Aardvark Antiques, LLC for itself and as agent for the seller, makes no warranties or representations of any kind with respect to any Lot., Buyer agrees that in no event shall Aardvark Antiques,LLC be held responsible or liable for the correctness, description, genuineness, authorship, attribution, provenance, period, culture, source, origin, value, or condition of any Lot. Nothing said or done by Aardvark Antiques,LLC shall be deemed a warranty of representation or an assumption of liability by Four Seasons Auction Gallery.

Bidding in this auction is a binding legal agreement with Aardvark Antiques, LLC. If you decide to take us to court for any reason you agree to pay our legal fees.
We encourage you to set an appointment for yourself or an expert to preview any item you are considering buying.
Condition report statements are generally provided as a courtesy to interested clients upon request and outside of 48 hours of the start of the auction. Such reports state our professional opinion and should not be treated as a statement of fact. As such, Aardvark Antiques LLC is not responsible for any omissions or errors to these condition reports.
The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or free of imperfections.
Buyer Premium 20% + 3% for Credit Card. This does not include any premium that Liveauctioneers may charge you in addition.
Credit Cards cannot be used for purchasing automobiles. " " Sales tax: All purchases are subject to 7% Georgia state sales tax; you must provide us with your reseller tax ID information if you wish to avoid tax being added to your invoice.
What if I purchase online AND in-house/phone? " You will be invoiced separately--one for online purchases with 20% BP, and the second for 20% BP. The same conditions above apply regarding discounts.
When will I receive my invoice for phone/absentee bidding? " We typically e-mail invoices by Monday afternoon after the auction. However, unforeseeable circumstances may delay the process of generating invoices, which is why we note in our Terms & Conditions within 3 days. Do you accept PayPal? " Sorry, we do not accept PayPal at this time. Will I get an invoice receipt? " Yes, you will receive an invoice receipt via e-mail upon settling your balance. Please note, if you paid during the auction weekend, it may be late Monday after an auction to receive your e-mail receipt. If you still have not received one by Tuesday, please contact us.
GA Sales Tax: If you are a Georgia Resident 7% sales tax will be added to your sales total on merchandise except for automobiles and motorcycles.

