Terms and Conditions of Auction
All items are shipped in-house. The buyer's premium is 30% for all bids submitted through this bidding portal. By placing a bid you accept the terms and confirm that you have read and understood and abide by those terms.
This is a live auction. If you have questions please contact us before the auction! We provide additional images upon request up to 72 hours prior to the live auction. We are unable to respond to photo request the last 24 hours before the auction or answer questions during the auction.
1. This auction is conducted under the laws of the State of Maryland. All lots are sold as-is, where-is. The property described in this catalogue, as amended by any posted notices or oral announcements during the sale, will be sold by Fairhill Auction LLC (Fairhill Auction) as agent for various owners (the consignors). All property is sold 'as is' and neither Fairhill Auction nor the consignor makes any warranties or representations of any kind or nature with respect to the property or its value, and in no event shall they be responsible for correctness of description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of the property or estimate of value. No statement (oral or written) in the catalog, at the sale, or elsewhere shall be deemed such a warranty or representation, or any assumption of responsibility.
2. The total buyer's premium for all bids submitted is 30% and will be added to your final invoice. Our in-house buyer's premium is 25%, Invaluable charges a 5% fee for using their platform, those fees are itemized on your invoice separately. Payments shall be made by cash, check, money orders, or major credit card. Invoices over $2,000 must be paid by check or bank transfer and all bank wire fees are payable by the buyer.
3. The Auctioneer reserves the right to reject any bid for any reason, at any time, before or during the auction. In cases of clerking errors, third-party bidding platform errors, miscommunication, technical malfunctions, or any other errors, the auctioneer reserves the right to withdraw the lot after the hammer has fallen. The auctioneer is the ultimate authority in the determination of the final hammer price.
4. The Auctioneer reserves the right to withdraw any lot for any reason at any time.
5. Our auctions are offered simultaneously on multiple proxy bidding sites. We also offer direct absentee bidding with Fairhill Auction. Call us for details. In the event of duplicate high bids, the earliest bid received will be the winner as determined by the bidding records. Absentee bids placed here are not considered early absentee bid by the auctioneer. If you need clarification or have further questions please contact us before bidding.
6. Some lots may carry a hidden reserve, any lot that does not meet that hidden reserve will not be sold. Reserves and maximum bids will not be disclosed. You may see a current high bid which is only current information for this portal, not taking into consideration competing bids received by other proxy bidding sites, or absentee bids received directly by Fairhill Auction. The current bid status will be announced by the auctioneer when a lot is opened for live bidding.

[email protected] before bidding. We are not responsible for typographical or photo errors in the description, the description is only provided as a service. All descriptions are personal opinions and not a statement of fact. By participating in the auction and placing a bid you acknowledge that you are satisfied and have fully inspected the item you are bidding on.
8. All items are in used condition unless stated otherwise. Items housed in frames have not been examined outside of the frame. Lots that bear defects or damage not visible because of framing or matting or any other obstructions, will not be subject to return because of hidden damage. Fairhill Auction will not be responsible for premiums paid, shipping costs, appraisal fees, authentication fees, testing, or any other post-auction costs. Under no circumstances will the auctioneer be responsible for lost profits or other financial damages. We do not refund shipping charges, any fees, including the buyer's premium.
9. Any lot containing three or more items is not subject to return for any reason. Dimensions provided in the description are approximate.
10. We are not selling frames or framing glass, the condition of the frame or the glass, including broken glass during transport, is not reason for return. Shipping costs for framed items or glass may vary greatly depending on the size and/or weight of the frame, and at times these charges may be more than the hammer plus buyer's premium. Customers may request us to remove items from its frame to reduce shipping charges. We will accommodate customers for an additional charge of $10.00 per framed item, please note such service will be undertaken at our sole discretion and only after full payment has been received. Fairhill Auction LLC will exercise care in removing items from frames, but this is done ENTIRELY at the risk of the buyer and the buyer fully indemnifies Fairhill Auction LLC for any damage that may occur as a result of any attempt by us to remove the item from a frame, mat, glass, etc.
