. relativamente ad oggetti falsificati ad arte, purché la relativa comunicazione scritta pervenga alla stessa entro tre mesi dalla scoperta del vizio e comunque non più tardi di cinque anni dalla data della vendita, e sempre che l'acquirente sia in grado di riconsegnare il lotto libero da rivendicazioni o da ogni pretesa da parte di terzi ed il lotto sia nelle stesse condizioni in cui si trovava alla data della vendita, Itineris S.r.l. potrà, a sua discrezione, annullare la vendita e rivelare all'aggiudicatario che lo richieda il nome del venditore, dandone preventiva comunicazione a quest'ultimo. In parziale deroga di quanto sopra, Itineris S.r.l. non effettuerà il rimborso all'acquirente qualora la descrizione del lotto nel catalogo fosse conforme all'opinione generalmente accettata da studiosi ed esperti alla data della vendita o indicasse come controversa l'autenticità o l'attribuzione del lotto, se alla data della pubblicazione del lotto la contraffazione potesse essere accertata soltanto svolgendo analisi difficilmente praticabili, o il cui costo fosse irragionevole, o che avrebbero potuto danneggiare e comunque comportare una diminuzione di valore del lotto. Itineris S.r.l. non risponderà in alcun modo e ad alcun titolo nel caso in cui si verifichino cambiamenti dopo la vendita nei soggetti accreditati e deputati a rilasciare le autentiche relative alle varie opere. Non costituisce contraffazione un bene che sia stato restaurato o soggetto a opera di modifica.
26)DIRITTO DI SEGUITO: qualora dovuto, il pagamento del c.d. "diritto di seguito" (introdotto dal D. Lgs. 13 febbraio 2006, n°118, attuativo della Direttiva 2001/84/CE) sarà corrisposto dal venditore.
27) FORO COMPETENTE: le presenti Condizioni di Vendita sono regolate dalla legge italiana e sono accettate tacitamente da tutti i soggetti partecipanti all'asta. Ogni controversia che dovesse sorgere in relazione all'applicazione, interpretazione, ed esecuzione delle presenti Condizioni di Vendita è esclusivamente di competenza del Foro di Milano.
28)PRIVACY: Ai sensi dell'art. 13 D.Lgs. 196/2003 (Codice in materia di protezione dei dati personali) e GDPR UE2016/679 Itineris, nella sua qualità di titolare del trattamento, informa che i dati forniti verranno utilizzati, con mezzi cartacei ed elettronici, per poter dare piena ed integrale esecuzione ai contratti di compravendita stipulati dalla stessa società, nonché per il perseguimento di ogni altro servizio inerente l'oggetto sociale di Itineris S.r.l.. CONDITIONS OF SALE

1) WRITTEN MANDATE (i.e. CONSIGMENT AGREEMENT): any item is offered for sale in Italy
by Itineris S.r.l., acting as exclusive agent in their own name and on behalf of each seller after entering into a written consignment agreement, pursuant to art. 1704 IT Cod.Civ.. Any effect of the sale will affect the seller, and Itineris S.r.l. it not liable by the buyer or any third parties in general other than for anytthing deriving from its role as agent.
2) MODIFICATIONS: these "Conditions of Sale" may be modified by a notice posted in the auction room or by an announcement made by the auctioneer before the auction start. Potential buyers are requested to consult the website www.itinerisaste.com to view the most updated catalogue of the lots present in the auction.
3) ESTIMATES: the estimates indicated in the catalogue are expressed in euros, constitute a mere indication and may be modified at any time and are unsuitable to generate any type of forecast on the price of the award.