AUCTION HOUSE TERMS REFERRING TO ART:
Replica: The auction house believes that the artist him/herself made this work as a replica of their own, previous original.
Attributed to: The auction house finds it likely that this is an original work but is not prepared to guarantee this.
His Studio. The auction house believes that the work was made in the artist's studio and possibly under their supervision.
His circle. The auction house believes that the work was made by another artist but during the lifetime of the named artist and in their manner.
Follower of. The auction house believes that the work was done in the manner of the named artist, during their lifetime or later.
In the manner of. The auction house believes that the work is done in the manner of the named artist but possibly after their lifetime.
After. The auction house believes that the work was made by another artist, based on an original work by the named artist.
The successful bidder is the highest bidder acknowledged by the auctioneer not any electronic bidding reports.
In the event of any dispute between bidders, or in the event of doubt on Four Seasons Auction Gallery's part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, Four Seasons Auction Gallery's sale record is conclusive.
While many items in the auction will be sold without reserve, the auctioneer and company representatives withhold the right to bid for business or personal reasons on behalf of any consignor for the purpose of protecting a reserve established by the consignor; that is, placing bids during the auction if and when the highest outstanding bid is less than the reserve on the item(s) being offered.
On behalf of absentee bidders, absentee bids and phone bids will be executed by Four Seasons Auction Gallery auctioneer or company representative in a competitive and confidential manner.
Phone bid arrangements must be made 24 hours prior to start of the auction.
Aardvark Antiques, LLC will not be responsible for failure to execute absentee or phone bids or electronic bids not received before the auctioneer hammer falls to determine final bidder.
The purchaser assumes full responsibility for any and all items at the fall of the hammer.
A 20% buyer's premium will apply for internet bidders of each lot purchased and it will be considered part of the total purchase price. Buyer's premium will automatically go to 25% if the buyer delays payment past the terms of the auction.
8. All purchases will be subject to a 7% HALL Co/Georgia sales tax unless the purchaser possesses a valid tax-exempt number. Four Seasons Auction Gallery must have a blanket exemption certificate with permit number and signature on any tax-exempt sale. Buyers may be exempt from sales tax if item is shipped out of state by a registered shipper and shipping documents are provided to auction by shipper depending on your state. No Exceptions!
9. PAYMENT -ANY PURCHASES FROM OUTSIDE THE UNITED STATES MUST BE PAID BY BANK WIRE TRANSFER... All items purchased in house must be paid for on the day of the auction in cash, personal or company check with proper ID, cashier's check, traveler's check, money order, Visa, MasterCard, Discover, or American Express. Any inhouse bidder not paying the day of the auction will be charged 25% buyer's premium, 1.5% interest and $10 a day per item storage. Internet bidders must pay for items within 3 working days of auction to avoid buyer's premium going to 25%. Unless prior arrangements have been made with management, items purchased in person at the auction and not paid for the day of the auction will be charged to the credit card you registered with.
All items purchased through absentee and phone bidding will be paid for with the credit card listed on the Absentee Bid Form and the Phone Bid Form, both of which are available at the gallery or online at our website.
Four Seasons Auction Gallery will email you an invoice within 36 hours from the date of the sale. We accept cash, personal or company check with proper ID, cashiers check, traveler's check, money orders, wire(bank) transfers, Visa, MasterCard, Discover, or American Express.... FOUR SEASONS TERMS AND CONDITIONS OF AUCTION SUPERCEED ANY AND ALL AGREEMENTS YOU MAY HAVE WITH YOUR CREDIT CARD COMPANY REGARDING CHARGEBACKS....ALL NON-US BUYERS MUST PAY VIA WIRE TRANSFER TO OUR ESCROW ACCOUNT. ALL JEWELRY AND VEHICLES MUST BE PAID VIA WIRE TRANSFER TO OUR ESCROW ACCOUNT.
Failure to make payment arrangements within 5 days following the auction will result in a non paying bidder being placed on your live auction account. If paying by check, Four Seasons Auction Gallery reserves the right to hold the property until the check has cleared. Make checks payable to Four Seasons Auction of Forsyth Escrow.
ANY BIDDER NOT PAYING FOR ITEMS PURCHASED WITHIN 5 WORKING DAYS OF AUCTION WILL AUTOMATICALLY HAVE BUYERS PREMIUM RAISED TO 25%, INCURR LEGAL COSTS OF MINUMUM OF $275.00 BUT NOT LIMITED TO ANY COST INCURED NECCESSARY TO COLLECT FUNDS OWED TO AUCTION GALLERY. THIS WILL BE IN ADDITION TO TERMS ABOVE. BY SIGNING UP FOR THIS AUCTION YOU HAVE AGREED TO THESE TERMS, YOU HAVE AGREED THAT PLACING A BID AT AUCTION IS A LEGAL CONTRACT TO BUY AND PAY FOR THE ITEMS UNDER THESE TERMS LISTED. YOU UNDERSTAND THESE TERMS WILL BE STRICKLY INFORCED AND YOU AGREE TO ABIDE BY THEM.
IF YOU HAVE NO INTENTION OF PAYING FOR ITEMS PURCHASED AT AUCTION, PLEASE DO NOT BID, AS WE ARE LEGALLY BOUND BY ESTATES AND TERMS ABOVE TO COLLECT.
10. SHIPPING - It is the buyer's responsibility to arrange for and pay for shipping. NO EXCEPTIONS! For online bidders we will provide the names and numbers of several local shippers or you can use a shipper of your choice.
All property should be removed from our premises no later than 6:00 P.M. of the seventh business day following the end of the auction. Unless prior arrangements have been made with Aardvark Antiques, LLC IN WRITING!
Items not removed by the specified time will be charged storage and handling fees of $10.00 per item, per day until removal.
Please note that removal deadlines are strictly enforced. NO EXCEPTIONS! Items that are not picked up will be sold for storage asap after 7 days.
Four Seasons Auction Gallery reserves the right to withdraw any lot at any time before the auction without liability.
The auctioneer reserves the right to reject any bid not commensurate with the value of the property offered.
A range of estimates is given on each lot with a low and a high estimate. Estimates should not be relied on as a prediction of the actual selling price. Items may sell above or below estimates depending on condition, availability, market trends, or economic conditions at the time of auction. NO ESTIMATE IS DEEMED AS A GUARANTEE AS TO VALUE.
If any applicable conditions herein are not complied with by the purchaser, in addition to other remedies available to it by law, including without limitation the right to hold the purchaser liable for the total purchase price, Four Seasons Auction Gallery at its option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property at public auction without reserve or minimum selling price, and the purchaser will be liable for any deficiency and costs, including handling charges, expenses of both sales, the commission on both sales at a 25% rate, all other charges due hereunder and incidental damages plus legal fees incurred.
These terms and conditions of sale, as well as the respective rights and obligations of Four Seasons Auction Gallery and any purchasers or bidder at any sale of Aardvark Antiques, LLC, shall be governed by and construed and enforced in accordance with the laws of the State of Georgia, state where auction is conducted, state where bidder lives or does business, at auctioneers discretion.
All firearms are sold under strict guidelines of FFL licensed dealers, all State, Local and Federal guidelines. Background checks if required are at buyers' expense, shipping of firearms from State to State will be at buyers expense.

