ACES Terms & Conditions of Sale

All property offered and sold through All Country Estate Sales, LLC. ("ACES" "ACES Gallery") shall be offered and sold on the terms and conditions below. By bidding at the auction, whether present in person or by agent, by written bid, telephone, internet or other means, the buyer agrees to be bound by these terms and conditions.

1. ALL ITEMS ARE SOLD "AS IS" - ALL SALES FINAL - and neither the auctioneer nor any consignor makes any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, of description, genuineness, authorship, attribution, provenance, period culture, source, origin or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability.

2. RESERVES - Some of the lots in this sale are offered subject to a reserve. The reserve is a confidential minimum price agreed upon by the consignor and ACES below which the lot will not be sold. In most cases, the reserve will be set below the estimated range, but in no case will it exceed the estimates listed. A representative of ACES will execute such reserves by bidding for the consignor. In any event and whether or not a lot is subject to a reserve, the auctioneer may reject any bid or raise not commensurate with the value of such lot.

3. SALE - Except as provided in paragraph 2 above, on the fall of the auctioneers? gavel or verbal declaration of the same, the highest bidder as determined by the auctioneer shall be the purchaser. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or re-offer the lot for sale. The auctioneer shall have sole discretion to refuse any bid, refuse to acknowledge any bidder, nullify bids before or after their execution, rescind any sale, or eject any person from the Auction premises. In the unlikely event of a loss of internet or phone connection we reserve the right to cancel or discontinue the auction.

4. BUYER'S PREMIUM - Except for property purchased online via liveauctioneers.com or invaluable.com, a premium equal to 25% of the final bid price will be applied to each lot sold, with a 3% discount for Cash, Wire, ACH, Zelle, or Check payment, to be paid by the buyer as part of the purchase price. The buyer's premium on property purchased via Liveauctioneers.com or invaluable.com will be in an amount up to 30% of the final bid price with a 3% discount for Cash, Wire, ACH, Zelle, or Check payment.

5. SALES TAX - All purchases are subject to a Connecticut State sales tax of 6.35% unless (1) the buyer is an out of state resident and lots are being shipped out of Connecticut or (2) the purchaser has a valid tax resale certificate (an actual resale certificate must be presented and on file with ACES Gallery)

6. PAYMENT - Payment methods accepted: Cash (in house only); Credit card payment will be accepted for invoice amounts under $2,000.00 (All payments of $2,000.00 and over MUST be made via other accepted methods); We do not accept international credit card payments; Credit cards from North America accepted include American Express, MasterCard, Visa, & Discover; Bank Wire Transfer (all international payments of any amount and payments for invoices over $2,000.00), Money order, certified check, approved personal or business check with proper identification. We reserve the right to hold item(s) until checks are clear. International wire transfer invoices are subject to a $50 bank fee.

7. AUTOMATIC CHARGE - Bidder gives ACES Gallery permission to charge the credit card supplied at the time of registration if payment is not made within 3 business days or the auction's specific payment time frame.

8. COLLECTION - COLLECTION IS "BY-APPOINTMENT" Items offered in the auction will be made available for buyers to collect for a period of three weeks following the auction, after which time remaining material will be packed and moved to ACES Gallery's secure storage facility at the risk and expense of the buyer. Packing and loading are the responsibility of the buyer, though ACES Gallery may offer assistance, it will not be held liable for any damage resulting from such action. ACES Gallery will not be held responsible for any damage or missing items following the sale.

UNLESS PRIOR ARRANGEMENTS have been made; Items not picked up by after twenty one (21) calendar days will be subject to a moving and packing charge, plus a $10 per day/ per lot storage fee.

9. SHIPPING - Shipping is the responsibility of the purchaser. Upon request, our staff will provide a list of shippers who deliver to destinations within the United States and overseas. Buyers must contact the shipping company directly after the auction to arrange shipment and payment for shipping. We require a written emailed release in order to have items ready for pickup.
Some property that is sold at auction can be subject to laws governing exports from the U.S., such as items that include material from some endangered species. Import restrictions from foreign countries are subject to these same governing laws. Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of licensing will not constitute cancellation or delay in payment for the total purchase price of these lots.

10. RETURN POLICY - For buyers who pickup in-person, or who send an authorized agent to collect for them in person, you or your agent must inspect and accept the merchandise at the point of pickup. Once you take possession of the merchandise, and sign our release authorization, ACES is no longer responsible or liable for the material in any way and there will be no returns or refunds permitted - "ALL SALES FINAL."

For buyers who have merchandise shipped to them: Buyers have 15 days after the auction date to contact ACES Gallery if there is a misrepresentation of an item. ACES will not be responsible for any items after 15 days from the auction date.

11. DAMAGE IN TRANSIT - Any damage that occurred during shipping is the responsibility of the shipper. All items must be signed off on by the shipper before leaving our facilities confirming condition is as stated in the catalog.

12. ACCEPTANCE OF TERMS - Bidding on any item constitutes your acceptance of these Terms & Conditions of Sale and all other terms printed within, posted, and announced at the time of the sale whether bidding in person, through a representative, by phone, by internet, by absentee bid, or by any other means.

13. LIABILITY - In no event will the liability of ACES Gallery to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item.

14. VALIDITY - No invalidity or partial invalidity or unenforceability of any provision provided herein shall affect or impair the validity or enforceability of any other provision hereof.

ACES Payment Rules

ACES Gallery accepts Credit Cards, Wire Transfers, Zelle, Cash, Cashier's Checks and Money Orders.

We do not accept credit cards for invoice amounts over $2,000, for international buyers, or for any invoices for gems, jewelry, or precious metals.

ACES Condition Reports

Condition reports are provided as a courtesy to bidders. The absence or inclusion of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections, or the effects of aging. Requests for condition reports can be made via telephone at (475) 500-7118 or via email at [email protected]. Any condition statement given is presented as the opinion of the person reporting and should not be treated as a statement of fact. ACES Gallery shall have no responsibility for any errors or omissions in condition statements.

Condition report requests sent to ACES Gallery via e-mail ([email protected]) will be responded to by adding information or photographs to the online catalog. E-mail requests will not always be responded to by return e-mail. Please make requests as early as possible since merchandise is not readily available for additional photos, measurements, etc. until we set up for preview. We cannot take photos or answer questions 24 hours before an auction begins.
