AUCTION OF ASSETS OWNED BY ARTE Y NATURALEZA GESPART S.L.
Final liquidation of assets authorized by the court.
Creditors in bunkruptcy proceeding 505/2006. Commercial Court number 6 of Madrid
The assets owned by Arte y Naturaleza Gespart S.L, will be auctioned by Durán Arte y Subastas
next May 6th. The auction will take place in the warehouse where the goods are stored,
located at Avenida Galileo Galilei, 5. 28906 Getafe (Madrid). The auction is subject to following
special Terms of Sale. We draw your attention to the following:
- Lots of this sale can be examinated and collected by appointment only (clauses 1 and
7)
- Terms of payment and item collection (clause 7)
- Methods of payment and collection terms (clause 7)
- Registration of new customers (clauses 2 and 3)
IN COMPLIANCE WITH DATA PROTECTION LAW, INTELLECTUAL PROPERTY LAW AND FOR
SECURITY REASONS, VIDEO AND AUDIO RECORDINGS, OR PHOTOGRAPHS ARE NOT
ALLOWED IN THE WAREHOUSE DURING THE EXHIBITION DAYS, OR DURING THE AUCTION.
1. EXHIBITION OF THE LOTS
In order to allow a perfect examination and knowledge to the buyers, lots to be
auctioned will be exposed in the warehouse of Arte y Naturaleza Gespart S.L., located
at:
Avenida Galileo Galilei, 5. 28906 Getafe (Madrid)
The exhibition will be open from April 17th to May 5th, from Monday to Friday from 10
am to 6 pm.
Visits to the exhibition will be by appointment only. Send an e-mail to:
subastaespecial@duran-subastas.com
with the following data:
• Message subject: appointment to examine lots of May 6th auction
• The message should state:
Name and surname
National ID card, passport or driver's licence number
Telephone number
Lots number
Entry to the warehouse will be made after registration by authorized team staff.
2. AUCTION
The auction will be held on Saturday, May 6th, starting at 11 a.m. and will end with the
sale of the last lot.
All clients wishing to bid must be registered in Durán Arte y Subastas at least 48 hours
prior to the day of the auction. No registrations will be made on the day of the auction.
The entrance to the warehouse will be done after registration by authorized team staff.
3. REGISTRATION
People registering for the first time must provide the following documentation:
Individuals: A scanned copy of national ID card (both sides) or accrediting legal
document, valid and provided with photograph. If participating on behalf of a third
party, written authorization of the final buyer accompanied by a scanned copy of the
valid national ID card or legal document with a photograph. The person placing the bid
assumes the veracity of the documentation provided.
Companies: Deed of incorporation of the company; deed of actual ownership; V.A.T.
card; a scanned copy of national ID card or legal document with photograph of the sole
administrator; if the person participating is a legal representative of the company, they
must provide sufficient powers granted by the company in their name and a scanned
copy of their national ID card or legal document with photograph.
4. HOW TO BID
Bids will be increased according to the scale:
From 50 € to 100 € 5 €
From 100 € to 200 € 10 €
From 200 € to 500 € 25 €
From 500 € to 1.000 € 50 €
From 1.000 € to 2.000 € 100 €
From 2.000 € to 5.000 € 250 €
From 5.000 € to 10.000 € 500 €
From 10.000 € to 20.000 € 1.000 €
From 20.000 € to 50.000 € 2.500 €
From 50.000 € to 100.000 € 5.000 €
From 100.000 € to 200.000 € 10.000 €
From 200.000 € to 500.000 € 25.000 €
From 500.000 € hereinafter 50.000 €
You can bid in the following ways:
In person:
those attending the room must be registered in Durán Arte y Subasta system,
show their ID card and fill in a form with their data, at the stand set up for this purpose.
They will be given a paddle with their bidder number.
Absentee bid:
By e-mail to subastaespecial@duran-subastas.com, indicating your name and surname,
ID number, address and telephone number. In the subject: Arte y Naturaleza Auction
Bid.
Log in in www.duran-subastas.com, enter the auction, select the lot, click on the BID
button and indicate the amount of your bid.
By handing in your absentee bidding form at Durán Arte y Subastas office in calle Goya
19, 28001 Madrid or at Arte y Naturaleza warehouse.
Live bidding:
Log in in www.duran-subastas.com, enter the auction and click on DURAN LIVE.
This sale will be also available in Invaluable and Drouot.
The first business day after the sale you will receive an email with the result of your bids.
