9. SHIPPING:

Bucklin Auctions' standard shipping policy is:

Purchases must be paid in full before any packing/shipping will be completed. Purchases are not contingent upon shipping costs. Shipping, handling and insurance costs are the responsibility of the winning bidder. Upon completion of the auction Bucklin Auctions will send an invoice to winning bidders with the cost of shipping included.
Regardless of shipping method, our auction house must have received cleared funds to release property for shipping.

Bucklin Auctions ships all books, photographs and art in house (except large and framed photographs, art and furniture, which, at our discretion, may require the buyer to use an outside shipping agent). Bucklin Auctions charges actual shipping costs and insurance (via USPS; or, if requested by the winning bidder, by UPS or FED EX). Depending on the size of each item, Bucklin Auctions adds a flat $10 to $25 handling and packing charge for all items shipped directly by Bucklin Auctions. This charge is in addition to any insurance and/or the actual cost of shipping. All packing and shipping charges are non-refundable.

Once the item is shipped, the winning bidder, NOT Bucklin Auctions, shall be fully responsible for any damage, loss or delays caused by USPS, UPS, FED EX (or any other shipping agent). If a loss or damage should occur during shipping, it is incumbent upon the buyer to file for recovery of any losses incurred.

If required by Bucklin Auctions, large and framed photographs, art and furniture must either picked up, or have shipping arranged by an outside agent within 10 business days following the auction date. If you need assistance with shipping, Bucklin Auctions will put you in contact with a shipping team that focuses on post-auction shipments.

Bucklin Auctions will not be responsible for loss or damage to items left on premises over 10 business days. After 10 business days, all unclaimed lots may be re-listed for sale. 21 days from the auction date, remaining property, paid or unpaid, will be considered abandoned and revert to Bucklin Auctions ownership.

Terms and Conditions

PLEASE REVIEW THE FOLLOWING TERMS CAREFULLY BEFORE BIDDING. BY REGISTERING AND USING THE SERVICES OF THE SITE AS A BUYER, YOU AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OF THIS AGREEMENT AND ALL POLICIES AND GUIDELINES INCORPORATED BY REFERENCE HEREIN.
1. BUYER'S OBLIGATIONS:

Buyer will honor all bids placed in an auction and is obligated to complete the transaction if you are the winning bidder. The winning bid is defined as the highest bid in an auction without a reserve, and/or the highest bid in a reserve auction that meets or exceeds the reserve price. You acknowledge that by not fulfilling these obligations, your action or inaction may be legally actionable.

2. AS IS:

ALL property is sold AS IS and all sales are FINAL. THE AUTHENTICITY OF PROPERTY LISTED IN THIS CATALOGUE IS SOLD "AS IS" AND NEITHER BUCKLIN AUCTIONS NOR THE CONSIGNOR MAKES ANY WARRANTIES OR REPRESENTATIONS OF ANY KIND OR NATURE WITH RESPECT TO THE PROPERTY OR ITS VALUE, AND IN NO EVENT SHALL THEY BE RESPONSIBLE FOR CORRECTNESS OF DESCRIPTION, GENUINENESS, ATTRIBUTION, PROVENANCE, AUTHENTICITY, AUTHORSHIP, COMPLETENESS, CONDITION OF THE PROPERTY OR ESTIMATE OF VALUE. NO STATEMENT (ORAL OR WRITTEN), DURING THE SALE, OR ELSEWHERE SHALL BE DEEMED SUCH A WARRANTY OR REPRESENTATION, OR ANY ASSUMPTION OF RESPONSIBILITY.

BIDDER AGREES THAT EVERYTHING IS SOLD AS IS AND THAT THEY MAY NOT RETURN ANY ITEM THEY PURCHASE. PLEASE ASK ALL QUESTIONS PRIOR TO BIDDING. YOU MUST KNOW WHAT YOU ARE BIDDING ON. All items are sold with the buyer being the expert. Bucklin Auctions is providing internet preauction and live bidding as a service to bidder. Under no circumstances shall bidder have any kind of claim against Bucklin Auctions or anyone else if the internet service fails to work correctly before during or after the live auction. The auctioneer is not responsible for bidder errors, auction platform errors, electronic device errors, internet errors, phone bidding errors and or other bidding mishaps. Bucklin Auctions will not be responsible for any missed bids from any source. Estimates published, showing both a high- and low-end range for each item, are of the opinion of Bucklin Auctions as to the fair auction value for each item. Bucklin Auctions makes no warranties as to finite value for item(s) sold. In no event shall Bucklin Auctions be held responsible for having made or implied any warranty of merchandise or fitness for a particular purpose of any item. The bidder is the sole judge of the value of any item sold. You as the bidder decide the final price.

