Property shall be picked up directly at our gallery; an appointment is required. If alternate arrangements have not been made and items have not been picked up within fourteen (14) days of the auction, a storage fee of ten dollars ($10) per week per lot will accrue. If thirty (30) days have passed and items have not been picked up from our gallery, they will be transported to an off-site storage facility and a mandatory one-hundred dollars ($100) handling fee will be levied per lot. The handling fee is in addition to the weekly storage fees already accruing. The AUCTION HOUSE reserves the right to sell any unclaimed property once the accrued fees are greater than the purchase price of the item. Regardless, failure by Buyer to remove unclaimed items within six (6) months from the date of the auction will result in the Buyer's forfeiture of items, and any claims thereto, to the AUCTION HOUSE.

REGISTERING TO BID AND/OR PLACING A BID AT AUCTION INDICATES ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS OF SALE.

A BUYER'S PREMIUM OF 25% WILL BE ADDED TO THE HAMMER PRICE OF EACH LOT. Three percent (3%) ADDITIONAL FEE WILL BE ADDED ON CREDIT CARD TRANSACTIONS.

All items are sold "AS-IS, WHERE-IS" WITH ALL FAULTS and WITH NO EXPRESS OR IMPLIED WARRANTIES and ALL SALES ARE FINAL.

Bidders are encouraged to register prior to the day of sale, as automatic bidder approval is not guaranteed.

The auctioneer has the sole right to re-offer a lot and/or settle any disputed bids. In the event of any dispute, the record of sale kept by the AUCTION HOUSE shall be final. At the fall of the auctioneer's hammer, the bidder acknowledged by the auctioneer, whether in person or absentee, assumes the obligation to pay for the offered lot, and shall pay full purchase price for the lot, which shall include hammer price, plus the buyer's premium and all applicable charges and/or costs herein. Payment is expected within three (3) business days of the auction date; interest charges will apply to invoices after the expiration of this period. For payments made by check, merchandise will not be released until ten (10) days after payment is deposited and/or when the check clears.

The auctioneer reserves the right to reject any bid. Some lots may carry reserves or minimum selling prices below which a lot will not be sold. The amount of the reserve shall not exceed the low estimate or requested opening bid. Estimates and opening bids are subject to change at any time prior to the offering of each lot. The AUCTION HOUSE shall not be held responsible for any errors or failures in the execution of absentee bids or bids executed online. In all instances the auctioneer's interpretation of these conditions is final and binding on all bidders.

Payment shall be made by cash, cashier's check, personal or business check, credit card, money order or wire transfer (with an additional bank fee assessed, added to Buyer's invoice) at AUCTION HOUSE's sole option, and is due at the end of the auction. An interest charge will apply to invoices not paid within three (3) business days of the auction. An additional three percent (3% ) will be added for all credit card transactions.

Buyers must notify the AUCTION HOUSE BY EMAIL at [email protected] immediately of their intent to pay with a check or money order. If written notice is not received by the AUCTION HOUSE within forty-eight (48) hours of the end of the auction including the buyer's name, phone number, invoice number(s), the invoice balance shall be charged to the card(s) on-file with the auction platform.

Credit card information on-file with the AUCTION HOUSE will be required for all new buyers intending to pay by check or money order. Payment must arrive by 5 PM EST on or before the tenth (10) calendar day following an auction; for payments not received by this time, the full outstanding balance will be charged to the buyer's card on-file with the AUCTION HOUSE. For payments made by check, merchandise will not be released until ten (10) days after payment is deposited, and/or when the check clears. Sales Tax

Online purchases from Devin Moisan Auctioneers, Inc. may be subject to sales tax, any tax-exempt certificates shall be submitted to the Auction Platform for their processing. Tax exemptions shall not be submitted to the AUCTION HOUSE.