4) DESCRIPTION OF THE LOTS - CONDITION REPORTS: any representation, written, oral or digital, including those published in the catalogue or in any report, guide, brochure or estimate, also related to the characteristics or quality of the goods, including the price or value, are the result of subjective evaluations and reflect opinions, and may be modified before the lot is offered for sale, including the period during which the lot is exposed to the public. Itineris S.r.l. can not be held responsible for errors or omissions relating to such descriptions, or in the event of counterfeiting, as no implicit or explicit guarantee is given with regard to the lots in auction. Furthermore, the images of the items presented in the catalogues or other illustrative material are used exclusively to identify the lot and can not be considered precise representations of the state of conservation of the goods placed at auction. In addition to the descriptions contained in the catalogue, on request Itineris provides condition reports on the status of each lot. The statements in the condition reports on the conservation status of the lots represent a mere subjective opinion not deriving from specific technical-professional knowledge of conservation or restoration and therefore does not constitute, for any reason, an element of declaration or guarantee that replaces the direct examination of the interested parties. The estimated weights of the gemstones, when not referred to a gemological certificate, are to be considered purely indicative. All watches are described as they appeared at the time of catalogueuing. As items of mechanical or electronic nature, they can show wear and defects, damage and consequent repairs and restorations and / or replacements of various non-original parts, including straps and buckles. For this reason Itineris
S.r.l. can not provide guarantees on the operating status or impermeability, or on the replacement of parts or on the restorations that have occurred, and the purchaser is responsible to verify personally, or with the advice of a trusted technician, the status of the lot of interest. For quartz watches, the operating status is indicated only when the battery is present and functioning. Buyers are informed that boxes, certificates and any accessories are not provided in the absence of specific indication in the catalogue.
5) EXHIBITION: the auction may be preceded by an exhibition of the lots, during which the Itineris experts will be available for any clarification; the exhibition aims to let examine the authenticity, attribution, conservation status, provenance, type and quality of the goods and clarify any errors or inaccuracies in which the catalogue was compiled. The person interested in buying a lot commits himself, before participating in the auction, to examine the property in depth, possibly also with the advice of an expert or a restorer of his trust, to ascertain all the characteristics. The lots placed at auction are sold in the state in which they are at the time of exposure, with any related defect and imperfection, and the lack of explicit references in the catalogue does not imply that they are exempt. No complaints are allowed after the award; neither Itineris S.r.l., nor its directors and employees, collaborators and consultants will be held responsible for any errors or omissions.
6) ITINERIS LIABILITY: except for the case of fraud, Itineris Srl, its administrators and its employees, collaborators and consultants will not be responsible for any acts or omissions relating to the presentation or running of the auction or for any question relating to the purchase of lots or failure to purchase. In any other case, Itineris's possible liability towards the Awardee in relation to the purchase of a lot by the latter is limited to the hammer price and the purchase commission paid to Itineris by the winning bidder / buyer. 7) PARTICIPATION IN THE AUCTION: it is possible to participate in the auction personally in the auction room, or even with written offers, by phone or via the internet, sending Itineris the appropriate form at least six hours before the beginning of the auction session or through authorized external providers. Itineris S.r.l. is not liable for inadvertently not executed offers, for errors related to the execution
of the same, for offers that are not readable, incorrect, or arrived late, and for any inconvenience or disruption concerning telephone lines or internet.
8) REGISTRATION TO THE AUCTION: whoever intends to compete in the auction room for any lot must register and get a numbered personal identification paddle that will be delivered by Itineris subject to providing personal data and identity documents. The paddle must be raised to compete for the auction. At the time of the award, who for any reason had not already done so, will have to inform Itineris about their personal data and show their identity document.
9) BILLING: each lot awarded in the auction room will be billed based on the general information and address given at the time of assignment of the numbered paddle.
10) REPRESENTATION AT AUCTION: it is possible to participate in the auction as a representative of a third person. On the occasion of the registration, the representative will have to present a proxy signed by the represented person with a copy of the identity document and of the tax code of the represented person and of the representative; in the event that the person represented is a company, the proxy must be signed by the legal representative or by an attorney with the power of signature, whose identity card and tax code must be attached to a document proving the
status. In any case, Itineris reserves the right to prevent participation in the auction to the representative when, at its sole discretion, it does not consider the power of representation to be demonstrated.
11) WRITTEN OFFERS: when the requested signed form is received by mail, email, fax or direct delivery to Itineris, written offers will be performed on behalf of the bidder at the lowest possible price, considering the reserve price of the lots and the other offers. Offer forms with unlimited amounts or no amount will not be considered valid. Itineris is not responsible for incorrectly completed forms. Before sending or submitting the form, the potential winner / purchaser must verify that the description of the lot indicated in the form corresponds to what he intends to purchase; in particular, the potential buyer is required to verify that there is a correspondence between the lot catalogue number and its description. In case of discrepancy between lot number and description, Itineris will make the offer on behalf of the potential buyer with exclusive reference to the lot number.
