IN 1918 ..........PROVENANCE : "Here is the historical provenance, going back to 1918, in regards to my father's (2nd cousins with David Anderson alias Billy Wilson) side of my family, my grandfather, Tomas Anderson to be specific; and how he and my Anderson family came to own the subject photograph, starting in 1918. My grandfather received this photograph directly from the widow of Billy Wilson/David Anderson (he took back his birth name of David Lawrence Anderson, after BTK was murdered in 1881). My grandfather was a second cousin as well as on a friendly basis with David Anderson and family, after Dave assumed the job of a sheriff in the Texas where both families lived. When my grandfather and family went to pay their respects to the widow of David Anderson at his 1918 funeral, she gifted him with, among other items, a small leather family photograph album ( with the subject photograph inside) which we still have. As well as some clothes and other personal items of her late husband's. She explained to my grandfather's family about the history of the photograph, and how Billy had gifted the photo to her husband before he died in 1881. Although, she wasn't clear as to the exact date that that exchange had occurred. Apparently my grandfather had been living on the east coast at the time when this photographs first changed hands. After 1918, this photograph, with it's historical significance and direct connection to BTK, was carefully preserved by my grandfather and father's families, and, at first, glued into our family's photo album for many years. Then it eventually was passed on to my father, and eventually to myself. This is the provenance of the subject tintype, showing four men: Billy the Kid, and his three Regulator friends: Richard Brewer, Fred Waite, and Henry Brown, playing cards. The above information has been explained to the best of my knowledge."Written by Mr. Tomas Anderson II..............HISTORY : Billy The Kid (born Henry McCarty 1859-1881, also known as William H. Bonney) was an American Old West outlaw and gunfighter who killed eight men before he was shot and killed at age 21. He took part in New Mexico's Lincoln County War, during which he allegedly committed three murders.After murdering a blacksmith during an altercation in August 1877, Bonney became a wanted man in Arizona Territory and returned to New Mexico, where he joined a group of cattle rustlers. He became a well-known figure in the region when he joined the Regulators and took part in the Lincoln County War. In April 1878, the Regulators killed three men, including Lincoln County Sheriff William J. Brady and one of his deputies. Bonney and two other Regulators were later charged with killing all three men. Bonney's notoriety grew in December 1880 when the Las Vegas Gazette in Las Vegas, New Mexico, and The Sun in New York City carried stories about his crimes. Sheriff Pat Garrett captured Bonney later that month. In April 1881, Bonney was tried and convicted of the murder of Brady, and was sentenced to hang in May of that year. He escaped from jail on April 28, 1881, killing two sheriff's deputies in the process and evading capture for more than two months. Garrett shot and killed Bonney aged 21 in Fort Sumner on July 14, 1881. During the following decades, legends that Bonney had survived that night grew, and a number of men claimed to be him...............Richard M. "Dick" Brewer (February 19, 1850 - April 4, 1878), was an American cowboy and Lincoln County, New Mexico, lawman. He was the founding leader of the Regulators, a deputized posse that fought in the Lincoln County War. Brewer was born on February 19, 1850 in St. Albans, Vermont. At the age of four, he and his family moved to Boaz, Wisconsin. Brewer moved on to Missouri before arriving in Lincoln County, New Mexico. Brewer tried farming as a profession, and he bought a farm in Lincoln County with this in mind. In the spring of 1871, Brewer began working for Lawrence Murphy, but soon left that job. By 1876, he was working as a cattle foreman for cattleman John Tunstall, owner of one of the largest farms in the area. On February 18, 1878, Tunstall was murdered. After Tunstall's murder, a posse was deputized to serve arrest warrants on his killers, with Brewer chosen to lead the posse. The Regulators originated from that posse, and included Billy the Kid and Jose Chavez y Chavez. Dick Brewer established a bond of friendship with Billy the Kid, Chavez and the rest of Billy the Kid's gang, and he was often accompanied by gang members. Being one of the founders of the Regulators, Brewer sometimes assumed a leadership role when around Billy, Chavez and the rest of their company, and was the first leader of the Regulators during the early stages of the Lincoln County War. The pair remained friends until Brewer's death, and evidently he followed Brewer's lead. Brewer was the most mature of the group, by all accounts, and the rest of the Regulators accepted him in that role...............Frederick Tecumseh Waite, occasionally spelled Fred Wayte (born September 23, 1853 - September 24, 1895), was a Chickasaw cowboy who joined Billy the Kid's gang. His father was a farmer and operated a trading store and stage stop southeast of Pauls Valley in the Chickasaw Nation. Waite left Indian Territory to work as a cowboy in the New Mexico Territory. While working for John Tunstall as a ranch hand, he met Bill Bonney and several other men who worked for Tunstall. After Tunstall was killed in the Lincoln County War, Bonney, Waite and the others called themselves the Regulators while they pursued Tunstall's killers. After that, they became known as the "Billy the Kid gang." In 1880, Waite left the gang, returning to live in the Chickasaw Nation. Waite married, became a rancher and started a family. He lived a law-abiding life thereafter and became involved in Choctaw and Chickasaw politics. Elected to the legislature as a representative both as a representative and as a senator, he was even elected Speaker of the House for three sessions. Then he was appointed Attorney General of the Chickasaw Nation. He died of rheumatism at the age of 42. ............Henry Newton Brown (1857 - April 30, 1884) was an American Old West gunman who played the roles of both lawman and outlaw during his life. In 1877, Brown landed in the New Mexico Territory, and became embroiled in the Lincoln County War. Brown joined Billy the Kid and cowboys as "The Regulators", working John Tunstall's Rio Feliz Ranch. On April 1, 1878, Brown, Billy the Kid, Jim French, Frank McNab, John Middleton and Fred Waite ambushed and murdered Lincoln County Sheriff William Brady, who was indirectly responsible for the death of Tunstall. Three days later, at the Gunfight at Blazer's Mill, Brown and the Regulators engaged in a gunfight with Buckshot Roberts, another man they believed involved in Tunstall's murder. Roberts received a serious gunshot wound from Charlie Bowdre which later proved to be fatal, but not before he managed to kill the Regulators' nominal leader, Richard M. Brewer. Retreating into proprietor Blazer's office, Roberts continued a prolonged firefight with Brown and the Regulators. He died the next day. The inaccuracies regarding the chain of ownership as described in the auction are a mistake of omission soley on my part rather than purposeful. This was done innocently rather than with malice of forthsight. In addition, the inaccuracies were made without the prior knowledge or approval of the auction house: Sofe Design Auctions. My family, the Anderson’s of Texas and Arizona, received the subject tintype, which was inside of the herein described leather photo album in 1918. It stayed in my family through three generations continuously until 2010. At that time, I was unfortunately in need of immediate funds for a family crisis, and had no other alternative but to sell the photo. I sold the photo to a gentleman interested in these types of photos. I sold it for a very nominal amount, much less than it’s actual worth. I was very despondent for several years over the loss of the photo, until 2018, when this gentleman I spoke of, suddenly listed the photo on ebay for sale. I then proceeded to buy it back from him at that time, and it has remained in it’s original condition in my family’s possession up to the present day. So, for 100% accuracy sake, the subject photo was in my family’s continuous ownership from 1918, until 2010. Then again, in 2018 to the present day. It is still in the same fine, original condition as when I sold it in 2010, and bought it back in 2018. Any copies or prints other than this original image my family owns and is now selling, are fakes. Credit Card(fees 3.5%) limit 5000 USD. Checks must be drawn on a U.S. bank, and must have the same address as Bidder's Driver License. At Auctioneer's discretion, a money order, cashier's check or bank wire may be required. Failure to provide payment will result in revoking the Buyer's right to participate in future sales with Auctioneer.

