1. Acceptance of the Auction Terms and Conditions
By participating in the auction, the participant declares that he/she is fully aware of these auction conditions and that he/she fully agrees with them.
2. Call and Hammer Price
As a rule, the call-out begins with the limit price. The highest bidder is the successful bidder. In the event of disputes between participants regarding the knockdown, the Auctioneer shall make the final decision. The Auctioneer is free to reject a bid without giving reasons and to exclude participants from the auction before and during the auction without giving reasons. The Auctioneer also reserves the right to separate, offer out of sequence, omit or add items from the catalogue before and during the auction.
3. Organisation and conduct of the Auction
The Auctioneer reserves the right to cancel or postpone, interrupt or prematurely end an auction or remove lots from the auction at any time without giving reasons and without liability for damages. The auctioneer may also return to a lot at any time during the auction and call it out again and re-auction it. The auctioneer can also return to the previous, lower bidding step at any time during the bidding process and call out the poster again at this price. Finally, the auctioneer is permitted to correct errors in bids and knockdowns at any time in order to ensure that the auction proceeds correctly.
4. Bids
Orders and bids are binding and can no longer be withdrawn. Orders below the limit price cannot be accepted. Each bidder is personally liable for his purchases and cannot claim to have acted on behalf of third parties.
5. Condition of the Posters
The posters are purchased in the condition in which they are at the time of the knockdown. The auctioneer's warranty obligation shall cease upon acceptance of the bid. The posters can be inspected in detail during the preview. The data in the catalogue, together with any written or verbal information provided, is compiled to the best of our knowledge and belief. However, no liability or guarantee can be assumed for their accuracy. Attributions, periods and dates, condition and any repairs must be verified by the prospective buyer. The buyer cannot return auctioned posters due to omissions or defects in the condition description and cannot withdraw from the purchase contract or refuse to pay the purchase price.
6. Premium and Value Added Tax (VAT)
In principle, all domestic and foreign buyers must pay a premium of 20% on the hammer price. Domestic customers pay an additional 7.7 % VAT on this surcharge.
7. Payment
The invoice must be paid by the buyer within two weeks of delivery of the invoice. Payment can be made in cash at our premises in Zurich or by bank transfer to the following bank account:
IBAN: CH29 0483 5052 3906 4100 0

An additional fee of 4% will be charged on all credit card payments and payments via Pay Pal (
[email protected]).
Invoices not paid within the due date will be handed over to a collection agency and a default interest of 10% p.a. will be added to the outstanding amount. The auctioned item shall not be transferred to the buyer until full payment has been received.
8. Consequences of non-payment
If payment is not made or not made on time, the Auctioneer may either demand fulfilment of the purchase contract or cancel the knockdown at any time without setting a further deadline. In any case, the successful bidder shall be liable for all damages resulting from non-payment or late payment, in particular, if the knockdown is cancelled, for any loss of proceeds, whether because the poster is knocked down to another bidder at the same auction or to a third party at a later auction. The successful bidder whose bid was cancelled shall not be entitled to any additional proceeds.
9. Delivery and dispatch of the Posters
The auctioned items will not be delivered until the invoice has been paid in full. Until then, they will be retained at the buyer's expense and risk. The auctioned posters must be collected from the address given below within four weeks of the close of the auction after payment has been made. If requested in writing, the auctioneer will take care of shipping the posters with all due care, but at the expense and risk of the recipient. The shipping costs for deliveries to Switzerland are generally CHF 40, for deliveries to the EU and UK CHF 70 and deliveries to other destinations CHF 90. This information is non-binding and can be changed by the auctioneer at any time. The goods are insured up to a value of CHF 1,500. Insurance cover for higher amounts is available on request.
10. Applicable Law and Place of Jurisdiction
The above terms and conditions are an integral part of each individual purchase contract concluded at the auction. In the event of any ambiguity between the original German text and translations, the German text shall prevail. Amendments are only valid in writing. The relationship between the parties shall be governed in all respects by Swiss law. The place of fulfilment and exclusive place of jurisdiction is Zurich.