12) TELEPHONE BIDS: to participate in the auction via telephone offers is required registration with the appropriate form. Phone calls can be recorded.
13) INTERNET BIDS: to make offers via the Internet is required to register before the auction and accept the Conditions of Sale within the site www.itinerisaste.com or the websites of authorized providers. 14) AWARD: the lots are awarded to the highest bidder, natural or legal person, (i.e. winner or buyer) and for cash.
15) INCREASES OF OFFERS: the auctioneer leads the auction starting from the offer he considers adequate, with increases generally of 10% (ten percent) unless otherwise chosen. The auctioneer can make consecutive offers or in response to other offers in the interest of the seller until the reserve price is reached. In the case of offers of the same amount Itineris will only take into consideration the offer received first.
16) DISPUTE OF A LOT: in case of dispute over the awarding of a lot, at the unquestionable judgment of the auctioneer, the lot can be put back for sale during the auction and again awarded, or it can be withdrawn from the auction.
17) LOT MANAGEMENT the auctioneer, during the auction, has the right to combine and separate the lots and possibly change the sales order. The same may, at its sole discretion, withdraw the lots if the offers at auction do not reach the reserve price agreed between Itineris S.r.l. and seller. Itineris has the right to withdraw one or more lots from the auction at any time.
18) PARTICIPATION UNDER WARRANTY: Itineris S.r.l. reserves the right to subordinate the participation of a potential buyer to the presentation of bank references or to the deposit of an adequate guarantee to cover the entire price of the desired lots.
19) AUCTION FEES (i.e. BUYER'S PREMIUM): for each lot the successful bidder will correspond to Itineris S.r.l. the buyer's premium including VAT, equal to 26% (twentysix) on the hammer price. Any additional charge or tax related to the purchase will in any case be borne by the winner. The successful bidder will have to make the payment no later than 5 (five) days from the day following the award and before withdrawing the goods at his care, risk and expense. In the event of non-payment, in whole or in part, of the total amount due by the seller within that period, Itineris S.r.l. will have the right, at its discretion, to: a) return the asset to the seller, claiming the payment of 35% (thirtyfive) of the hammer price as a penalty by the non-purchaser; b) take legal action to enforce the compulsory purchase

obligation; c) sell the lot by private-sale or in subsequent auctions on behalf and at the expense of the seller, pursuant to art. 1515 of IT Cod.Civ:, save in any case the right to compensation for damages.
20) After the aforementioned term, Itineris S.r.l. will in any case be exonerated from any liability towards the successful bidder in relation to the eventual deterioration or decay of the items and will have the right to be paid for each lot of custody rights as well as any reimbursement of expenses for transportation to another warehouse, charging the buyer € 15 for each day of deposit.
21) The transfer of ownership of the lot will take place only at the time of the full payment by the buyer of the amount due. Full payment means that the wire transfer or the bank cheque is registered on Itineris' bank account, or the cashier's cheque or cash within the permitted limit is consigned to Itineris' offices, or authorization from the credit card issuer is obtained. Any risk for loss or damage to the awarded item will be transferred to the purchaser from the time of the award. The buyer can require the delivery of the purchased goods only after payment to Itineris
S.r.l. of the entire hammer price, auction fees and any other relevant cost or refund. If Itineris were unable to deliver the purchased goods, the buyer will have the right to get back purely what has already been paid, renouncing in advance and explicitly to claim any increase or damage. In the event that the buyer assigns a third party to withdraw the lot, the latter must be provided with a written proxy issued by the purchaser and a copy of the document of the delegator and of the delegate.
22) The lots delivered by sellers subject to VAT, indicated in the catalogue with the symbol (§) will be subject, in addition to the auction commission, to VAT of 22% on the hammer price; the lots in temporary importation from countries not belonging to the EU, reported in the catalogue with the symbol (#) will be subject, in addition to the auction fee, to 10% VAT on the hammer price (deposit for VAT) refundable only in case of proven non-EU re- exportation occurred within three months from the date of sale.
23) NOTIFIED GOODS: for goods subject to notification by the Italian State pursuant to Legislative Decree 22.01.2004 n°42 (so-called Cultural Heritage Code) and subsequent modifications, buyers are required to comply with all law provisions in force on the matter. The buyer, in case of exercise of the right of first refusal by the Italian State, cannot claim from Itineris S.r.l. or from the seller any refund or cancellation of the auction commissions, nor any material or moral damage of any kind.