ABSENTEE AND PHONE BIDS: All purchases are subject to a 23% buyer's premium.
Full payment must be made within five (5) business days of sale. Payment terms are check, money order, cashier's check or bank wire transfer(40 USD fee), VISA/Mastercard. Credit Card(fees 3.5%) limit 5000 USD. At Auctioneer's discretion, a money order, cashier's check or bank wire (40 USD fee) may be required. Failure to provide payment will result in revoking the Buyer's right to participate in future sales with Auctioneer.

ONLINE BIDS: All purchases are subject to a 25% Buyer's Premium. Full payment must be made within five (5) business days of sale. Payment terms are Invaluable credit card processing service ( cc processing fees are 3.5%), cash, check, money order, cashier's check or bank wire transfer (40 USD fee), VISA/Mastercard (cc processing fees are 3.5%). Credit Card limit 5000 USD.
All successful online Buyers will receive an emailed invoice within ( 24-48) hours of the end of a sale. If the Buyer does not receive notification within (48) hours, Buyer remains responsible for all items purchased and retains the responsibility of providing payment. If Buyer fails to provide cleared funds within five (5) business days of the sale, they will receive a negative feedback report associated with their LiveAuctioneers.com / Invaluable.com/ AuctionZip.com profile and will not be permitted to registration for future sales. All bidders who do not contact us to arrange payment within five (5) business days after the auction may have their credit card charged for the full invoice including all fees without notice. All credit card charges are final and may not be disputed. Disputing credit card charges will put buyers in violation of this agreement and will subject them to legal fees, punitive damages, etc.


TAXES: State and local taxes will be applied to all merchandise. Buyer will be exempt from taxes if Buyer presents to Auctioneer a current resale license number prior to auction.