Items can be picked up on the day of the auction when the auction ends. In addition the items can be picked up at the auction house 10am - 3pm the following day of the auction. If you cannot pick up items during that time, call us to set an appointment to pick up your items in the first week following the auction. Mon - SAT, 10am -2pm.

Since you do not handle shipping, who contacts the shipper? Can you do it for me if What if I pay extra?
Unfortunately no, we are unable to contact shippers on behalf of buyers. Please note that you must contact your shipper directly to arrange payment and services. We only release merchandise to the shipper, or delivery agency of your choice, after the item has been paid-in-full. Our address for the shippers to pick up from is:

How do I have my merchandise released?
In order for items to be released to a shipper or delivery agency, please notify us of your arrangements in writing via e-mail.. Since we want to ensure that merchandise is released to the appropriate party, we cannot release items by phone.
Are you open on weekends? May I pick up before 10AM or after 5PM?
Since we have a small staff, and are quite busy after an auction. Pick-up the Monday AFTER the auction is 10am - 3pm at our location in Oakwood, GA. Any pick-ups after that day must be picked up at our Oakwood, GA location during normal business hours (Monday-Saturday 10-2pm). We do understand that sometimes items may need to be picked up at a different time and will try to accommodate if possible. Please contact us to schedule a pick-up time if meeting normal business hours is impossible. If not picking up on the day of the auction or the following day you must PLEASE MAKE AN APPOINTMENT TO PICK UP ITEMS. Items not picked up within 30 days after the auction will be donated.
Will someone from Four Seasons Auction Gallery help me load my items into my car/truck/van?
Generally, it is the responsibility of the buyer to handle the pick-up of merchandise due to potential liability. Please factor this into your pick-up of very large/heavy items. If we have guys there however, of course we will help.
Can you remove glass from frames, items from bases, etc., for the shipper to pack?
Like loading items for customers, altering or removing parts of an item for a shipper or delivery company is not something that we typically do due to liability. However, if such a situation occurs, we ask that you submit your request in a written statement prior to the handling of your merchandise.
Can I use a different shipping or delivery company than the ones on your preferred list?
Absolutely. You are welcome to select whatever company or individual you would like to ship or deliver your items.
Why are shipping estimates so expensive for my merchandise?
Please note the following when factoring your packing/handling quotes:
•The majority of the shipping cost is typically the packaging/handling cost.
•Generally speaking, it is difficult to find shippers that will handle your items without a base handling fee, i.e. even if an item is small, it will be subject to a minimum handling fee, determined by the shipping company of your choice.
•Since the shippers are out of house and are less familiar with the items, at times, you may pay slightly more, or less, based on the shipper's calculations of an item's weight and/or dimensions.
What should I do if I have difficulty with a shipper?
At Four Seasons, we are very committed to customer service and getting items to buyers. As such, we will assist in the process should you have difficulty with a given shipper. If you are having trouble getting a response back or encounter another issue, please let us know so that we can try to help resolve the issue.
Items left for more than 30 days will be sold for storage unless other arrangements in writing have been made with Four Seasons Auction Gallery.