24) EXPORT FROM ITALY / IMPORT IN OTHER COUNTRIES: the export from Italy of objects by buyers resident or not resident in Italy is regulated by the legislation on notified goods, by national and international custom laws, currency and tax laws in force . It is higly recommended to abroad buyers to check their own legislation regarding the requirements prescribed for importing into their country the goods purchased. Itineris does not guarantee either the export from Italy or the import to other countries unless explicitly stated, and does not assume any responsibility towards the buyer for any export restrictions and subsequent import of the lots awarded, nor for any licenses, certificates that the same must obtain based on Italian, international or local legislation, the release of which is the buyer's responsibility; the failure to release or delay in the release does not constitute cause for resolution or cancellation of the sale, nor for late payment by the buyer of the total amount due, not even when Itineris has acted as an actor in the presentation of the relative requests to the competent authorities. Obtaining a license and/or import certificate does not guarantee the obtaining of a license or certificate for export and vice versa. All lots consisting of, or containing parts of plants or animals (for example ivory, coral, turtle, alligator skin, whale bones etc), regardless of age and value may need a license or export certificate and/or licenses and/or import certificates in some countries. It is higly advisable to abroad buyers to check their own legislation regarding the requirements necessary for importing into their country any goods constituted or containing protected species.
25) Any dispute, to be decided first in the scientific forum between a consultant of Itineris S.r.l. and an expert with the same qualifications appointed by the client, must be asserted in writing by registered letter with return receipt within eight days from the award. Once this deadline has expired, Itineris S.r.l ceases all liability. A valid recognized claim leads to the simple repayment of the sum actually paid, in exchange for the return of the work, in the same conditions as it was at the date of sale, excluding any other claim. In case of complaints founded and accepted by Itineris S.r.l. in relation to items counterfeited to art, provided that the relative written communication arrives to the same within three months from the discovery of the defect and in any case no later than five years from the date of sale, and always that the buyer is able to return the free lot from claims or from any claims by third parties and the lot is in the same condition in which it was at the date of sale, Itineris Srl may, at its discretion, cancel the sale and disclose to the successful bidder requesting the name of the seller, giving prior notice to the latter. In partial exemption from the above, Itineris S.r.l. will not refund the purchaser if the description of the lot in the

catalogue conforms to the opinion generally accepted by scholars and experts at the date of sale or indicates the authenticity or attribution of the lot as controversial, if on the date of publication of the lot the counterfeiting could only be ascertained by carrying out analyzes that were difficult to do, or whose cost was unreasonable, or which could have damaged and in any case led to a decrease in the value of the lot. Itineris S.r.l. will not respond in any way in the event that after the sale changes occur in the subjects deputed and accredited to issue the expertises related to the art-works. An asset that has been restored or subject to modification is not a forgery.
26) ARTIST RESALE RIGHT: if due, the payment of the c.d. "artist resale right" (introduced by IT Legislative Decree no. 118 of 13 February 2006, implementing Directive 2001/84 / EC) will be paid by the seller.
27) These Conditions of Sale are governed by Italian law and are tacitly accepted by all participants in the auction. Any dispute that may arise in relation to the application, interpretation, and execution of these Conditions of Sale is exclusively jurisdiction of the Law Court of Milan.
28) PRIVACY: Pursuant to art. 13 IT D.Lgs. 196/2003 | GDPR UE2016/679, Itineris, in its role as data controller, informs that the data will be used, using paper and electronic means, to be able to give full and complete execution of the purchase and sale contracts stipulated by the same company, as well as for the pursuit of any other service compliant to Itineris Srl. The conferment of data is optional, but is strictly necessary for the execution of contracts. The registration to the auctions allows Itineris to send the catalogues of next auctions and other informative material related to auction and sales.

Potential buyers are requested to consult the website www.itinerisaste.com to view the most updated catalogue of the lots present in the auction.
3) ESTIMATES: the estimates indicated in the catalogue are expressed in euros, constitute a mere indication and may be modified at any time and are unsuitable to generate any type of forecast on the price of the award.