11. Photographs of lots may have been adjusted for size, color, brightness, or contrast, for display purposes only. We do not guarantee the color of lots displayed online matching the sold items due to variances in external device color calibration.
12. Estimated prices are only suggestions. Actual selling prices may be higher or lower than our estimates.
13. The placing of a bid is a legal contract, you agree to purchase the lot at your highest bid placed, plus the buyer's premium. Bids may not be retracted without our approval. Please think before you bid!
14. The winning bid will always be one bidding increment over the second-highest bid. Bidders may call us at 443-222-8240 during office hours, Monday through Friday 10 A.M. - 5 P.M. EST. Live bidding: Bids entered during the course of the sale by bidders on the floor, on the phone, or live on the internet, will be taken at the amount bid.
15. Please do not call us during the auction to pay. If you won you will receive an invoice from Fairhill Auction by email after the auction, check your email and junk mail. The invoice will have your invoice attached as a PDF file and a secure payment link for credit card payments. If you have difficulties using the link email us or call us at 443-466-8164 during office hours. We may charge your credit card automatically once invoices have been created.
Payment is due immediately upon receipt of your invoice from Fairhill Auction. We accept cash, checks, money orders, all major credit cards, and bank transfers for invoice amounts over $600.
Invoices over $2,000 must be paid by check or bank transfer, buyer pays all bank transfer fees. Maryland residents and any items being picked up in Maryland are charged 6% Maryland sales tax unless a resale number is filed with us prior to the auction.
Fairhill Auction reserves the right to cancel invoices not paid within 12 days and will file a dispute if you don't communicate with us.
Transfer of property rights only takes effect after payment, not by being the highest bidder.
All lots are shipped in-house shipping for your convenience. Shipping charges are automatically added to your invoice. Your invoice email will contain a secure link for easy online payment by credit card.
Please check your email inbox and your junk mail for your invoice, which will be attached as a PDF file. It is the bidder's responsibility to follow up and pay in a timely manner.
NOTE: PayPal is NOT an option for payment.
16. Shipping is fulfilled in-house and the charges are added to your invoice, all packages will be insured for the hammer price only. You may inquire with us for the complete insurance terms.
Packages may take up to 14 days after payment to be shipped from our facility.
We are NOT a warehouse, please do NOT expect your package to be ready the moment you pay. That does NOT include the transit time for USPS or other couriers, for that you will have to contact those companies directly with your tracking information which we email you. We carefully package the items you purchase, which takes time, no exceptions. All items are as described when shipped. We are not responsible for damages that occur through reckless handling and opening of packages.
Shipping, material, insurance, and handling charges will be added to your invoice. International shipping is expensive and we have to follow the new taxation rules in Europe. We are required to ship with tracking and domestic signature confirmation to protect the buyer and the seller from fraud. We will only ship to the address on file and registered with the payment method. Shipping charges are determined by the volumetric dimension and destination. [email protected] and provide us with the lot number and your complete shipping address. We elect to ship via USPS, UPS, DHL, FedEx Ground, FedEx Express for both domestic and international shipping based on the most efficient method deemed by us.
If you have a preference please communicate with us prior to shipping.
It is the recipient's responsibility to communicate with us any requested changes for shipment.
We do not contact you before a package is shipped.
17. Property purchased and paid for by successful bidders but remaining unclaimed after 90 days will be deemed abandoned and the title will be ceded to Fairhill Auction LLC unless you make arrangements with Fairhill Auction LLC to hold items.
18. Although careful precaution has been taken in the preparation of this catalog, we assume no responsibility for omissions or errors. The absence of a condition statement does not imply that an item is in perfect condition or completely free from wear and tear, imperfections, or the effects of aging. Any condition statement is given as a courtesy and is only an opinion and should not be treated as a statement or a fact.
19. By placing of a bid in our auction you confirm that you have read and accept and abide by our terms. By accepting these terms you give Fairhill Auction implied and unquestionable permission to send you emails now and in the future, contact you through email now and in the future, according to American, Canadian, and European regulations.