3. WITHDRAWL:

Bucklin Auctions reserves the right to withdraw lots prior to the commencement of each auction. If a bidder wishes to withdraw a bid they must do so no later than the day before the auction by going to their auction account or contacting the auction platform. Bucklin Auctions cannot access or cancel bids. Contacting Bucklin Auctions is not equivalent to a bid cancellation and unless the bid is cancelled on the bidding platform by the bidder, the bidder is responsible for the bid.

Bucklin Auctions reserves the right to reject any bid. In the event of a dispute between bidders, or in the event of doubt on our part as to the validity of any bid, the auctioneer will have the final discretion whether to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sale records are conclusive. Although in our discretion, we will execute other order bids or accept telephone bids as a convenience to clients who are not present at auctions, we are not responsible for any errors or omissions in connection therewith.

4. RESERVES:

Some lots may be offered subject to a reserve, which is the confidential minimum price below which such a lot will not be sold. We may implement such reserves by bidding on behalf of the Consignor and Bucklin Auctions may act to protect the reserve by bidding through the auctioneer. The auctioneer may open bidding on any lot below the reserve by placing a bid on behalf of the seller. The auctioneer may continue to bid on behalf of the seller up to the amount of the reserve either by placing consecutive bids or by placing bids in response to other bidders.

5. WINNING BIDDERS:

The highest bidder, whether in the salesroom, absentee, on the telephone or online will be acknowledged and recorded by the auctioneer. On the fall of the auctioneer's hammer, title to the offered lot or article will pass to the highest acknowledged bidder, who thereupon (a) immediately assumes full risk and responsibility therefor, (b) will immediately sign a confirmation of the purchase therefor, setting forth his name and address, and (c) will immediately pay the full purchase price therefor.

If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to Bucklin Auctions and the Consignor by law (including without limitation the right to hold the purchaser liable for the bid price), Bucklin Auctions, at its option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser, or (b) resell the property, either publicly or privately, for the account and risk of the purchaser, and in such event the purchaser shall be liable for the payment of all deficiencies plus all costs, including warehousing, the expenses of both sales, and Bucklin Auctions' commission at its regular rates and all other charges due hereunder.

6. SALES TAX:

All purchases are subject to 8.875% New York State sales tax with the following exception: registered re-sellers are exempt from state and local sales tax, however, completed resale certificates in the name of the business must be provided to Bucklin Auctions prior to the time of purchase.

As per NY State Department of Taxation and Finance Notice, TB-ST-155, New York State sales tax is applied if tangible personal property is delivered to or transferred to the possession of a purchaser's agent, representative, employee, or a private or contract carrier hired by the purchaser, the location of transfer determines if sales tax is due, regardless of the ultimate destination of the merchandise.

7. PAYMENT: If you are a successful Internet Bidder.

The purchase price paid by a purchaser shall be the sum of the final bid and a buyer's premium of 20% of the hammer price. For Invaluable.com and Liveauctioneers.com, the additional buyer's premium is 5%.

You will receive an invoice by email 1 to 2 days following the conclusion of each day's auction. In some cases, invoicing may take longer, especially for multiple-lot winners whose shipping size and weight calculations require extra time. If you believe you are a successful bidder and don't receive an invoice, please contact Bucklin Auctions.

Payment is due promptly and within 7 days of receipt of invoice. All items won must be paid for within seven (7) business days or a dispute will be filed with the bidding platform after that period. Once a dispute is filed, claims to unpaid items are void, and the gallery will have full title and claim to the items in order to resell them at auction.

All invoices over $5,000 require a bank transfer, bank issued cashiers check or certified check. All payments must be made in US Dollars.

Purchases paid for by wire transfer, bank check, or cashier's check will be available for release immediately.

Purchases paid for by personal or business check will be held until the check has cleared (please allow 7 business days from receipt of payment).

Payments made by credit card will be released immediately. Absolutely no credit card charge backs will be allowed for any reason.

8. REMOVAL:

No auction lot can be removed from the premises until payment has been accepted and cleared. Bucklin Auctions is not liable for damaged or missing items after they are signed out and removed from the premises. Bucklin Auctions is not responsible for or liable for any lots paid for and not picked up within 10 business days of auction date. By departing from the pickup site you, or your agent, acknowledges that you have all your items and that you are satisfied with them. Bucklin Auctions is not responsible for the acts of omissions of carriers or packers of purchased lots, whether or not recommended by us. Packing and handling of lots by us, or by purchaser is at the entire risk of the purchaser, or purchaser's agent and Bucklin Auctions will have no liability for any loss or damage to such items. No claims are permitted after removing items from the premises, as condition issues cannot be validated once items are released into your possession. Bucklin Auctions is not responsible for damages and or loss of items that are picked up and signed for by your shipper or authorized agent. Items picked up by a third party must have prior approval for pickup from the purchaser and a copy of the paid invoice, and a valid government issued ID.