4) DESCRIPTION OF THE LOTS - CONDITION REPORTS: any representation, written, oral or digital, including those published in the catalogue or in any report, guide, brochure or estimate, also related to the characteristics or quality of the goods, including the price or value, are the result of subjective evaluations and reflect opinions, and may be modified before the lot is offered for sale, including the period during which the lot is exposed to the public. Itineris S.r.l. can not be held responsible for errors or omissions relating to such descriptions, or in the event of counterfeiting, as no implicit or explicit guarantee is given with regard to the lots in auction. Furthermore, the images of the items presented in the catalogues or other illustrative material are used exclusively to identify the lot and can not be considered precise representations of the state of conservation of the goods placed at auction. In addition to the descriptions contained in the catalogue, on request Itineris provides condition reports on the status of each lot. The statements in the condition reports on the conservation status of the lots represent a mere subjective opinion not deriving from specific technical-professional knowledge of conservation or restoration and therefore does not constitute, for any reason, an element of declaration or guarantee that replaces the direct examination of the interested parties. The estimated weights of the gemstones, when not referred to a gemological certificate, are to be considered purely indicative. All watches are described as they appeared at the time of catalogueuing. As items of mechanical or electronic nature, they can show wear and defects, damage and consequent repairs and restorations and / or replacements of various non-original parts, including straps and buckles. For this reason Itineris
S.r.l. can not provide guarantees on the operating status or impermeability, or on the replacement of parts or on the restorations that have occurred, and the purchaser is responsible to verify personally, or with the advice of a trusted technician, the status of the lot of interest. For quartz watches, the operating status is indicated only when the battery is present and functioning. Buyers are informed that boxes, certificates and any accessories are not provided in the absence of specific indication in the catalogue.
5) EXHIBITION: the auction may be preceded by an exhibition of the lots, during which the Itineris experts will be available for any clarification; the exhibition aims to let examine the authenticity, attribution, conservation status, provenance, type and quality of the goods and clarify any errors or inaccuracies in which the catalogue was compiled. The person interested in buying a lot commits himself, before participating in the auction, to examine the property in depth, possibly also with the advice of an expert or a restorer of his trust, to ascertain all the characteristics. The lots placed at auction are sold in the state in which they are at the time of exposure, with any related defect and imperfection, and the lack of explicit references in the catalogue does not imply that they are exempt. No complaints are allowed after the award; neither Itineris S.r.l., nor its directors and employees, collaborators and consultants will be held responsible for any errors or omissions.
6) ITINERIS LIABILITY: except for the case of fraud, Itineris Srl, its administrators and its employees, collaborators and consultants will not be responsible for any acts or omissions relating to the presentation or running of the auction or for any question relating to the purchase of lots or failure to purchase. In any other case, Itineris's possible liability towards the Awardee in relation to the purchase of a lot by the latter is limited to the hammer price and the purchase commission paid to Itineris by the winning bidder / buyer. 7) PARTICIPATION IN THE AUCTION: it is possible to participate in the auction personally in the auction room, or even with written offers, by phone or via the internet, sending Itineris the appropriate form at least six hours before the beginning of the auction session or through authorized external providers. Itineris S.r.l. is not liable for inadvertently not executed offers, for errors related to the execution
of the same, for offers that are not readable, incorrect, or arrived late, and for any inconvenience or disruption concerning telephone lines or internet.
8) REGISTRATION TO THE AUCTION: whoever intends to compete in the auction room for any lot must register and get a numbered personal identification paddle that will be delivered by Itineris subject to providing personal data and identity documents. The paddle must be raised to compete for the auction. At the time of the award, who for any reason had not already done so, will have to inform Itineris about their personal data and show their identity document.
9) BILLING: each lot awarded in the auction room will be billed based on the general information and address given at the time of assignment of the numbered paddle.
10) REPRESENTATION AT AUCTION: it is possible to participate in the auction as a representative of a third person. On the occasion of the registration, the representative will have to present a proxy signed by the represented person with a copy of the identity document and of the tax code of the represented person and of the representative; in the event that the person represented is a company, the proxy must be signed by the legal representative or by an attorney with the power of signature, whose identity card and tax code must be attached to a document proving the
status. In any case, Itineris reserves the right to prevent participation in the auction to the representative when, at its sole discretion, it does not consider the power of representation to be demonstrated.