5. SALE PROCEDURE
Lots will be sold to the highest bidder. Disagreement between two or more bidders or
on the amount that has constituted the highest bid and, in general, any difference that
arises between bidders, will be settled by the auctioneer, who will sell the lot to whom
he deems appropriate, without appeal. If the auctioneer does not resolve on the fly the
disagreement or difference arising between bidders, Durán Arte y Subastas will have the
right to proceed to a new auction of the lot in question at the same session, or may
proceed to a private auction of the same lot.
6. BUYER'S PREMIUM
Buyer's premium, including V.A.T. and taxes, assumed by Durán, is 23% of the hammer
price.
7. PAYMENT AND COLLECTION OF LOTS
Buyer's will have seven (7) calendar days to pay the hammer price, buyer's premium
and other expenses, if any.
Cash payments will not be accepted. Forms of payment accepted will be:
- VISA or MASTERCARD credit card: the card holder shall be the same as the invoice
holder.
- Bank transfer: Transfer shall be made from an account held by the same account holder
as the invoice to:

Items will be collected by the buyer, by appointment only, at the warehouse of Arte y
Naturaleza Gespart S.L. located at Avenida Galileo Galilei, 5 (28906 Getafe - Madrid)
within a period not exceeding 20 days following the date of the auction and provided
that the amount corresponding to the hammer price and buyer's premium (VAT
included) has already been paid.
The established schedule to collect items at Arte y Naturaleza's warehouse will be from
Monday to Friday, from 8:00 a.m. to 6:00 p.m., uninterrupted. Last appointment will be
at 5:30 pm.
Appointments will be requested by e-mail (subastaespecial@duran-subastas.com) and
following information will be provided:
• Subject of the message: Collection of lot/lots number & Buyer's name
• Buyer's name and surname
• Buyer's national ID card, passport or driver's licence number.
• Buyer's contact telephone number and e-mail
• Name and surname, national ID card / passport / driver's licence of the
person authorized by the buyer to collect the ítems; or transport
company along with the tracking number of order
• Lots to be collected.
• Proof of payment
And in accordance with the following premises:
1. Appointments will be given at least two (2) days in advance of the
scheduled collecting date. These two (2) days are necessary for
warehouse personnel to locate and prepare the lots to be collected.
2. No simultaneous appointments will be given. There will be 15 minutes
between appointments.
3. Customers will not be quoted outside of the established collecting time
4. Works will be delivered with the packaging they had. It will be buyer's
responsibility to bring material to pack the lots.
5. No quotations will be given to buyers who have not paid the total
amount of the lot/lots to be collected.
Lots must be collected on the day appointed for this purpose
8. LOTS PAID AND NOT COLLECTED
A 10 € / day storage charge will be generaterd in favor of Arte y Naturaleza for lots paid but
not collected on the date indicated for that purpose, with a máximum of fifteen (15) days.
If finally the goods are not collected within this additional period, it will determine the
resolution of the purchase and Arte y Naturaleza will receive -deducing it from the price
already paid- both the amount corresponding to the storage costs referred to ut supra and
fifty percent (50%) of the amount already paid, as compensation; in case of remainder in
favor of the buyer, it will be returned and in case of balance in favor of Arte y Naturaleza,
it will proceed to claim it, plus the corresponding interest and expenses.
9. UNSOLD LOTS
Unsold lots will be automatically consigned for direct sale in the different comercial media
and electronic systems on www.duran-subastas.com, at the same starting price as auction,
plus 23% buyer's premium (including taxes and VAT).
Payment terms and requirements for collection of the lots will be the same as those
established for the auction (clauses 6 and 7).
10. SPECIAL PERMITS
Buyers are responsible for obtaining and providing, at their sole cost and expense, the legal
and administrative documentation, licenses and permits of any kind, including export and
import permits, which may be required by the public authorities and administrations,
national and international, for the legal transport of the lots purchased.
11. RETURN POLICY
No exchanges or returns will be admitted. All lots are offered "as is", meaning that the items
are sold with all existing faults and imperfections.
Buyers should take into account that this is a final liquidation of assets of a commercial
company in bunkruptcy proceeding.
Only in the event that - exceptionally - the item received by the buyer does not correspond
to the description or has significant damages not indicated therein, must be communicated
to Durán within a maximum period of fourteen (14) days, which, in agreement with Arte y
Naturaleza, will proceed to respond to the claim, depending on the circumstances of the
case.
Shipping Terms
Items will be collected by the buyer, by appointment only, at the warehouse of Arte y
Naturaleza Gespart S.L. located at Avenida Galileo Galilei, 5 (28906 Getafe - Madrid)
within a period not exceeding 20 days following the date of the auction and provided
that the amount corresponding to the hammer price and buyer's premium (VAT
included) has already been paid.
