Auction is in Miami, Florida. All items are available for examination prior to sale. Bidders are encouraged to examine all items in which they have an interest. We try to accurately describe the items being sold, but all property offered for sale is strictly as is, where is, and with all faults. ALL SALES ARE FINAL AND NO REFUNDS ARE GIVEN. It is the bidder's responsibility to determine the exact condition and authenticity of each item. No statement in this catalogue or by representatives of VBA AUCTION shall be considered as a warranty or assumption of liability. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear or imperfections. Unless noted all items have some amount of acceptable wear, scratches, nicks, etc. for their age. Estimates are of market value and are designed to help buyers gauge what sort of sum might be involved for the purchase of a particular lot. Estimates do not include the Buyer's Premium. Estimates are prepared before the sale and may be altered by announcement before the sale. By bidding, you are entering a contract and you are agreeing that you have either closely examined the items, have chosen not to examine them, or have hired an independent agent to examine the items for you.

Terms: All sales are subject to the terms and conditions of sale. Bidding is available by phone and absentee. A 25% buyer's premium is added to the hammer price of each lot purchased. The auctioneer will also have full discretion to reopen the bidding, cancel the sale or re-offer and resell the property. Should a dispute arise after the auction, our sale record is conclusive.

All lots are sold "AS IS" and without recourse and neither VBA Auction nor its consignor(s) make any warranties or representations, express or implied regarding these lots. Neither VBA AUCTION nor its consignors make any express or implied warranty or representation of any kind regarding merchantability, fitness for purpose, accuracy of the catalog or any other description of the product. physical condition, size, quality, rarity, importance, medium, material, authenticity, attribution, provenance, period, culture, source, origin, exhibitions, literature or historical significance of any lot sold.

Potential buyers are strongly advised to conduct due diligence on any property they are interested in before placing an offer. Due diligence includes, but is not limited to, reviewing the description, condition report, disclaimers and photographs of each lot. Photographs should be considered an indication of condition in addition to the written condition report. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear, imperfections or the effects of aging. VBA Auction is not responsible for the accuracy of any representation of any kind regarding a lot, whether written, photographic or oral, or for any other error or omission in the description or for any defect or defect in a batch. After: A work of art or object made in the style of an artist or creator, the auction house does not take responsibility for the authenticity of the lot Sometimes refers to bronzes or other multiples that may have used an artist's mold or plate, but were reproduced by someone other than the artist. Can also be used to describe a direct reproduction from an original work of art.

Attributed: In our opinion, this may be a work of art by the artist or creator, but unsigned, unmarked and/or lacking proper provenance or expert agreement in the domain.

Bears the Signature: The work is signed, but the work and the signature cannot be in the hand of the artist.

Circle of: The auction house believes this work may be from the same period as the artist and shows his influence.

Follower of: A work executed in the style of the artist but not necessarily by a student, or anyone who worked directly with the artist.

Manner of: Made in the image or style of an artist, with a slight possibility that it was made by the artist or maker or by a disciple or student of the artist or maker.

Maybe: being something that may or may not be true or real. We do not guarantee that this is true.

School: Usually refers to a particular artistic or aesthetic movement. It could also be about an actual school or the followers of a particular artist or creator.

Workshop of / Workshop of: Work executed in the studio or workshop of the artist, possibly under his direction. But someone other than the famous name actually created the work.

Style: After the original period of the style, or a more recent reproduction. In works of art, sometimes used to refer to the style of a particular artist or art movement, usually made long after that period.

Absentee Bids: Arrangements for absentee bidding can be made by completing and submitting the Absentee Bid Form by 5:00 pm the day prior to sale day. This form can be obtained by emailing or calling our office. All bids must be secured with a credit card number. All absentee bids will be executed in a fair, competitive and confidential manner. While every effort is made to execute and honor absentee bids, VBA AUCTION is not responsible for failure to execute a bid and is not liable for any losses incurred as a result of failure to execute absentee bids.
Live Internet Bidding: Live internet bidding is available during the auction VBA AUCTION will not be held liable for live internet bids that are not sent, received, or executed by the administrator. If you are bidding live, real-time on-line, please bid quickly because there is a time delay in receiving live bids.

Payment: You will be invoiced after completion of the auction. Payment is due within 5 business days after the auction contacts you. Any unpaid invoices will be turned over to invaluable and you will be "Tagged" and unable to bid on other auctions until paid in full. Checks, credit cards, and wire transfers are accepted. All items purchased via absentee bid must be paid for within 5 business days of the sale date. If a buyer fails to contact VBA AUCTION within 5 business days following the sale, the credit card used to secure the bid will be charged the amount of the invoice. If paying by certified check, VBA AUCTION reserves the right to hold the item until the check has cleared. In addition, items may be paid for with a properly authorized Visa, American Express and MasterCard. We DO NOT accept Paypal under any circumstances.

Ownership: Item ownership is conveyed immediately following the fall of the auctioneer's hammer. While we always try to store all items with great care, VBA AUCTION will not assume liability for any loss or damage to an item after the hammer has fallen. Bad checks or non-payment of purchases will be prosecuted by VBA AUCTION to the fullest extent of the law, and the names of offenders will be announced to the public and to other auction firms. Buyer pays actual shipping costs, plus handling charges.

Shipping: The purchaser agrees purchases will be removed within 5 days of payement. As the winning bidder, it is the responsibility of the buyer to arrange and pay for packing and shipping for all items. This means the buyer must contact a company of their choice to arrange shipping details. We can recommend various shipping services upon request depending on the item.