11) WRITTEN OFFERS: when the requested signed form is received by mail, email, fax or direct delivery to Itineris, written offers will be performed on behalf of the bidder at the lowest possible price, considering the reserve price of the lots and the other offers. Offer forms with unlimited amounts or no amount will not be considered valid. Itineris is not responsible for incorrectly completed forms. Before sending or submitting the form, the potential winner / purchaser must verify that the description of the lot indicated in the form corresponds to what he intends to purchase; in particular, the potential buyer is required to verify that there is a correspondence between the lot catalogue number and its description. In case of discrepancy between lot number and description, Itineris will make the offer on behalf of the potential buyer with exclusive reference to the lot number.
12) TELEPHONE BIDS: to participate in the auction via telephone offers is required registration with the appropriate form. Phone calls can be recorded.
13) INTERNET BIDS: to make offers via the Internet is required to register before the auction and accept the Conditions of Sale within the site www.itinerisaste.com or the websites of authorized providers. 14) AWARD: the lots are awarded to the highest bidder, natural or legal person, (i.e. winner or buyer) and for cash.
15) INCREASES OF OFFERS: the auctioneer leads the auction starting from the offer he considers adequate, with increases generally of 10% (ten percent) unless otherwise chosen. The auctioneer can make consecutive offers or in response to other offers in the interest of the seller until the reserve price is reached. In the case of offers of the same amount Itineris will only take into consideration the offer received first.
16) DISPUTE OF A LOT: in case of dispute over the awarding of a lot, at the unquestionable judgment of the auctioneer, the lot can be put back for sale during the auction and again awarded, or it can be withdrawn from the auction.
17) LOT MANAGEMENT the auctioneer, during the auction, has the right to combine and separate the lots and possibly change the sales order. The same may, at its sole discretion, withdraw the lots if the offers at auction do not reach the reserve price agreed between Itineris S.r.l. and seller. Itineris has the right to withdraw one or more lots from the auction at any time.
18) PARTICIPATION UNDER WARRANTY: Itineris S.r.l. reserves the right to subordinate the participation of a potential buyer to the presentation of bank references or to the deposit of an adequate guarantee to cover the entire price of the desired lots.
19) AUCTION FEES (i.e. BUYER'S PREMIUM): for each lot the successful bidder will correspond to Itineris S.r.l. the buyer's premium including VAT, equal to 26% (twentysix) on the hammer price. Any additional charge or tax related to the purchase will in any case be borne by the winner. The successful bidder will have to make the payment no later than 5 (five) days from the day following the award and before withdrawing the goods at his care, risk and expense. In the event of non-payment, in whole or in part, of the total amount due by the seller within that period, Itineris S.r.l. will have the right, at its discretion, to: a) return the asset to the seller, claiming the payment of 35% (thirtyfive) of the hammer price as a penalty by the non-purchaser; b) take legal action to enforce the compulsory purchase

obligation; c) sell the lot by private-sale or in subsequent auctions on behalf and at the expense of the seller, pursuant to art. 1515 of IT Cod.Civ:, save in any case the right to compensation for damages.
20) After the aforementioned term, Itineris S.r.l. will in any case be exonerated from any liability towards the successful bidder in relation to the eventual deterioration or decay of the items and will have the right to be paid for each lot of custody rights as well as any reimbursement of expenses for transportation to another warehouse, charging the buyer € 15 for each day of deposit.
21) The transfer of ownership of the lot will take place only at the time of the full payment by the buyer of the amount due. Full payment means that the wire transfer or the bank cheque is registered on Itineris' bank account, or the cashier's cheque or cash within the permitted limit is consigned to Itineris' offices, or authorization from the credit card issuer is obtained. Any risk for loss or damage to the awarded item will be transferred to the purchaser from the time of the award. The buyer can require the delivery of the purchased goods only after payment to Itineris
S.r.l. of the entire hammer price, auction fees and any other relevant cost or refund. If Itineris were unable to deliver the purchased goods, the buyer will have the right to get back purely what has already been paid, renouncing in advance and explicitly to claim any increase or damage. In the event that the buyer assigns a third party to withdraw the lot, the latter must be provided with a written proxy issued by the purchaser and a copy of the document of the delegator and of the delegate.
22) The lots delivered by sellers subject to VAT, indicated in the catalogue with the symbol (§) will be subject, in addition to the auction commission, to VAT of 22% on the hammer price; the lots in temporary importation from countries not belonging to the EU, reported in the catalogue with the symbol (#) will be subject, in addition to the auction fee, to 10% VAT on the hammer price (deposit for VAT) refundable only in case of proven non-EU re- exportation occurred within three months from the date of sale.
