Terms and Conditions

1. The auction is carried out by Sebastian Marzeion - Antikauktion Krefeld (hereinafter auctioneer) in the name and for the account of a third party. The purchase contract is mediated between the consignor and the buyer. In the case of a distance selling transaction, there is no right of cancellation; § 312g paragraph 2 no. 10 BGB.

2. The auctioneer has the domiciliary rights in all auction rooms and reserves the right to exclude people from viewing or auctioning without giving reasons. Bidders must identify themselves by presenting their identity card.

3. The auctioneer reserves the right to combine numbers of the catalogue, to separate them and, if there is a special reason, to call them out of sequence or to withdraw them.

4. All auction items can be adequately inspected and checked before the auction and on preview days. The description in the catalog is for information only and is not a guaranteed property, particularly with regard to quality and completeness. A detailed description of the condition of the item is not mentioned in the catalog unless the item is clearly damaged. The items are used and will be auctioned in the condition in which they are at the time of the bid. Technical and electronic objects are not checked for functionality. Requests for the condition report must be made in good time before the start of the auction.

5. The call begins with the limit price and is usually increased in 10% increments, but at least in 10 EUR increments. Written bids are bid with the next lowest bid increment as long as there is a higher bid.

6. The bid is accepted after a bid has been called three times, unless a higher bid is made. With the award, the risk is transferred to the purchaser.

7. The auctioneer can reserve or refuse the bid on behalf of the consignor if there is a special reason. If several people submit a bid at the same time and there is no higher bid, the lot decides on the bid. If the limit is not reached, the bid can be accepted "under reserve" and requires the consent of the consignor.

8. Ownership is only transferred to the bidder after full payment has been made.

9. A surcharge of 20% will be added to the hammer price, plus the statutory sales tax of 19% (total 23.8%) on the surcharge. For bidders via the external live bidding systems, a 3% - 5% premium applies.

10. Invoices issued immediately after the auction require special verification. Errors and omissions excepted.

11. The purchase contract is concluded with the award and obliges acceptance and payment in cash or by bank transfer. The buyer is obliged to take over the items immediately after the auction. Buyers by written, electronic or telephone surcharge will receive an invoice. This is due within 14 days of receipt. In the event of late payment, interest of 2% will be charged for each month started.

12. Complaints of any kind after the award remain unconsidered.
Warranty claims are to be asserted directly with the consignor. The claims of the auctioneer remain unaffected.

13. Pre-bids by bidders in written, electronic and telephone form must be submitted at least 24 hours before the start of the auction.

14. Telephone bids are only permitted from a limit price of EUR 100.00. With the registration as a telephone bidder, the limit price is automatically bid.

15. The desired shipping of auctioned items is carried out without exception at the expense and risk of the buyer. The shipping costs depend on the weight, size, packaging material, destination country and effort. The auctioneer is not liable for loss of or damage to the consignment by the shipping company. Items that cannot be shipped or easily breakable items must be picked up.

16. Auctioned items must be picked up no later than 14 days after the auction. In the event of a delay, we shall charge a storage fee of EUR 10 for each commenced week.

17. Objects from the Third Reich are auctioned solely for the purposes of civic education, defense against unconstitutional efforts, art or science, research or teaching, reporting on current or historical events or for similar purposes.

18. The auctioneer assumes no liability and is not liable for technical problems in the live internet bidding system or the establishment of a telephone connection at the time of the auction. Early bidding is recommended.

19. Any liability for description, image and printing errors in the catalog and/or online catalog is rejected.

20. Place of performance and place of jurisdiction is Krefeld. German law applies.
Should one of the provisions be wholly or partially ineffective, the validity of the others remains unaffected.

Buyer's Increments

9. The surcharge price is subject to a surcharge of 28.8%. The statutory sales tax is already included in the fee and is not reported under Section 25a UStG due to the difference tax. Regularly taxed auction objects are marked with one (R), with a 25% surcharge on the surcharge plus on the fee the statutory sales tax.