Endangered Species. Certain property sold at auction such as Huanghuali, Huali, ivory, rhinoceros horn, tortoise shell, coral or whalebone, irrespective of age or value, may require a certificate or license before exportation and additional certificates or licenses upon importation to another country. SOFE DESIGN AUCTIONS suggests that buyers check on their government import requirements before placing a bid. Please note that the ability to obtain an export certification or license does not ensure the ability to get an import certification or license in another country, and vice versa. It is the purchaser's responsibility to obtain any export or import certificates and/or licenses as well as any other required documentation. In the case of denial of any export or import license or of delay in the obtaining of such licenses, the purchaser is still responsible for making on-time payment of the total purchase price for the lot. Although licenses can be obtained to export some types of endangered species, other types of endangered species may not be exported at all, and other types may not be resold in the United States. Please check with third party shippers if you are uncertain about whether a lot is subject to these export/import certificate and license requirements, or any other restrictions on exportation. Please also note that it is the purchaser's own responsibility to identify and obtain any necessary export, import, firearm, endangered species or other permit for the lot. Any notices in the sale catalog reflect SOFE DESIGN AUCTIONS reasonable opinion at the time of catalog and are for bidder's general guidance only. SOFE DESIGN AUCTIONS makes no representations or warranties as to whether any lot is , or is not subject to export or import restrictions.

STORAGE
Immediate removal of purchased merchandise is requested when payment is received, and shall be done at the expense, liability and risk of the Buyer. All arrangements for removal will be at the convenience of Auctioneer. Failure to remove merchandise immediately after completion of payment within the (14) business days following sale completion will be subject to storage fees of 5 USD per day per item.
After (60) days items will be considered abandoned. Auctioneer will apply any deposit to loss, damages, and expense incurred in the resale of merchandise not paid for in full or removed in the time specified and shall retain any balance as liquidated damages.
Auctioneer does not accept responsibility of any agreements reached between Buyer and shippers, or any resulting loss, damage or delay resulting in the use of the shipper.

SALE of SPECIFIC and/or RESTRICTED GOODS
No Guarantee of Authenticity for ALL Jewelry and Jade: Due to the fact
that jade can be bleached and dyed among other techniques, SOFE DESIGN AUCTIONS CANNOT GUARANTEE the authenticity of the COLOR, AGE, or QUALITY of any jade items sold. All Jewelry and Jade will be sold AS-IS, without any warranties. All sales are final NO RETURNS will be accepted. Judgment of such qualities is the sole discretion of the Buyer. No Guarantee of Authenticity for Paintings: SOFE DESIGN AUCTIONS CANNOT GUARANTEE any aspect of the Paintings sold including authenticity, origin, age, quality, medium or provenance.

Endangered Species and CITES Permits: SOFE DESIGN AUCTIONS adheres to the
Texas and Federal laws pertaining to the sale of items containing endangered or protected species, and WILL NOT ACCEPT LIABILITY of items that may include any material such as ivory, rhinoceros horn, tortoise shell, coral, endangered woods, and whalebone. In the event an item is found to contain any amount of these products, it is the SOLE RESPONSIBILITY OF THE BUYER to perform their due diligence and acknowledge any laws and regulations that apply to purchasing, importation and exportation laws. All purchases are subject to State and local sales tax unless Certificate of Resale tax form is fully and completely filled out and received prior to time of purchase. Resale tax numbers from other states are accepted. International buyers are responsible for tariffs, taxes, or assessments of shipped items to the buyer's country.


Shipping Terms

Sofe Design Auctions agents WILL BE offering IN-HOUSE professional packing and shipping services of small/medium/semi-large, non-fragile items for November 22nd, 2019 sale. The charges including professional packaging, materials, shipping, insurance will be calculated, and added to your total invoice.
All items will be carefully packed and shipped fully insured to your address on file with Invaluable.com unless instructed otherwise
Tracking numbers will be emailed.
Please allow up to 2-5 business days to process shipments after payment is received.


RECOMMENDED THIRD PARTY SHIPPERS:
Sofe Design Auctions receives no compensation for shipping referrals. We urge you, the buyer, to obtain shipping insurance and more than one shipping quote. Purchased items not picked up from our auction facility within 14 business days of the auction will be assessed a storage fee of 5.00USD per day, per item. You authorize us to re-sell on your behalf any item not picked up within 30 calendar days. The costs of storage, plus any other costs directly related to the item, and an auctioneer's commission of 25%, will be subtracted from the proceeds unless other arrangements have been made with Sofe Design Auctions. The minimum charge will be 50 USD.

Property not collected within 60 days of the close of the auction will be considered abandoned and any monies paid to SOFE DESIGN AUCTIONS, LLC by the purchaser will be considered liquidated damages.