23) NOTIFIED GOODS: for goods subject to notification by the Italian State pursuant to Legislative Decree 22.01.2004 n°42 (so-called Cultural Heritage Code) and subsequent modifications, buyers are required to comply with all law provisions in force on the matter. The buyer, in case of exercise of the right of first refusal by the Italian State, cannot claim from Itineris S.r.l. or from the seller any refund or cancellation of the auction commissions, nor any material or moral damage of any kind.
24) EXPORT FROM ITALY / IMPORT IN OTHER COUNTRIES: the export from Italy of objects by buyers resident or not resident in Italy is regulated by the legislation on notified goods, by national and international custom laws, currency and tax laws in force . It is higly recommended to abroad buyers to check their own legislation regarding the requirements prescribed for importing into their country the goods purchased. Itineris does not guarantee either the export from Italy or the import to other countries unless explicitly stated, and does not assume any responsibility towards the buyer for any export restrictions and subsequent import of the lots awarded, nor for any licenses, certificates that the same must obtain based on Italian, international or local legislation, the release of which is the buyer's responsibility; the failure to release or delay in the release does not constitute cause for resolution or cancellation of the sale, nor for late payment by the buyer of the total amount due, not even when Itineris has acted as an actor in the presentation of the relative requests to the competent authorities. Obtaining a license and/or import certificate does not guarantee the obtaining of a license or certificate for export and vice versa. All lots consisting of, or containing parts of plants or animals (for example ivory, coral, turtle, alligator skin, whale bones etc), regardless of age and value may need a license or export certificate and/or licenses and/or import certificates in some countries. It is higly advisable to abroad buyers to check their own legislation regarding the requirements necessary for importing into their country any goods constituted or containing protected species.
25) Any dispute, to be decided first in the scientific forum between a consultant of Itineris S.r.l. and an expert with the same qualifications appointed by the client, must be asserted in writing by registered letter with return receipt within eight days from the award. Once this deadline has expired, Itineris S.r.l ceases all liability. A valid recognized claim leads to the simple repayment of the sum actually paid, in exchange for the return of the work, in the same conditions as it was at the date of sale, excluding any other claim. In case of complaints founded and accepted by Itineris S.r.l. in relation to items counterfeited to art, provided that the relative written communication arrives to the same within three months from the discovery of the defect and in any case no later than five years from the date of sale, and always that the buyer is able to return the free lot from claims or from any claims by third parties and the lot is in the same condition in which it was at the date of sale, Itineris Srl may, at its discretion, cancel the sale and disclose to the successful bidder requesting the name of the seller, giving prior notice to the latter. In partial exemption from the above, Itineris S.r.l. will not refund the purchaser if the description of the lot in the

catalogue conforms to the opinion generally accepted by scholars and experts at the date of sale or indicates the authenticity or attribution of the lot as controversial, if on the date of publication of the lot the counterfeiting could only be ascertained by carrying out analyzes that were difficult to do, or whose cost was unreasonable, or which could have damaged and in any case led to a decrease in the value of the lot. Itineris S.r.l. will not respond in any way in the event that after the sale changes occur in the subjects deputed and accredited to issue the expertises related to the art-works. An asset that has been restored or subject to modification is not a forgery.
26) ARTIST RESALE RIGHT: if due, the payment of the c.d. "artist resale right" (introduced by IT Legislative Decree no. 118 of 13 February 2006, implementing Directive 2001/84 / EC) will be paid by the seller.
27) These Conditions of Sale are governed by Italian law and are tacitly accepted by all participants in the auction. Any dispute that may arise in relation to the application, interpretation, and execution of these Conditions of Sale is exclusively jurisdiction of the Law Court of Milan.
28) PRIVACY: Pursuant to art. 13 IT D.Lgs. 196/2003 | GDPR UE2016/679, Itineris, in its role as data controller, informs that the data will be used, using paper and electronic means, to be able to give full and complete execution of the purchase and sale contracts stipulated by the same company, as well as for the pursuit of any other service compliant to Itineris Srl. The conferment of data is optional, but is strictly necessary for the execution of contracts. The registration to the auctions allows Itineris to send the catalogues of next auctions and other informative material related to auction and sales.
